My clients are greatly concerned about several matters concerning this application. They are as follows: 1. The house plans appear to reveal a house considerably larger than two-bedrooms. Elevations of the house clearly show a third floor and yet the floor plans are for a first floor and second floor only: No layout for the third floor has been filed. Further, the elevations depict a cupola and outside stairs,both of which I am informed were not approved by the Conservation.Commission as part of the Order of Conditions issued with respect to this matter. (File SE3-2567) Therefore, it is requested that the Board require a change in the layout of the house so as to comply with the two- bedroom provision. 2. .Enclosed'is a map which shows the location of a well on my clients property which is not depicted on any of the site plans and does appear to be within 150'and perhaps a 100'of the proposed septic system. While this well is not currently in use for a potable supply of water it is capable of the same and my clients wish to continue the option of having well water as their drinking water as opposed to town water. It would appear at a minimum the plans should be modified to show the existence of the well and, if necessary, a variance from the provisions of your regulations requiring the. distance from the well. 3. The distance from the leaching system to the wetlands on the site is of concern. While the proposed system may provide for nitrogen removal,my clients are concerned about viruses and bacteria that may ultimately leach into the wetland from this system. Clearly, the 100 separation from the resource area should be observed in this instance. As a result, it cannot be shown that the same degree of environmental protection can be provided by the proposed system,as that of a system 100' from the resource area. Therefore, the Board cannot find that variance conditions are met in this instance. Page 2 - Ltr. to Board of Health- 10-26-99 I would ask that you take all of these matters into consideration at your hearing and at a minimum require that the plans be redrawn to reflect the well and that the house plans be revised to clearly show a two-bedroom dwelling. The variances requested were as follows: 310 CMR 15.211(1): To install a soil absorption system only two feet away from the property line, in lieu of the minimum ten (10) feet setback required. 310 CMR 15.211(1): To design the reserve area for the soil absorption system only one foot away from the property line, in lieu of the minimum ten (10) feet setback required. Part VIII, SECTION 10.00: To install a soil absorption system 91 feet away from the spring high tide and to install a septic tank 80 feet away from the spring high tide, in lieu of the minimum 100 feet setback required. During the public hearing on November 23, 1999 the real estate agent, Cheryl Dumont, testified that the applicant Dr. William Mulroy, does not own this property. Therefore, in the opinion of the Board of Health, the applicant failed to establish that enforcement of the provisions of 310 CMR 15.000 would be manifestly unjust to the owner of this property. belair Also, you testified that it may be feasible to provide the Board of Health a plan showing an onsite sewage disposal system designed to accommodate a one- bedroom dwelling at this parcel, without the need for any variances from the State Environmental Code, Title V and from local health regulations. Also, the floor plans submitted to the Board of Health showing a deck at the rear of the dining room were not approved by the Conservation Commission. In addition, the sewage disposal system plan was reviewed by Thomas McKean, R.S., Health Agent for the Town of Barnstable. Mr. McKean found that the plan does not show the location of percolation tests as required by 310 CMR, 15.220(4) of Title 5, and that you did not request a variance from this section of Title 5. You are reminded that Regulation 15.401 of Title 5, states:that variances may be granted only when in the opinion of the Board of Health that (1) enforcement thereof, would do manifest injustice, (2) the applicant has proved that the same degree of environmental protection required under this title can be achieved without strict application of the particular provision. You did not introduce evidence that denial of this variance would be manifestly unjust to the owner, nor did you prove that the same degree of environmental protection required under Title 5 and Town of Barnstable Health Regulations would be achieved. It is our feeling that the granting of this variance at this time would violate the spirit and intent of the Environmental Code and the Town of Barnstable Health Regulations. Upon completion of the work described herein, the applicant shall forthwith request in writing that a certificate of Compliance be issued stating that the work has been satisfactorily completed. 12. It .also has been favorably recommended by the Board of Health. It is presumed to serve the prevention of pollution interests of Article 27 and MGL Ch. 131, S. 40. Special Conditions of Approval: 1. General Conditions 1-12 on the preceeding page are binding, and demand both your attention and compliance. 2. Within one month of receipt of this Order of Conditions and prior , to the commencement of any work approved herein, General Condition number 8 (preceding page) shall' be complied with. 3. This Article 27 permit is valid for 3 years from the date of issuance, unless extended at the request of the applicant. Note that the DEP superseding order is on a separate "clock. " 4 . The construction work limit for the project shall be as indicated (haybale line) on the plan. 5. Staked haybales shall be set at the work limit prior to the start of work and maintained throughout construction. 6. There shall be no disturbance of the site, including cutting of vegetation, beyond the work limit, except for buffer zone planting as indicated on the plan. This restriction shall continue over time. 7 . ' All areas disturbed during construction shall be revegetated immediately following completion of work at the site. No areas shall be left unvegetated or unmulched for more than 30 days. 8. Sod shall not be used as a landscape feature of the project. All grassed areas shall be seeded and maintained in fescues. a 9. The applicant shall abstain from any and all use of lawn care chemicals, herbicides, pesticides and fertilizers at the site. 10. This approval is contingent upon the approval by the Board of Health of the subsurface sewage disposal system. 11. Drywells or french drains shall be installed to accommodate roof runoff. 12. The driveway shall be constructed of pervious material. 13. Construction shall conform to the requirements of the State Building Code, the Town of Barnstable Zoning By- law Flood Area Provisions for construction within the coastal floodplain. Work shall ensue only after consulting with the Building Commissioner. First floor elevation of the proposed structure shall be set at or above elevation 12. 14 . All work shall conform with the January 13, 1993 plan and its notes. 15 . "'ie buffer zone enhancement planting shall conform with June 29, 1992 specifications by Fugro McClelland. 16 . Any future septic system plan revisions shall be submitted to the Conservation Commission for. prior authorization. 17 . The Barnstable Realth Department (790-6265) shall be consulted regarding the septic system monitoring program. Monitoring protocols as required by the Board of Health shall be modified (with Hoard of Health approval) should the groundwater flow anomoly so necessitate. 18. The proposed septic system upgrade for Assessors Map , #53/parcel #2 shall be implemented prior to or in conjunction with the sale of that parcel (also known as Lot #3, Plan Book #277, page 61) . 19. Development of the parcel shall ensue under engineering firm supervision. The Conservation Commission shall receive twice-a-month progress reports (with at least one per month being a written update) once work has begun. Reporting shall end at the discretion of the Conservation Department or at the conclusion of work at the site. 20• At least one of the septic system monitoring wells (to be installed in consultation with the Board of Health) shall be located "downgradient" (i.e. near the adjacent town landing) . 21. Septic system monitoring reports (as required by the Board of Health) shall also be submitted in timely fashion to the Conservation Commission. 22• It is the responsibility of the applicant, owner and/or successor(s) to ensure that all conditions of this Order are complied with. The project engineer and contractors are to be provided with a. copy of this Order and referenced documents before the commencement of construction. The foregoing condition shall not be construed to exempt project contractors from responsibility for any work performed in deviation with provisions of the Order of Conditions or with the detail of the plans of record. 23. The Conservation Commission, its employees, and its agents shall have a right of entry. to inspect for compliance with the provisions of this Order of Conditions. 24. At the completion of work, or by the expiration of the present permit, the applicant shall request in writing a Certificate of Compliance for the work herein permitted. Where a project has been completed in accordance with plans stamped by a registered professional engineer, architect, landscape architect or land surveyor, a written statement by such a professional person certifying substantial compliance with the plans and setting forth what deviation, if any, exists with the record plans approved in the Order shall accompany the request for a Certificate of Compliance. Specifically, I refer to 310 CMR 15.020 (2) "All systems for which a Disposal System Constructior. Permit has been issued shall be completed, and the Certificate of Compliance shall be; obtained, within three years of issuance of the permit. Unless an extension pursuant to 10 CMR 15.020(3)is.issued, the permit, and any variances or local upgrade approvals from 310 CMR 15.00 allowed therewith, shall ex ire if the work by it authorized is not completed wi ' the three-year eP riod." (emphasis added) While it may be argued in the instant case that the Disposal System Construction Permit was never pulled after the issuance of the existing variance. It is clear that three years have run since the issuance of that variance and I don't believe that one can simply never apply for the Construction Permit arguing that the variance stays in effect, thereby staying the three-year period. I've attached elevation views. This area is to be used as storage space. "The cupola brings light into the second floor. Otherwise, it's an attic with a pull-down stair. The shed dormer brings light into the attic" -------ConCom was informed. o A first floor plan was later approved on February 11, 1997 (attached). The final house design must conform with this floor plan, although the elevation views presently do not as regards decks and porches. I am very much concerned that the first floor plan recently submitted to the Board of Health is the very same plan which ConCom denied over three years ago. Perhaps the successors in the project believe they can build whatever suits them. 0 A copy of the order of conditions is attached, as is the approval site plan (Revised January 13, 1993, Arne Ojala, RPE). The final house design must conform with this floor plan, although the elevation views presently do not as regards decks and porches. I am very much concerned that the first floor plan recently submitted to the Board of Health is the very same plan which ConCom denied over three years ago.
