Box 2716 Oak Bluffs, MA 02557 Dear Mr. Koch, NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.00 STATE SANITARY CODE II, MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND THE TOWN OF BARNSTABLE RENTAL ORDINANCE ARTICLE 51 The property owned by you located at 58 Cedar Street, Hyannis, MA was inspected on January 24, 2001 by Edward Barry, Health Inspector for the Town of Barnstable, because of a complaint. The following violations of 105 CMR 410.00, State Sanitary Code II, Minimum Standards of Fitness for Human Habitation were observed: 410-602A - Located on ground outside three bay building: multiple miscellaneous metal frigerator, used batteries, used tires, and van full of debris parts, old re removed from"B"bay and keep the property free from debris. You,are directed to correct these violations within fourteen(14) days of receipt of this notice. You may request a hearing if written petition requesting same is received by the Board of Health within seven (7) days after the date order is received. However, these violations must be corrected regardless of any request for a hearing. Please be advised that failure to comply with an order could result in a fine of not more than $500. Each separate day's failure to comply with an order shall constitute a separate violation. I SOURCES OF FILTH In accordance with the provisions of Chapter III, Section 122, of the General Laws, and for the protection of public health, the Town of Barnstable Board of Health adopts the following revised regulation after a public meeting of the Board of Health on December 17, 1996. The original regulation was adopted May 21, 1980. The occupant of any building used for business or habitation shall be responsible for maintaining in a clean and sanitary condition and free of garbage, rubbish, other filth or causes of sickness in that part of the building and outside area which he occupies or controls. The owner of any building, vacant or otherwise, or parcel of land shall be responsible for maintaining such building or land in a clean and sanitary condition, free from garbage, rubbish or other refuse. Garbage, or mixed garbage; and rubbish shall be stored in watertight receptacles with tight fitting covers. Said receptacles and covers shall be of metal or other durable, rodent proof material. Rubbish means combustible and non-combustible waste materials, except garbage, including, but not limited to such material as paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, grass clippings, tin cans, metals, mineral matter, glass, crockery, dust, and the residue from the burning of wood, coal, coke, and other combustible materials. Garbage means.the animal, vegetable, or other organic waste resulting from the handling, preparing, cooking, consumption or cultivation of food, and containers and cans which have contained food unless such containers and cans have been cleaned or prepared for recycling. Any person in violation of this regulation may be fined forty (40.00) dollars. Any person who fails to comply with an order issued pursuant to this regulation, shall be fined forty (40.00) dollars.
