McKean, R.S., CHO Director of Public Health Town of Barnstable 200 Main Street Hyannis MA 02601 RE: Order Letter dated March 9, 2007 regarding 1281 Main Street, Cotuit Dear Mr. McKean: I received your letter directing me to correct five violations of the State Sanitary Code at my house in Cotuit within 30 days of receipt,which was on March 24, 2007. I have talked with Meredith Morgan,Donna Morandi and Katie Barrett of your staff and they have been helpful in answering my questions and giving me direction. I am writing to tell you my plans to bring all violations into compliance and to ask for relief from the 30-day deadline for the completion of all work. I respect your public office,nature's ecosystem and people's safety and health. I have been quite anxious about the tight 30-day deadline and the prospect of paying$500.00 per day in fines. I take seriously my responsibility to correct the violations,and I will correct them. Plans for the non-septic system violations: 0 I will turn on the hot water and insure the temperature is right. ® I will post my name and telephone number. o I will install carbon monoxide alarms. O I plan to complete these three items on my first trip to Cotuit; expected to be in late April or early May. At that time, I will notify your office, so,an inspector can come and verify compliance. s v " 1 of 2 Plans for septic system violations: O I will hire a licensed engineer to obtain a permit,conduct a percolation test, and design a septic system that is in compliance. I expect to be able to have this portion of the work done by the end of May 2007,barring unforeseen delays in work schedules of all involved. o I will hire a contractor to install the system in accordance with the design. I would like to have this installation work done in the fall of this year, as I will further explain below. Pertinent facts: This house is occupied only in July, August and a handful of other weeks in the warm months. The house is completely shut down from mid-October to mid-April. I have the house fully rented for the months of July and August this year. The septic system,while not in total compliance,has not failed. The septic tank is 1500 gallons in size,which I understand is in compliance. I also understand that the property is not in a"zone of contribution." Request for relief from 30-day deadline: I would like an extension of time to complete the non-septic system violations until the 'end of May 2007. I would appreciate not having to expedite the opening of the unoccupied house. Also,the first tenant doesn't arrive until June 30, 2007. I would like an extension of time to complete the septic system installation until the end of October 2007. Because the system is not failing, I ask for relief to do the job in a thorough and orderly manner. I would appreciate having more than 30 days to allow for thorough evaluation and design work,to solicit installation bids from several contractors, to allow for un-expedited work from contractors who may be very busy and to keep my cost reasonable. Also, I would appreciate being able to do the installation work in the fall to provide my tenants with a mature lawn in the yard(versus a large expanse of sand if the work is done pre-July and August). Having a mature lawn is a condition my tenants expect and upon which the lease contracts were made. I appreciate your giving my request your consideration. I look forward to hearing from you.
