Assessor's Map/Parcel: Map 021,Parcel 104 Zoning: Residential F&Resource Protection Overlay Zoning District Relief Requested&Background: According to the Assessor's records,the property at issue is a vacant 1.08-acre parcel. The lot in question has only0.88 acres of upland and does not meet the minimum area requirements of zoning. The lot is owned by M.Leonard Lewis and Ann Marie Lewis,Trustees of Halcyon Trust. The applicants,Thomas L. Cadzow and Susan M.Cadzow have a signed Purchase and Sales agreement with the owner. Subdivision Number 336 created the subject lot in 1974. That subdivision was submitted to the Planning Board in December of 1973 and approved by the Planning Board on June 17,1974. It created 9 lots located along two short roadways-Julie and Trudy Lanes-located off Santuit Road. On that subdivision plan the subject lot is labeled Lot# 8. s At the time of its creation the lot contained only40,375 sq.ft.of upland. Although the RF Zoning District required 43,560 sgft.of lot area,the Zoning Bylaw at that time required"70 percent of the required zoning area of such lot shall be upland" (provision C of Section J-IntensityRegulations-Residential Districts). The subject lot met the requirements of Zoning at the time it was created on June 17, 1974. In 1983 that provision of the Zoning Bylaw was amended to require"100 percent of the required zoning area of such lot shalll be contiguous upland."Under MGL Chapte40A,Section 6,the 1974 subdivision plan would have had seven years of grandfathering from anychange in the zoning requirements. Those subdivision grandfathering nights would have expired by 1983 and the amendment to 100%upland would have caused the lot to be undersized and a non-buildable lot. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on July 02,2003, Apublic heating before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 20,2003 and continued to September 17,2003,at which time the Board found to grant the appeal. Board Members deciding this appeal were;Richard L.Boy,Ralph Copeland,Ron S..Jansson,Gail Nightingale,and Chairman Daniel M. Creedon III. Bk 17832 Pq 201 #12360 1 i I Attorneyjohn W.Kenney represented the applicant before the Board. He stated that the property is under purchase and sale agreement. He gave a history of the property and pertinent zoning. The subject lot is larger than abutting lots and taxed as buildable. The 1974 subdivision lots were buildable at the time of creation and had been considered still buildable under zoning. However a merger issue"exists due to the changes in the amount of required uplands and the minimum lot area. In 1983,a zoning amendment was enacted that required buildable lots,to have 100%of the minimum lot area contiguous upland. This lot.does not have one-full area of contiguous upland,it has only0.88 acres of upland and is therefore non-conforming. The merger issue based on upland requirements was not detected when the neighboring lots were conveyed. Mr.Kenney submitted photos of debris being dumped on the land. The Cadzows are seeking to buy the j property and plan to build in 2-4 years.upon retirement. No plans are available now,but building parameters are submitted and:they will live by them. NIr.Kenney noted the hardship is in the fact that no land is available for increasing the existing uplands: The lot is encumbered by the wetlands and the shape created by the wetlands is unique especially when the setbacks are considered and the building envelope is created bythose setbacks. There was a merger issue not detected when two of the three lots were sold. The variance would be granted in conjunction with a deed of conveyance. Public comment was requested and Stanley Goldstein,owner of the abutting property stated that he would j like to see the property built upon. The Board noted that the Purchase and Sales Agreement is outdated and needs to be extended to have standing before the Board. The appeal was continued to September 17,2003 for that extension. At that continuance Mr.Kenney submitted a copy of the extension of the purchase and sales agreement and give a brief summary of the request and variance conditions. a Findings of Fact At the hearing of September 17,`2003,the Board unanunouslymade the following findings of fact: i ! 1. Appeal 115 of 2003 is for a Variance to Section3-1.4(5) Bulk Regulations and to Section 3-53 Resource Protection Overlay District. The subject premises is addressed as 26 TrudyLane,Cotuit,MA and is shown as parcel104 on Assessor's Map 21 and as lot 8 on a plan recorded in the Barnstable Registry of i Deeds in Plan Book 284,Page 98. The applicants are Thomas L.Cadzow and Susan M.Cadzow who have a Purchase and Sale Agreement for the property. 2. Although the propertyhas a total area of 1.08-acres it is undersized in that it has 0.88-acres of contiguous uplands. The propertyis in the Resource Protection OverlayDistrict that requires a minimum of two acres of contiguous uplands to be buildable. i 3. The lot was originally created as a buildable lot and it has been taxed as a buildable lot. 4. This particular lot is vacant and all of the neighboring lots have been build upon. There is no available land that can be added to this lot to make the required two-acres for a buildable lot today. 5: The overall size of the lots is similar to those neighboring lots and construction of a single-family dwelling in conformance to the required setbacks would not represent a substantial detriment to the neighborhood. 6. Variance conditions exist in terms of topography in that a portion of the lot is encumbered with wetlands. The presence of the wetlands creates the hardship warranting the granting of a variance to minimum lot area. Cadzow Y Relief Requested and Background: In this appeal the applicants are seeking a bulk variance to Section 240-14.E, Bulk Regulations, Minimum Lot Area of 1-acre and to Section 240-36, Resource Protection Overlay District, Minimum Lot Area of.2-acres for an undersized lot with 0.92-acres of upland. The applicants are requesting the variance for the undersized lot to be developed with a single-family dwelling of 2,592 sq.ft. (living area) with an attached two-car garage of 832 sq.ft. A site plan for the development of the lot and architectural plans for the home have been submitted to the file. The lot at issue is a vacant lot with a total area of 1.08 acres and owned by Thomas L. Cadzow and �--� Susan M. Cadzow. For standing, the applicant has submitted a copy of a signed Purchase and Sales agreement with the sellers. The subject lot was created in 1974 by Subdivision Number 336, recorded at the Registry of Deeds in Plan Book 284 page,98 and titled "Plan of Land-Cotuit- Barnstable, Mass., prepared for_Ernest W. Kitchen". The subdivision created 9 lots located along two short roadways-Julie and Trudy Lanes- +�` located off Santuit Road in Cotuit. .The lot is shown on the plan as Lot No..8. Although the lot was 1.08-acres in area, it only contains 4.0,375 sq.ft, of upland (0.92-acres). In 1974, at the time of the subdivision approval, zoning only required 70 percent of the lot as upland. The lot was legally created and conformed to the zoning requirements at the time it was created. However, in 1983, that provision of the existing Zoning Bylaw was amended to require 100 percent of the lot area to be contiguous upland. Under MGL Chapter 40A, Section 6, the 1974 subdivision plan had seven years of grandfathering from any change.in the zoning requirements or until 1981. The subdivision grandfathering rights expired two years prior to the 1983 change and effectively caused Lot#8 to become a non-buildable lot. On September 26, 2003,Thomas L. and Susan M. Cadzow were granted Bulk Variance No. 2003.-115 to allow the undersized lot to be buildable. Upon the granting of the variance, the Cadzows t Town of Barnstable,Zoning Board of Appeals—Notice.and Decision Bulk Variance No.2010-002,Minimum Lot Area&Resource Protection Overlay Minimum Lot Area —Olsen purchased the lot from M. Leonard Lewis and/Ann Marie Lewis, Trustees of Halcyon Trust, as evidenced by a deed recorded at the Barnstable Registry'of Deeds in Book .17819,'page 154. The variance was subsequently recorded in Book 17832 page 200. That variance however expired and now the Cadzows intend to sell the property to the Oisens who desire to build upon the lot. Procedural & Hearirig Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December.1, 2009. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. An Extension of Time for Holding the Public Hearing and Filing of the Decision was executed and filed. The hearing was opened January 13, 2010 and continued to March 10,,2010,at which time the Board found to grant the variance with conditions. Board Members deciding this appeal were, William H. Newton, Michael P. Hersey, Craig G. Larson, George T.Zevitas, and Board Chair, Laura F. Shufelt. Attorney John W. Kenney represented the applicants. The hearing was opened on January 13, 2010 and continued at the request of the applicants to March 10, 2010. At that hearing, Attorney Kenney presented a brief history of the lot noting that the lot was legally created in 1973 in full conformity with zoning requirements for that time. The lot.was created under the subdivision control law and grandfathered for 7 years from changes in zoning. In 1983,zoning was amended increasing the upland requirement for a buildable lot from 70% to 100%. This lot, when created, only had 92% upland. It was the only lot in the subdivision that lacked 100% upland and the only lot remaining in the subdivision's ownership. It was rendered non-buildable by that amendment. On September 26, 2003, Thomas L. and Susan M. Cadzow were granted a bulk variance to allow the undersized lot to be buildable. However, that variance was not executed and has expired, Today, the Olsens are requesting a new variance from the Board with the intent for it to be developed with a single family home. Attorney Kenney stated that it is to b ea three-bedroom home.of 2,592. sq.ft. (living area) with an attached two-car garage. The home will conform to all required setbacks and is situated 100 feet off the wetlands and in conformity to all requirements of Title 5 and the local Board of Health regulations. Variance conditions that justify the grant of the variance were presented. Public comment.was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of March 10, 2010,the Board unanimously made the following findings of fact: 1. Appeal No. 2010-002 is that of Christopher J. & Carol L. Olsen seeking a variance to Section 240- 14.E- Bulk Regulations and to Section 240-36- Resource Protection Overlay District to allow for the construction of a single-family dwelling on a lot with 0.92-acres of upland when zoning now requires a minimum lot area of 2-acres of upland. The property is addressed.26 Trudy Lane, Cotuit, MA. 2 Town of Barnstable,Zoning Board of Appeals—Notice and Decision Bulk Variance No.2010-002,Minimum Lot Area&Resource Protection Overlay Minimum tot Area =Olsen 2. The lot was created as a buildable lot. All the neighboring lots are developed and there is no surplus land available to add to the lot to make it conform to the two-acre requirement. The lot is similar in area'to neighboring lots and it can be developed in conformance to all other zoning requirements. 3. The variance conditions were found it.terms of topography as a portion of the lot was encumbered with wetlands and there is a steep slope. Those facts created the hardship. 4. The improvements are all located outside of 100 feet to wetlands; therefore, should be possible without an Order of Conditions from the Conservation Commission. The proposed on-site septic appears to conform to all Board of Health Regulations and Title 5. Decision: Based on the findings of fact, a motion was duly made and seconded to grant Bulk Variance No. 2010- 002 subject to the following conditions: 1. This variance is granted only to the minimum lot area requirements of Section 240-14.E, Bulk Regulations and Section 240-36, Resource Protection Overlay District. All other zoning regulations shall apply. 2. The lot shall be developed in substantial conformance with the plans submitted to the Board entitled "Plans for Christopher and Carol Olsen 26 Trudy Lane, Cotuit, MA 02635", dated October 2009 and consisting of 8 sheets. 3.
