Failure to obtain annual Hazardous Materials License for storage/handling of greater than 25 gallons of hazardous materials. Facts: Recent hazardous materials inspections by the Town of Barnstable Public Health Division at Advanced Body Science have found that approximately 1200 gallons of hazardous materials are stored on site. Due to late application filings for the hazardous materials license over the past five years, Mr. Michael Hatfield of Advanced Body Science, had previously been issued written and verbal warnings and reminders to obtain a valid license. He was notified on the latest inspection report dated June 7, 2017 to renew his license by June 30, 2017. During a follow-up visit on August 11, 2017, a member of his staff was verbally notified to have Mr. Hatfield contact me. No contact was made. An official warning notice was issued on August 13, 2017. No response was received. Mr. Hatfield was issued a $75 citation on August 31, 2017. This Ordinance was adopted to protect the public health and welfare,especially as it pertains to the public drinking water supply. The following is a description of the results of the Inventory(enclosed)and Inspection. MATERIALS INVENTORY AMOUNT AND PURPOSE: The Inventory of this site indicates the use or storage of approximately one-thousand,three-hundred and ninety-six(1,396)gallons of toxic and hazardous material.This material is used in the repair and maintenance of vehicles,auto body work and in heating the building. Please be aware that the Town of Barnstable has determined that a minimum of one-hundred and eleven(111)gallons of toxic and hazardous materials requires an annual license. GENERAL STORAGE AREAS AND CONDITIONS: •- The first garage bay(adjacent to the office)houses six(6)unmarked flammables cabinets containing various sized and partially used containers of paint.This garage bay work area also contained shelving for reducer and drums of acrylic thinner. • The Paint Room,also unmarked,at the rear of the first garage bay,houses the majority of paints. • The second garage bay houses a small flammables cabinets, drums of antifreeze and waste antifreeze,oil tanks,waste oil tank and heater,a tank of windshield washer fluid,flammables and an acetylene set up,CO tank,and a shelf of auto body filler. • The Storage Room,at the rear of the second garage bay,houses two(2)small flammables cabinets. 9 -2- SAFETY AND DOCUMENTATION: The required Material Safety Data Sheets were available and in a binder in the office.A Contingency Plan was posted by the telephones,and a Spill Kit is available. Manifest sheets for the transport of hazardous materials were also provided upon request. Fire extinguishers were available and their inspection up to date. Although an"Application for permit to store and/or utilize more than 111 gallons of hazardous materials" and associated fee had been submitted to the Town,the site was not in receipt of an annual license.Upon visiting the Board of Health office on February 21,2008 Mr.Hatfield was issued the license. SITE FACILITIES: There were no floor drains observed at the facility. The site building is served by an on septic system. Any deficiencies which were discovered in the course of this inspection with regards to the Hazardous Materials Ordinance are described below. RECOMMENDED CORRECTIVE ACTIONS TO BE TAKEN: A fifty-five(55)gallon drum of acrylic thinner,which had recently been delivered,was observed lying on its side in the first garage bay. This material and its vapors are highly flammable;therefore it is recommended that all drums of this material be stored in a containment device. This action will further protect the drum from any accidental damage caused by vehicle movement in the garage bay. All flammables cabinets and storage rooms were not labeled;they should be labeled as"Flammable". All hazardous waste containers must be labeled as"Hazardous Waste",the waste identified,and the associated hazard described(i.e.In the case of waste antifreeze:Ethylene Glycol,Toxic). The Contingency Plan should identify the location of any containment devices,please update your Plan to indicate the location of the on site Spill Kit. The PHD appreciates your cooperation and acknowledges your past actions demonstrating your intent to maintain compliance with the Hazardous Materials Ordinance.
