It was moved that ,the meeting adjourn at 10 :15 P.M. , Respectfully Submitted Bernard Wilber, Clerk F Date: 1/31/2011 To: Building File From: Robin Anderson Re: 28 Todd Way, Cotuit Although the current assessing records show 28 Todd Way to be a single lot containing 2 dwellings on a 1.28 acre site, a subdivision is on file for this property reflecting a division consisting of Parcel 1-with 20,010 sq ft and Parcel 2 with 35,500 sq ft. Said plan recorded in Plan Book 213 Page 151 and dated August 7, 1967 Prior to this action, the parent lot contained a 1 bedroom dwelling (circa 1945). It is likely that sometime in the early 1960's the Todd's wanted to construct a larger newer home and likely attempted to obtain a permit to no avail. In fact, according to assessing, in 1965 a 4 bedroom ranch home was constructed. During that era, this office was not required to maintain records of permits and no information was on file lending 'clarity to this.issue. What is known is that the aforementioned subdivision was created but the Todds retained ownership of both developed lots. Apparently, the assessors have not picked up the subdivision, which led to some of the confusion and ultimately the appearance of a nonconforming lot and use being two dwellings on a single 1.28 acre lot. The fact is, however the applicants achieved the subdivision, it was approved and duly recorded. The Todds conveyed the two developed together and subsequent conveyance also involved both dwellings together. • Bk 20770 P`se s ' uitcim9eeb I,METTE KRENZ,TRUSTEE OF METTE KRENZ REVOCABLE TRUST,u/d/t dated 5/20/1999 and recorded with the Barnstable County Registry of Deeds in Book 12294,Page 19,of Norwalk,Fairfield County,Connecticut In of FIVE HUNDRED THOUSAND DOLLARS AND N0/100 ($500,000.00)PAID Grant to VIRGINIA ANNE KOLVEK,hiss of 28 Todd Way, Cotuit;MA 02635 individually With QUITCLAIM COVENANTS The land, together with the buildings thereon, situated in Barnstable (Cotuit), Barnstable County,Massachusetts, bounded and described as follows: The said premises contain 1.28 acres of land, more or less, and are shown on a plan of land entitled "Plan of Land in Cotuit, Barnstable,Mass.,belonging to Helen M.
