Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire, express or implied,oral or written." An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership,association or other legal entity,employing employees. MGL chapter 152, §25C(6)also states.that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required." Additionally,MGL ehapter..152, §25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for,the performance of public work until acceptable evidence of comp*fiance with'the insurance requirements of this chapter have been presented'to the contracting authority." GATES AND WINGATE LLOYD "ANR Plan of Land - #250 Vineyard Road, Cotuit, MA", prepared for H. Gates and Wingate Lloyd, dated November 20, 2006, scale 1" = 60'; prepared by BSC Group, West Yarmouth, MA; Assessor's Map 015, portion of Parcel 6. Zoning: RF/RPOD. Clocked with Town Clerk, December 28, 2006 +21 days = January 18, 2007. Keelan Healy of BSC Group addresses the Board regarding the ANR. He states that this is a realignment of the interior area of three existing lots. He states that each lot has 152 ft. frontage and proper access and the shape factor requirement is met. Motion was duly made by Steve Shuman and seconded by Dave Munsell to approve and endorse the ANR plan as not requiring the Planning Board approval under the Subdivision Control Law. There was discussion regarding the access road, Vineyard Road, not being constructed to subdivision standards. It was stated that the lots already exist and the changes are lot lines within the interior to make the lots more usable for the family after the removal of a building. Mr. Keelan stated that these are not the lots with restrictions, however the other lots to the west do have conservation restrictions and the land to the south has a 20-year Land Trust restriction. Unanimous vote in favor. The Planning Board Members signed the mylar and paper copies. SECURITY/LOT RELEASE/UPDATES SUBDIVISION 4305—RUE MICHELE Two "Release of Lots under Covenants" forms were filed along with a Performance Security form by Marcia Elliott for the release of all lots in Subdivision #305 to be secured with a road bond in the amount of$35,000.00. Marcia Elliott addressed the Board regarding her request for the two requests for the release of lots under covenants. Tom Broadrick provided a memo written by the Assistant Town Attorney, Atty. Charles McLaughlin, to Ms. Elliott and Board Members. Tom Broadrick referred to this memo as he explained to Ms. Elliott that the Performance Security which she had provided for security for the road bond was problematic for several reasons: First, the surety company, Western Surety, is not a company which the Town of Barnstable can deal with because the company that actually issues the bond needs to be a Massachusetts company, Western Surety is only a Massachusetts agent for a company outside of Massachusetts. Second, the licensed contractor doing the road work h as t o b e n amed on t he r oad b ond, t he p roperty o wrier c annot b e n amed i n t his capacity. Third, the conditions of default need to be properly identified and a date certain of anticipated completion provided. Fourth, the bond must be non-cancelable and self- renewing except with written release or permission of the Town upon completion of the road. Marcia Elliott stated that she felt that she has had a good track record with the Town and also stated that she had only approximately 1 %2 years left to finish the road which is the balance of the 3 years she was given in the subdivision decision. The suggestion was made by Felicia Penn that a cash deposit could be offered as surety instead of the bond. Ms. Elliott acknowledged that this option was also available. Tom Broadrick suggested that Ms. Elliott discuss the road bond criteria with the surety company. Tom also stated that the Asst. Town Attorney, Attorney McLaughlin has offered to consult with her on this matter. Motion was duly made by Steve Shuman and seconded by Roy Fogelgren to sign the two lot releases with the contingency that the applicant provide proper surety or cash deposit in the amount of $35,000 that meets the requirements and satisfaction of the Town Attorney before the endorsed releases will be given to the applicant. Discussion: Dave Munsell inquires if there was a letter from Steve Seymour regarding the status of the road and what work is included in the $35,000 surety. Marsha Elliott stated that the electrical was installed and that NSTAR owns the electric and all that was left to complete the road was the final topcoat. Unanimous vote in favor of signing the lot releases with the contingency that they would be held in the file until the applicant provides proper surety or cash deposit in the amount of$35,000 as the Performance Security. OTHER BUSINESS Subdivision #739—Raymond Aittaniemi—Informal discussion regarding modification of road profiles. Arne Ojula from Down Cape Engineering represented Mr. Aittaniemi and provided a brief history of Subdivision#739 stating that it was approved in 1993 with a Development Agreement and waivers. In 2001, Mr. Aittaniemi returned to the Board to ask for a change of the road width to 16 feet which was approved and the he filed an S Form. At this time, the Board also approved to extend the Development Agreement for another 3 years. This extension has since expired in 2004. Mr. Aittaniemi is requesting another extension of the Development Agreement in order to complete the road with modifications. The road has been constructed for the first 250 feet and the first 2 lots have been released and developed with a road width of 33 ft. Mr. Aittaniemi proposes to construct the road as far as the "T" on the approved layout and then covenant to build a turnaround T beyond that where a house could be built contingent upon obtaining a building permit for the third lot. He proposes to build the turnaround T within Lot 3 further down the road. It was discussed if it could make sense to modify the existing subdivision plan to allow the T turnaround on the lot in stead of a road layout T? Dave Munsell inquired if this way was being proposed due to conservation. Mr. Ojula stated that in part it is due to conservation because drainage would not have to be constructed within 100 ft of he conservation area. It was stated that this would not become a part of the roadway, instead, a permanent easement over the lot for the T would be put into place. The permanent easement would create a T turnaround which does not exist for the entire roadway for all emergency apparatus. Mr. Ojula clarified that the original approved T would be kept as a paper T, the roadway would be constructed up to the end of that original paper T and that they would propose to covenant to construct the new T with an easement if issued a building permit for Lot 3. It was inquired why the roadway could not just be extended and it was explained that a change in the size of the lot would create a zoning problem. The question was raised by the Board if the easement area would be constructed to Town specs. Mr. Ojula stated that the intention is to develop it to the Board's specs for heavy fire equipment, utilities and drainage. Mr. Ojula also stated that when the modification was filed, appropriate waivers from present subdivision standards would be requested as needed. The Board informally agreed that they would consider a modification to the subdivision as presented with a new Development Agreement with a current date if the applicant filed. 5-Lot Subdivision off Parker Road - Informal Discussion. Attorney Michael Dunning represented the owners and stated that he also was also commissioner, appointed by the Probate Court to divide and sell the property. The property is 12.5 acres more or less and has been in the Jenkins family since the 1700s. His intent is to retain the character of the neighborhood to the best of his ability. The property was used for farming and in the 1950s it was an egg and poultry farm with two large commercial buildings for(largest 7,000 sq. ft.) this use. This operation has been gone for 40 years and the property is now used for storage. The commercial buildings are in disrepair and there is no intention to improve them. The property contains special i features such as one house, which is occupied by one of the petitioners, and a number of stone walls and mature oaks which they want to retain. The plan presented depicts a roadway on the southerly border ending in a cul-de-sac. Attorney Dunning stated that if the frontage for the lots is obtained from the cul-de-sac, it will endanger the stone walls and oak trees that they are trying to preserve. He would like to propose that the road not be built and instead look at the existing meandering road. The road on the plan is shown within the confines of the 30-ft wide ROW with a utilities easement also the road is unpaved dirt because they would like not to interfere with the look of the road. All five lots comply and meet zoning requirements. The development is surrounded by bog and borders to the east by Town of Barnstable conservation land. The development does contain two areas of wetlands not significant enough to stop construction of a house. Attorney Dunning stated that he is looking for feedback from the Planning Board. John Slaminsky of Cape and Island Engineering was present to answer questions from the Board. He stated that they are trying to work with what exists. The paper cul-de-sac is providing frontage for 4 of the 5 lots. The homestead lot (lot 5) has its own frontage. The two commercial buildings will be razed. A turnaround would be provided at the end of a gravel road and that fire department input would be needed to determine adequacy of width and materials. Ray Lang stated that a dirt road is usually considered private and would need to be maintained by the owners. Steve Shuman inquired if a cluster development with dedicated open space was considered instead of the future owners of lots 3 and 4 having bisected land and shared driveways. Mr. Slaminsky stated that the cluster development was considered, however, this would place all of the houses to the front of the lot where they would be more visible. Steve Shuman stated that the cluster development could be designed very much like the plan designed to preserve what exists. Attorney Dunning stated that by the use of restrictive covenants he could propose a plan that preserved the integrity of the property without the need for cluster with open space. Roy Fogelgren inquired why the proposed 30 foot right of way was not further to the south instead of necessitating the bisection of the lots. Mr. Slaminsky stated that raised elevation in the topography would not allow for this. The approach to the driveway to lot 1 needed to be as straight as possible without negotiating a sharp turn. The difference in elevation throughout the property is approximately 20 feet. Patrick Princi stated that he familiar with the property and stated that the map does not provide full picture of what it looks like with the oak trees and the walls. Tom Broadrick stated that waivers will most likely be needed. COMMITTEE REPORTS Dave Munsell reported that the DCPC Pond Village is progressing well. It has gone back to the Cape Cod Commission to request a 90-day extension in which time it is felt that it can finish.
