There were some questions contained within it which may fall under the jurisdiction of the Town of Barnstable Public Health Division. I included the questions contained in your letter and my answers below: 21E Environmental Site Assessment Study QUESTION: Why is a 21E not required for,this property? Based on,historical usage, and long term outdoor exposure of vehicles, garbage and hazardous materials,,such a study would most likely uncover potential environmental contamination issues. It appears that by maintaining the business under Mr. Medeiros' prior business permitting, this requirement has been skirted and potential environmental issues remain unknown and unaddressed. This is not acceptable for this fragile environment and our ground water aquifer. ANSWER: The Public Health Division does not require 21E studies to be conducted. Operation and Inspection of Automotive Business QUESTION: If Regulatory Services does not have jurisdiction over business operation, WHO is responsible for overseeing compliance with the State of Massachusetts Project Manual for Auto Shops? ANSWER: The Public Health Division does not oversee compliance with State of Massachusetts Project Manual for Auto Shops. QUESTION: You have referred operational questions regarding oil separators, vehicle storage and hazardous waste management to the Health Division. We have not heard from the Health Department in response to these questions.Does this department conduct regular inspections to insure MA State r f f compliance? ANSWER: Beginning on July 1,2016,a full-time hazardous materials specialist position was funded for the purpose of conducting inspections. Now that this position is funded, regular inspections will be conducted in the future. On November 1, 2016, Hazardous Materials Specialist Timothy Lavelle conducted an inspection at this ' property. His inspection revealed the following: • There were no chemical tanks or fuel storage tanks on the property. • Many years ago, there were approximately 25 junk cars'in the rear. All of those vehicles were removed. • There is a floor drain in existence. It is connected into a dry well. Mr. Lavelle ordered Mr. Medeiros to seal the floor drain. - Mr. Lavelle will be following-up with a re-inspection next week and will be taking additional action(s),if necessary to gain compliance in this regard. Cars were parked outside for a period of weeks to months _ without movement prior to foreclosure and over the last 6-9 months following transfer of the deed. A letter is on file with the Town of Barnstable addressed to Thomas Perry from Michael Medeiros stating that he had not conducted business since 2011. If commercial under a non-conforming use permit, does the property not revert back to.residential usage o g - look-back period prior to sale/foreclosure? if the business was not active during a 36 month- p p _ We never received a response to our October 20,2015, letter to Thomas Perry, in which we posed this, and several other questions. Is this property zoned as both residential and commercial? This is a non-conforming commercial property located in a residential zone. The current use is limited to commercial only until and unless the property owner seeks to officially change it. Our files indicate that the property conveyed from Michael Medeiros(auto repairs)to Steven Gould in December or 2014. In his letter, Mr. Medeiros indicates that repairs continued until he moved out.There is also a letter from Chief Olsen-Cotuit FD-dated 8-10-15 - that to the best of his knowledge, 505 Main St., "has not ceased to exist has(sic)an Automotive Business within the past three years." On October.2,4, and 20 letters were sent to this office from citizens in the area indicating their belief that the pre-existing, non- conforming use had been abandoned.This perception appears to be based upon an unsigned letter/petition which states in part, "The use of that property has reverted back to residential with the foreclosure and the lack of a permit and no business run therefor over 3 years." It goes on to suggest to send letters to the Cotuit/Santuit Civic Association and to the President of the Town Council. AP heard about the complaint from DD and since it is on the haz mat business list,went to the said location for a site visit and haz mat inventory. Violations given during the recent visit were the same violations that were given in 2004 that had not been corrected.There are over 111 gallons of haz mat on site, most of it being incorrectly stored outdoors, so a haz mat permit is required unless he disposes of the 2x55 gallon drums of waste oil. During the visit, DS observed a power cord running from the building to a white GMC pick-up truck with a camper topper, lic# 383-N48 located behind the building. Mike asked that DS write him a"violation"so he could get rid of the"tenant". DS discussed the finding with Bob M from the building department and Bob has sent a certified letter regarding this issue to the site. A follow up site visit will need to be completed by AP to ensure the haz mat has been removed and properly stored.Further action is required. Haz mat issues- remove four 55 gallon drums being improperly stored outdoors, heating oil tank shall be replaced, painted or tested to show that it is structurally sound, place all paints in the flammables cabinet,clean exhaust fan motor in the paint room, remove all combustibles inside the paint room, remove all tires and debris from behind the building, and replenish all fire extinguishers and mount them.The septic has been dug up and 30-60 days to correct the issue per the Director of Public Health. Hmmmm, sounded familiar. Joan, our Administrative Assistant, asked me to assist him because she wasn't sure about the information on the form from the last haz mat inspection that Amy Wallace completed 8/2004. Mr. Noonan wanted to know if there was anything wrong with the site currently as far as haz mat goes because he has a friend who is going to buy it and didn't want to"deal with the town and state" regarding these issues. He didn't tell me who and I didn't ask because I didn't want to look suspicious, but we can all assume it is Penti from Thornton Dr. I asked him if the seller had any information on it and he said there was nothing. The only issue on the inventory sheet was there were no MSDS, then I pulled a letter from my computer database that Amy Wallace,the last haz mat specialist, had composed from the visit and brought it to him to show him the other issues. Please note the problems identified at your place of business during the hazardous materials innventory and their corresponding recommendations/orders listed below: Problem: Two barrels containing hazardous waste(i.e.waste oil)are stored outside with no proper cover and no secondary containment of 110%. This is a violation of the Town of Barnstable General Ordinance,Article 39: Control of Toxic and Hazardous Materials, Section 5-1 and 5-2. Order: Please RELOCATE ALL barrels/containers/tanks containing hazardous waste indoors immediately. Keep these barrels on a concrete surface and store absorbent materials nearby in case of an accidental spill or release of these hazardous materials. Problem: There are approximately 24 unregistered vehicles on your property,in the rear of your shop. The Town of Barnstable General Ordinance limits unregistered cars stored on a property to one(1). Order: Please remove the junk/unused/unregistered vehicles from your property that are not for immediate service. Please try and limit your storage of unregistered vehicles to one(1). Please comply with this order in the next 60 days. If more time is needed,please contact the Public Health Division. AP heard about the complaint from DD and since it is on the haz mat business list, went to the said location for a site visit and haz mat inventory. Violations given during the recent visit were the same violations that were given in 2004 that had not been corrected. There are over 111 gallons of haz mat on site, most of it being incorrectly stored outdoors, so a haz mat permit is required unless he disposes of the 2x55 gallon drums of waste oil. During the visit, DS observed a power cord running from the building to a white GMC pick-up truck with a camper topper, lic # 383-N48 located behind the building. Mike asked that D: write him a "violation"so he could get rid of the"tenant". DS discussed the finding with Bob M from the building department and Bob has sent a certified letter regarding this issue to the site. Mike is waiting for 2 new barrels from Village Garage so he can transfer the waste oil from the old rusty barrels into the new barrels. His reasoi behind this is that he doesn't want to move the old barrels while full so they don't leak or break down. I agreed and allowed the wait. The back of the yard is much cleaner than before, batterieE have been removed, tires are in one location, camper is no longer there. Follow up is necessary mid August. Haz mat issues- remove four 55 gallon drums being improperly stored outdoors, heating oil tank shall be replaced, painted or tested to show that it is structurally sound, place all paints in the flammables cabinet, clean exhaust fan motor in the paint room, remove all combustibles inside th paint room, remove all tires and debris from behind the building, and replenish all fire extinguishers and mount them. The septic has been dug up and 30-60 days to correct the issue per the Director of Public Health. Will contact DEP regarding the issues at this location. Bob suggest that I not go there alone due to his site visit with Cotuit FD a few days earlier and found many issues with the site.
