5. The applicant agrees, if the definitive plan is approved, to construct and install all improvements
within the proposed subdivision required by the Rules and Regulations of the Barnstable Planning
Board as in force on the date of this application, and as modified and supplemented by the work
specifications and other requirements set forth in the statements attached hereto.
6. The applicant further agrees to complete all said required improvements within one year from the
date of approval of the definitive unless the Board approves a different period of time.
7. If the definitive plan is approved, the applicant agrees to record or register the plan in Barnstable
County Registry and agrees that even if otherwise authorized so to do by the filing of a performance
bond, applicant will not sell or offer to sell any of the lots within the subdivision until said plan is
so recorded or registered.
8. The applicant further agrees that if the definitive plan is approved, applicant will promptly at any
time thereafter when requested so to do by the Board, convey to the sewer District in form satis-
factory to the Board, title to sewers and the prescribed easements therefor. The applicant also agrees
to convey to the Town title to storm drainage improvements and easements therefor.

9. (a) The applicant further agrees that before final approval of the definitive plan, the applicant will
cause to be filed with the Board a bond in form satisfactory to the Board, conditioned on the
completion of all required improvements in the time and manner prescribed; in a penal sum
sufficient, in'the opinion of the Board, to cover the cost of such work, and executed by the ap-
plicant as principal and a surety company authorized to do business in the Commonwealth
and satisfactory to the Board as surety, or secured by the deposit with the Town Treasurer of
cash or negotiable securities in an amount equal to the penal sum established by the Board.

(b) The applicant requests the Board to approve the definitive plan on condition that no lot in the
subdivision shall be sold and no building shall be erected or placed on any lot until the re-
quired improvements necessary to adequately serve such lot have been completed to the Satis-
faction of the Board.

Town. Office Building, Main Street, Hyannis Mass. on November 21,1966

Motion was made by Mr. Burbank and Mr. Lebel that this plan be endorsed
"that the endorsement does not infer any Planning Board status to the

Robert Jones brought request of Civic Association for meeting with the
Civic Association at Barnstable Fire Station regarding Historical
Zoning. L. Allen Jones Coordinator to call Mr. Barnard to try and
coordinate, with Civic Association.Meeting.
Subdivision #83 Jean L. & Elizabeth Caillouet, Osterville
Called for those in Favor by Chairman. Miss McLellan requested post-
ponement awaiting arrival of Mr. Bearse the engineer. It was so ordered.
Miss McLellan recorded in favor J.C. Brophy also. Harrison Budge re-
quested information regarding no turn arounds. Chairman Ricker
explained the Boards position regarding turnarounds and use of "Ts"
Moved by Mr. Burbank and Mr. Wilber that plan be approved subject to the
endorsement (the paving-see plan) Approval voted Unanimously.
Subdivision#60 Paul C. & Gertrude Brown, Barnstable
Mr. Brown spoke in favor explaining that it is a re-subdivision. Mr.
LaFleur and Mr. Lebel moved that approval be subject to a drainage
easement to be shown up on the plan as per Town Engineer, agreement
of the petitioner, and the Subdivision ,Rules and Regulations. It was
voted Unanimously.
Subdivision #80 Robert J. Williams , West Barnstable - Mercer
Engineering, by Bob Eldridge
Mr. Eldridge was aware of the letter from the Board of Health. Mr.
Eldredge stated he has discussed situation with Board of Health and
pointed out that he can design leaching facilities for sewage dispo-
sal and water supply (on lots 1 through 6) but stated that lot 7
might have to have some fill. Mr. Williams stated that wells are
in exist ance on lot #2. A letter was read from Wilfred Taylor
Chairman of the Wetlands Committee.(see file) It was generally
agreed that the burden is on the petitioner to satisfy the Board
of Health on water and sewage. Petitioners agent requested the

Planning Board withhold action pending negotiation with the Board
of Health. Board agreed in principal.
Subdivision #20 Everett and Bernice D. Jackson, Santuit
Requesting discontinuance of way. Charles Savery spoke and gave
explanation and reasoning for discontinuing the way originally shown.
Mr. Lebel and MR. Burbank moved acceptance subject to Subdivision
Rules and Regulations. It was voted unanimously.
Subdivision #79 Edlen Construction Corp. , Hyannis Mass.
Charles Savery Engineer speaking for the petitioner. Abutters to
the East requested information on water and Board of Health letter
was read stating Town water must be provided. Mr. Lebel and Mr.
Burbank moved acceptance subject to Subdivision Rules and Regulations
and changes and noted by the town engineer, regarding road profiles
and drainage. It was voted unanimously.
.Subdivision #82 William Todd et ux, _Cotuit
Charles Savery Engineer "spoke`��in favor giving background and re-
quested waiving of paving of way as may be noted on plan. There
was no opposition. Mr. Lebel and Mr. Burbank moved approval sub-
ject to Subdivision Rules and Regulations and the waiving of paving
as endorsed on plan. It was voted unanimously.
Preliminary subdivision-Charles E. Dow and William Nye , Santuit &
Wakeby Road-uNewtown"
Mr. Lebel and Mr. Jones moved acceptance subject to Subdivision
Rules and Regulations and correcting of lot 31 to meet zoning re-
quirements. It was voted unanimously.
Preliminary Plan of Donald J. Capeletti was presented 'by Whitney
and Bassett for tentative approval. Shoot Flying Hill Road,
Centerville "Campus Heights"
Mr. Lebel and Mr. Wilber moved acceptance of preliminary plan sub-
ject to Subdivision Rules and Regulations , on variance of grade at one
point to slightly more than 100 if absolutely necessary. It was
voted unanimously.
Definitive Plan of Merle Crocker et als Oyster Harbors , Osterville
PPesented by John Alger attorney requesting public hearing date.
Mr Burbank and Mr Jones moved hearing date be held December 19, 1966
at 8 P.M. in the hearing room. It. Was voted unanimously.
Mr. Lebel and Mr. Burbank moved that the Chairman be authorized to
act on in behalf of the board to release the $600 cash security to
Seagate. It was voted unanimously.
General discussion was held on cluster zoning and green areas. No
action was taken.
General discussion was held on Subdivision Rules and Regulations
and what action should be taken in relation to the recent public
hearing held by the board. Board discussed with Wilfred Taylor
who has analized the Rules and Regulations and made reclmmendations
to the board based on the information received at the public
hearing and discussion by the board.
Mr. Wilber and Mr. Rosario moved that a new -correct copy be pre-
sented to the board at its next regular meeting for its endorse-
went pr6or to ordering to printer. It :was voted unanimously.
It was moved that ,the meeting adjourn at 10 :15 P.M. ,

Although the current assessing records show 28 Todd Way to be a single lot containing 2
dwellings on a 1.28 acre site, a subdivision is on file for this property reflecting a division
consisting of Parcel 1-with 20,010 sq ft and Parcel 2 with 35,500 sq ft. Said plan
recorded in Plan Book 213 Page 151 and dated August 7, 1967
Prior to this action, the parent lot contained a 1 bedroom dwelling (circa 1945).
It is likely that sometime in the early 1960's the Todd's wanted to construct a larger
newer home and likely attempted to obtain a permit to no avail. In fact, according to
assessing, in 1965 a 4 bedroom ranch home was constructed. During that era, this office
was not required to maintain records of permits and no information was on file lending
'clarity to this.issue.
What is known is that the aforementioned subdivision was created but the Todds retained
ownership of both developed lots. Apparently,the assessors have not picked up the
subdivision, which led to some of the confusion and ultimately the appearance of a
nonconforming lot and use being two dwellings on a single 1.28 acre lot. The fact is,
however the applicants achieved the subdivision, it was approved and duly recorded. The
Todds conveyed the two developed together and subsequent conveyance also involved
both dwellings together.

In consideration of the mutual promises and agreements exchanged, the parties hereto agree
as follows(notwithstanding anything to the contrary contained in the Note or Security Instrument):
1. As of OCTOBER 1,2009 ,the amount payable under the Note and the Security Instrument
(the"Unpaid Principal Balance")is U.S.$ 485,691.89 ,consisting of the unpaid amount(s)
loaned to Borrower by Lender plus any interest and other amounts capitalized.
2. Borrower promises to pay the Unpaid Principal Balance, plus interest, to the order of Lender.
Interest will be charged on the Unpaid Principal Balance at the yearly rate of 6.000 %,from
OCTOBER 1,2009 Borrower promises to make monthly payments of principal and
interest of U.S.$ 3,057.58 ,beginning on the 1ST day of NOVEMBER,2009 ,and
continuing thereafter on the same day of each succeeding month until principal and interest
are paid in full. The yearly rate of 6.000 %will remain in effect until principal and interest
are paid in full. If on MARCH 01,2036 (the "Maturity Date"),Borrower still owes
amounts under the Note and the Security Instrument,as amended by this Agreement,Borrower will
pay these amounts in full on the Maturity Date.
3. If all or any part of the Property or any interest in the Property is sold or transferred (or if
Borrower is not a natural person and a beneficial interest in Borrower is sold or transferred)
without Lender's prior written consent,Lender may require immediate payment in full of all sums
secured by the Security Instrument.
If Lender exercises this option, Lender shall give Borrower notice of acceleration. The notice
shall provide a period of not less than 30 days from the date the notice is delivered or mailed
within which Borrower must pay all sums secured by the Security Instrument. If Borrower
fails to pay these sums prior to the expiration of this period, Lender may invoke any remedies
permitted by the Security Instrument without furtlier notice or demand on Borrower.
4. Borrower also will comply with all other covenants,agreements,and requirements of the Security
Instrument, including without limitation, Borrower's covenants and agreements to make all
payments of taxes, insurance premiums, assessments, escrow items, impounds, and all other
payments that Borrower is obligated to make under the Security Instrument; however, the
following terms and provisions are,forever canceled, null and void, as of the date specified in
paragraph No. 1 above:

(a) all terms and provisions of the Note and Security Instrument (if any) providing for,
implementing, or relating to, any change or adjustment in the rate of interest payable
under the Note, including, where applicable, the Timely Payment Rewards rate reduction,
as described in paragraph 1 of the Timely Payment Rewards Addendum to Note and
paragraph A.1. of the Timely Payment Rewards Rider. By executing this Agreement,
Borrower waives any Timely Payment Rewards rate reduction to which Borrower may
have otherwise been entitled;and
(b) all terms and provisions of any adjustable rate rider, or Timely Payment Rewards Rider,
where applicable, or other instrument or document that is affixed to, wholly or partially
incorporated into, or is part of,the Note or Security Instrument and that contains any such
'terms and provisions as those referred to in(a)above.
5. Borrower understands and agrees that:
(a) All the rights and remedies, stipulations, and conditions contained in the Security
Instrument relating to default in the making of payments under the Security Instrument
shall also apply to default in the making of the modified payments hereunder.
i (b) All covenants, agreements,stipulations,and conditions in the Note and Security Instrument
shall be and remain in full force and effect, except as herein modified, and none of the
Borrower's obligations or liabilities under the Note and Security Instrument shall be
diminished or released by any provisions hereof,nor shall this Agreement in any way impair,
diminish, or affect any of Lender's rights under or remedies on the Note and Security
Instrument,whether such rights or remedies arise thereunder or by operation of law. Also,
all rights of recourse to which Lender is presently entitled against any property or any other
persons in any way obligated for, or liable on, the Note and Security Instrument are
expressly reserved by Lender.
(c) Nothing in this Agreement shall be understood or construed to be a satisfaction or release
in whole or in part of the-Note and Security Instrument.
(d) All costs and expenses incurred by Lender in connection with this Agreement, including
recording fees, title examination, and attorney's fees, shall be paid by the Borrower and
shall be secured by the Security Instrument,unless stipulated otherwise by Lender.
(e) Borrower agrees to make and execute such other documents or papers as may be necessary
or required to effectuate the terms and conditions of this Agreement which, if approved and
accepted by Lender, shall bind and inure to the heirs,executors,administrators,and assigns
of the Borrower.
