Bethesda, MD. 20816 Dear Mr. Perry and Ms. Kozlowski, It recently came to the attention of the Board of Health that the soil absorption system designed and installed at,28 Little River Road Cotuit on August 7, 2002 does not meet the State Environmental Code,`Title 5 and the Town of Barnstable Board of Health Regulation, PART VIII, SECTION 1.00. According to the Department of Environmental Protection of the Commonwealth,there is a coastal bank on the property and/or on the- abutting property located within very close proximity to the soil absorption system at 28 Little Road. The designing engineer failed to show the coastal bank location on the plan. As a result the system as designed and installed does not comply with the State Environmental Code, Title 5. In addition, the 274 square feet soil absorption system was designed for a wastewater discharge flow of 203 gallons per day maximum. As built, there is insufficient capacity in the system either for any increase in use or for a change in use to a typical residential dwelling for example. Any such change would require a variance from the Board of Health and/or an upgrade of the system to bring it in compliance with Title V.
