The property is located in an RF Residential Zoning District which requires a minimum 30' front yard, 15' side yard and 15' rear yard setback. The applicant is proposing to construct a one-story porch addition (approximately 385 sq. ft. in area) to the southerly side of the existing dwelling. The proposed addition will be situated to within 15 feet of the property line off Vineyard Road. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on September 17, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened November 17, 1999, at which time the Board granted a Special Permit with conditions. Hearing Summary: Board Members hearing this appeal were Ron Jansson, Richard Boy, Gene Burman, Gail Nightingale, and Chairman Emmett Glynn. Attorney John Alger represented the applicant, David Mugar. Also present was Ronald Mycock, broker for the property. Attorney Alger submitted elevation plans. Attorney Alger explained that the applicant is applying for a Variance to allow for the construction of a 385 square foot addition to an existing dwelling that will be encroach approximately 15 feet into the setback of Vineyard Road (a private unconstructed dirt road). The"road"was never constructed and probably never will be constructed because it only leads to one lot which has an erosion problem and is most likely unbuildable. The"road" is more like a dirt walking path. If this were the side line- no relief would be needed: i Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-138-Mugar Variance to Section 3-1.4(5)Bulk Regulations-Front Yard Setback There was a discussion among the Board Members and Attorney Alger. It was determined the house is pre-existing nonconforming with regard to the setback because it is approximately 27 feet from the setback where 30 feet is now required. Therefore, the proper relief would be a Special Permit pursuant to Section 4-4.3(2) Nonconforming Buildings or Structures Used as Single and Two Family Residences and not a Variance to Section 3-1.4(5) Bulk Regulations. Because a Special Permit is,a"lesser form of relief' than a Variance, the Board can (if conditions are met) grant a Special Permit even though the legal notice stated the applicant was requesting variance relief. The plan was reviewed by Ronald Mycock. The porch will be no larger than 396 square feet and no closer than 15 feet from the lot line. Public Comment: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of November 17, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-138: 1. The applicant, David Mugar, is seeking a Variance to Section 3-1.4(5) Bulk Regulations, however it .was determined the proper relief would be a Special Permit pursuant to Section 4-4.3(2)Alteration or Expansion of Nonconforming Buildings or Structures Used as Single and Two Family Residences. 2. The property address is 50 Vineyard Road, Cotuit, MA as shown on Assessor's Map 016, Parcel 016. The property consists of 1.89 acres and is improved with a two and a half story single-family residence with a living area of approximately 3,100 square feet, according to assessor's records dated 11/03/99. 3. The property is located in the RF Residential F Zoning District which requires a minimum 30' front yard, 15' side yard and 15' rear yard setback. The house was built in the late 1950s/early 1960s and does not conform to the minimum front yard setback and is therefore pre-existing nonconforming which why the applicant is now seeking a Special Permit. 4. The applicant is proposing to construct a one-story porch addition (approximately 385 square feet in area) to the southerly side of the existing dwelling. The proposed addition will be situated to within 15 feet of the property line off Vineyard Road. 5. The subject site is bounded by Vineyard Road to the west and south so a minimum 30 foot front yard setback is required on two sides of the property. 6. The proposed addition is located within 100 feet of a wetland resource area and is, therefore, within the jurisdiction of the Conservation Commission. The applicant has not filed with Conservation. 7. The relief may be granted without substantial detriment to the public good or neighborhood affected and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal No. 1999-138, subject to the following terms and conditions: 1. The applicant is proposing to construct a one-story porch addition (approximately 385 sq. ft. in area)to the southerly side of the existing dwelling. The proposed addition will be situated to within 15 feet of the property line off Vineyard Road. The subject site is bounded by Vineyard Road to the west and south so a minimum 30 foot front yard setback is required on two sides of the property. The applicant is applying for a Variance to Section 3-1.4(5)of the Zoning Ordinance- Bulk Regulations- Front Yard Setback, to permit a porch addition to encroach within 15 feet of the front property line off Vineyard Road where a minimum 30 foot front yard setback is required. Staff Review: The subject lot fronts onto Nantucket Sound to the east. Vineyard Road, a private unconstructed paper road, abuts the property to the south,where the addition is being proposed. Single-family residences abut the property to the north, and to the south and west(across Vineyard Rd.). The submitted site plan shows Pine Ridge Road abutting the locus to the west. The applicant should be aware that Pine Ridge Road has been renamed to Vineyard Road. The improved portion of Vineyard Road is a dirt drive approximately 16 feet wide. The subject.lot, as well as the abutting single-family residential lots, are accessed from this dirt drive. The only lot that would need access from.the unconstructed portion of Vineyard Road is Parcel 17, which is a vacant lot consisting of 0.35 of an acre. According to the application, Parcel 17 is no longer buildable due to erosion. The proposed addition is located within 100 feet of a wetland resource area and is, therefore,within the jurisdiction of the Conservation Commission. As of this writing, the applicant has not filed with Conservation. Alternate Board Member Tom DeRiemer will hear the testimony tonight and can replace any Board Member if necessary. Attorney John Alger represented the applicant,Donald F.Law,Jr. Present was Arlene Wilson, PWS,of A.M.Wilson Associates,Inc. Attorney Alger described the site. There is presently a small cottage. The one-car garage has been removed. The owner went to the Town of Barnstable Conservation Commission in April(1999)seeking permission to demolish the cottage on site and build a new dwelling that would have been partially inside the 50 foot buffer zone. The Conservation Commission would not approve any structure that encroached within 50 feet of the top of the bank even though the top of the bank is a considerable distance from Poponessett Bay. In order to comply with conservation,the applicant is proposing to move the house out of the 50 foot buffer zone and closer to the front property line. But,they need a variance from the Zoning Board of Appeals because the dwelling will encroach into the required 30 foot front yard setback. The house will encroach by 5 feet on one end and 10 feet on the other end. If the applicant were to build a smaller house,they would not encroach on any setbacks. However,Attorney Alger stated that to build a smaller house was not feasible. When you take into account the,50 foot buffer in the rear and the 30 foot setback in the front,a satisfactory house can not be built that justifies the price paid for the lot: The topography of the lot is unique in that much of the lot is unbuildable when you put in all the buffer zone requirements. The shape of the lot is unique due to the.Conservation Commission and zoning restrictions placed on the lot. On the site are some beautiful trees that will act as.a buffer. There-are houses already built on either side of the isubject lot and this proposed dwelling will be in keeping with those houses. As such,.the proposed relief maybe,.granted without substantial detriment to the public.good and without derogating from the intent or purpose of the Zoning Ordinance.. Attorney Alger reported that all of the lot is considered upland,but it is not buildable due to the 50 foot conservation .r. regulation. There is only a small strip.of land(less than 10%)that can be:used for any structure: The proposed house will be approximately 112 feet long including the breezeway and garage. The Board felt this might be a self-imposed,hardship because the proposed house is so large. There was a house on the lot and a new house can be built on the lot-just not as' big as the applicant wants. Attorney Alger disagreed stating.that the applicants were upset with the Conservation Commission's ruling and they have appealed to the DEP and appealed to Superior Court. The DEP told the applicant they could build in the 50 foot buffer but the applicant is still in Superior Court. The applicants have two•proposals. On one plan,the house is within the 50 foot conservation buffer zone but meets the zoning setbacks. On the other plan,the house is outside the conservation buffer zone but encroaches.on the zoning setback. The applicant would like the first plan [within the conservation buffer zone and meeting the zoning setbacks]. The Board requested elevation plans as the new house will be twice as long and three times as big as the old house. Attorney Alger stated he will provide elevation plans and floor plans so the Board can understand the scale of the project and requested a continuance. If the applicant were to build a second story,no zoning relief would be needed,but they do not want a two story home.. Public Comment: Arlene Wilson addressed the Board. She stressed this was not a self-imposed hardship. She indicated that the Conservation Commission is not uniform in its rulings and no one knows what will happen when they go before the Commission. They are not consistent in their rulings and one can not tell from project to project how they will rule. No one else spoke in favor or in opposition to this appeal.
