Dear Ms. Schobel,
During the public meeting of the Board of Health held on Tuesday February 10, 2015, the
Board voted to ant you an extension until May 11 2015 to provide power line

electrical service to your dwelling at 102 Nyes Neck Road East, Centerville. This
dwelling shall remain unoccupied until such time electrical service is resto fed.
On January 2, 2015 by Jim Parziale R.S., Health Inspector for the Town of Barnstable
conducted an inspection at your property in response to a complaint filed with the Public
Health Division. The following violations of the State Sanitary Code were observed:
105 CMR 410.256—Temporary Wiring
Extension cord observed running from generator in to home through front door.
105 CMR 410.258—Electrical Service
Disconnected power lines were observed on closest pole to dwelling and dwelling is
within 600 of electrical service
You are hereby ordered to correct these State Sanitary Code violations on or before
May 11, 2015 by disconnecting extension cord to temporary generator and restoring
electrical service to power lines connected to dwelling. After that date, the
generator shall not be used as permanent electrical power source for your dwelling.
Of course, a generator may be used temporarily during those times when power line
electrical service is not available, for example during power outages caused by
falling trees during/after a hurricane, blizzard, or other severe weather event.

Since purchasing our year round residence at 110 Nyes Neck Road East in Centerville
(February 2012) we have endured the noise created by the generator running on 102 Nyes
Neck Road East(the island), owned by Mary Schoebel. Ms. Schoebel appears to be
running this generator as her only means of power to her residence. This being the case,
the generator is run quite frequently inorder for her to be using this property as a primary
residence. This also raises questions regarding proper running water and septic on this
property as it does not have a constant power source.
In an attempt to be neighborly and find a reasonable way to mitigate the noise I have had
several conversations with Ms. Schoebel. I offered to help her by contacting the electric
company,Nstar, on her behalf to reconnect. In discussion with surrounding neighbors we
offered help in any way possible. All of these offers were ignored by Ms. Schoebel.
We believe that all the neighbors within hearing range have the right to peace and quiet
as regulated by the Town Of Barnstable Noise Ordinances(regulations require
enforcement of Chapter 133-2 noise regulations). As Chief McDonald told us, "you are
all entitled to peace and quiet."
There is power available at the pole by the garage on the property simply by clamp
connection, typical to any residence. Again, all surrounding neighbors are in support of
Ms. Schoebel's connection to the grid.

Please be advised that I represent Agnes C. Schobel, record owner of the property
located at 100 Nyes Neck Road East, Centerville, MA. She has received a notice from the
Barnstable Board of Health, written pursuant to the Barnstable Code, Section 353.2,
complaining of certain unlawful property located at said address. I have enclosed a copy for
your review.
In speaking with Agnes, she tells hne that the aforementioned described property
belongs to you. Kindly make arrangements to remove the property by December 1, 2014. I
have spoken with Timothy Lavelle, the Hazard Material Specialist with the Board of Health,
and he has graciously given us some time to get this premises cleaned up.
However, because this could have a"negative impact" on Agnes I would like to attend
to this matter with dispatch. If you have any questions or comments please feel free to contact
me or Agnes.
