Additionally;MGL chapter 152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." The facts regarding the lot are as follows: 1. The subject lot is shown as Lot 26 on a plan of land dated December 5, 1972. The plan was approved by the Planning Board on January 15, 1973. The plan is recorded in the Barnstable County Registry of Deeds in Plan Book 268, Page 4. A copy of this plan is enclosed for your review along with a copy of the Assessor's Map. 2. The subject locus has .46 acres of land and frontage of 125 feet on an approved way. 3. Lot 26 is presently owned by Anthony J. Alberti, William G. Aliberti and Thomas J. Aliberti. They acquired title to the property from Richard A. Aliberti and Mary T. Aliberti by a deed dated January 23, 1993 and recorded in Book 8418, Page 97. A copy of this deed is enclosed for your review. 4. Richard A. Aliberti and Mary T. Aliberti acquired title to Lot 26 from Sea Lake Corporation by a deed dated June 4, 1979 recorded in Book 2936, Page 261. This transfer was made during the plan protection period afforded lots under M.G.L. c. 40A §6. A copy of this deed is enclosed herewith for your review. 5. When Sea Lake Corporation transferred title to Lot 26 to Richard A. Aliberti and Mary T. Aliberti on June 4, 1979, it put Lot 26 into ownership separate from all abutting lots. Lot 26 has remained in separate ownership from all abutting lots from June 4, 1979 to the present day. 6. My title rundown sheet and copies of the deeds to abutting Lot 25 (enclosed herewith for your review) show that Lot 25 was conveyed into ownership separate from Lot 26 on April 1, 1976 and has remained in separate ownership since that date. 7. Based on the foregoing, it is my opinion that under Section 4-4.2(1) of the Town of Barnstable Zoning Ordinance this lot was not held in common ownership with any adjoining land; the lot has an area greater than the 5,000 square feet of area required and frontage greater than the minimum 50 feet of frontage required; the lot conformed to the existing zoning, if any,when legally created; and was separately owned at the time of the zoning change which made it non-conforming and has remained in separate ownership since that zoning change. Therefore, it is my opinion that this lot is "grandfathered" and may be built upon for residential purposes because the lot conforms with Section 4-4.2(1) of the Zoning Ordinance.
