Gately and Mandy M. Russell, we request approval of a Nitrogen Aggregation Loading Plan pursuant to 310 CMR 15.216 of the State Environmental Code, and to modify the existing deed restriction and replace with the proposed Facility Land Nitrogen Restriction and Easement that limits the total number of bedrooms to three(3). This is not a request for approval of anon-site septic system. The Applicant acknowledges that a separate sewage system design plan modifying the existing system will be required to be filed with the Board of Health prior to any issuance of a septic installation permit. The subject property where the proposed septic system will be located is referred to as the Facility Property having the address of 95 Forest Hills Road,Cotuit, and is currently subject of a one(1)bedroom deed restriction for nitrogen loading purposes. The subject property where the Nitrogen Credit Area is located is referred to as the Credit Property having the address of Lot 19, 0 Forest Hills Road, Cotuit. The properties are shown on the attached Nitrogen Aggregation Loading Plans prepared by our firm dated 04-29-15, revised 05-20-15. Both properties are located with the same Mass DEP Mapped Zone II Well Recharge Area, . as shown on the attached Mashpee GIS Zone II Map, (Figure 1). A total of 15,188 square feet of Credit Area from the Credit Property will be restricted for the benefit of Facility Property,through the use of a Nitrogen Restriction and Easement, a legal. instrument that will be recorded at the Barnstable Registry of Deeds. The Facility Property will be restricted to a three(3)bedroom house through the use of a complimentary Nitrogen Restriction and Easement for Facility Property. Draft Nitrogen Restriction and Easement documents have been prepared using the DEP standard format and are attached. The Credit Area is being used to achieve the nitrogen loading limitation of a 330 gpd/acre discharge standard pursuant to 310 CMR 15.214. The table below shows aggregation area calculations and how the area requirements are satisfied for the installation of a 3 bedroom Title 5 subsurface sewage disposal system within a Mass DEP Mapped Zone II Well Recharge Area.
