Zoning: RF Residential F Zoning District Groundwater Overlay: GP Groundwater Protection District . Background: The property is shown on Assessor's records as a 0.64 acre lot commonly addressed as 110 Thankful Lane, Cotuit, MA. The parcel is vacant and is located in the RF Residential F Zoning District, where there is a minimum area requirement of one acre and required frontage of 150'. The applicant is seeking a variance to build on an undersized lot. This parcel was created by the Planning Board in 1968 as part of an 89 lot subdivision known as"Cotuit Commons". At that time, this area was zoned RD-2,with a 20,000 sq.ft. minimum area requirement. The zoning was changed to one acre in March, 1973. Later in 1973, Bass River Savings Bank acquired 72 lots in this subdivision through foreclosure. The lots were checkerboarded before the expiration of the grandfathering period for commonly owned adjacent lots. Former Town Counsel, Bruce Gilmore, noted in a 1979 memo to the former Building Commissioner, Joseph DaLuz, that he believed the lots were buildable lots. The Geographic Information System (GIS) map shows a number of other unbuilt parcels, but these maps reflect building only through 1989. According to the Cotuit Water Department, public water is available on Thankful Lane. The applicant has owned the parcel since 1979. According to the Assessor's records for the neighboring parcels, the applicant has never owned any of the adjacent parcels. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 7, 1997. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 16, 1997, at which time the Board found to grant the variance with conditions Board Members hearing this appeal were Richard Boy, Ron Jansson, Gene Burman, William Garreffi, and Acting Chairman Emmett Glynn. Attorney John Kenney represented the applicant, Allan W. Stewart. Hearing Summary: Attorney Kenney submitted a copy of the deed for the file. Mr. Kenney indicated there was a typographical error on his application. He is seeking a Variance pursuant to Section 3-1.4(5), not Section 3-1.3(5)as written on the application. As background, Mr. Kenney said the lot was part of a subdivision plan approved on February 19, 1968. It was registered in Land Court on August 6, 1968. The petitioners bought the lot on April 13, 1979 and Town of Barnstable-Zoning Board of Appeals Decision and Notice-Appeal No.97-46 Stewart Variance to Section 3-1.3(5)Bulk Regulations-Minimum Area Requirement have owned it ever since that time. It is the only lot they own in the Town of Barnstable. One acre zoning in the area came into affect on March 24, 1973. On February 18, 1975, many lots in the subdivision were checkerboarded, and a mortgage was granted. In 1977, that mortgage was foreclosed and the lots merged. On November 5, 1977, the Town of Barnstable changed the Zoning Ordinance regarding "grandfathering". But for the foreclosure which created the merger problem, this lot would have been protected under that grandfathering provision and considered a buildable lot. Mr. and Mrs. Stewart have been taxed for a buildable lot since their purchase in 1979. They were originally to retire here but now wish to sell the lot. The lot is equal to, or larger than any other lot in the area. There is adequate frontage. If the lot can not be built upon, it would be a substantial hardship for the petitioner. There is a party of interest that would like to purchase the lot if the Variance is granted and a signed Purchase and Sales Agreement will be executed if the relief is granted. For the record, the names of the streets as listed on the original subdivision plan of February 12, 1968 have changed and are correctly listed on the assessor's map. Public Comments: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of April 16, 1997, the Board unanimously found the following findings of facts with reference to Appeal Number 1997-46: 1. The property in issue is owned by Allan W. Stewart, who has filed an application for a Variance for the property located at 110 Thankful Lane, Cotuit, MA. It is located on Assessor's Map 39, Parcel 39 and consists of 0.64 acres or approximately 2/3 of an acre. The property is currently in the RF Residential F Zoning District which requires, among other things, one acre of valuecontiguous upland. 2. The petitioner purchased the property on April 13, 1979 for what was considered fair market value at that time. 3. The surrounding lots in the neighborhood are approximately the same size as locus and the majority of these lots are built upon. 4. Granting the petitioner the relief being sought would not be in derogation of the spirit or intent of the Town of Barnstable Zoning Ordinance nor would it be detrimental to the neighborhood affected. 5. The petitioner has been paying full assessment on this property for taxes to the Town of Barnstable since the purchase in 1979. To disallow the petitioner the right to have this lot be a buildable lot would be a significant hardship to the petitioner. 6. No further findings are made pursuant to Chapter 40A, Section 10. Decision: Based on the positive findings, a motion was duly made and seconded to grant the petitioner the relief being sought subject to the following terms and conditions: 1. The construction shall conform to all the requirements of all applicable boards and agencies in the Town of Barnstable including Health, Building and Conservation Divisions. 2. The development shall conform in all other aspects to all side yard requirements for the district as well as to all requirements of the GP Groundwater Protection District. No lot coverage shall be in excess of 50% and the remaining lot shall remain in its natural state. . 3. In view of the fact that the lot is undersized, any proposed dwelling is restricted to three(3)bedrooms.
