The commitment is to install the water main by July 25, 2007. Plans were submitted this morning to the Cotuit Water District. The owner is getting a second quote on installation, and work will then proceed as soon as the owner has final approval of the plans and the installer can do the work. As I mentioned, I'm respectfully requesting that the Town allow construction to proceed in the meantime, as the Owner is paying on a construction loan; for the Owner to be stopped from working on the construction is a default in his construction loan. Obligation to Install. Owner hereby agrees with the Town of Barnstable acting through their Board of Health to install a conforming water main to service the Premises on or before July 25, 2007. 2. Compliance with Rules & Regulations. Owner agrees to insure the completion of said water main in compliance with the Rules & Regulations of the Cotuit Water District and the Town of Barnstable Board of Health. 3. Plans Submitted. Owner represents that as of the date of this agreement, the Cotuit Water District has received plans for the installation of the water main. 4. Liability. Owner hereby agrees to and indemnify and hold harmless the Town of Barnstable from and against any liability, cost, expense, damage, injury or other similar charge, which the Town of Barnstable may incur by reason of the delay in installing the water main servicing the Premises or the Owner's failure to satisfy his obligations set forth herein. 5. Right to Proceed. In consideration of the undertakings by the Owner set forth herein, the Town of Barnstable agrees to allow construction of the Premises and the appurtenant dock serving the Premises to proceed.
