This letter contains information from that visit that will help you become compliant with and remain compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous Materials. Enclosed is a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your business. Please note the problems identified at Your place of business during the hazardous materials inspection and their corresponding orders or recommendations listed below: PROBLEM: • Monro Muffler is.in violation of Section 108-9 of Chapter 108: Hazardous Materials, which states, "The release of any hazardous materials and/or acutely hazardous materials upon the ground, or into any surface...within the Town of Barnstable,is prohibited." • There are small releases throughout the service bay areas that have been covered with absorbents. • There are large amounts o_f speedy dry around the base of the oil and waste oil tanks inside the garage. ORDER: • Section 108-513 of the Town of Barnstable General Ordinance states,"Provisions shall be \ made to contain the product(i.e.hazardous materials)in the case of an accidental release." • Remove the speedy dry from the service bays areas and the base of the tanks after full absorption and place in the trash. • Plan and conduct staff"refresher"training in hazardous materials identification, handling,PPE(personal protective equipment) and proper spill response. • No spill kit has been obtained to date. Please obtain a kit composed of proper personal protective equipment(i.e. gloves, glasses, absorbent pads, speedy dry). PROBLEM: • There were open or uncapped containers and catch pans improperly stored throughout the servicing areas. This violates the Town of Barnstable General Ordinance, Chapter 108: Section 108-5C. Storage Controls. ORDER: • Keep all hazardous and flammable materials stored in capped containers. • Empty all waste oil catch pans immediately. PROBLEM: • The 55 gallon drums have releases or spills on the tops of them. ORD ER: • Place absorbent pads on the tops of the drums to catch any and all leaks before they rundown the side of the drum to the floor. Do not use shop rags to catch the releases. OBSERVATIONS: • Oil filters are kept outdoors in 55 gallon drums. The storage area is fenced in and has a roof to protect them from the elements. • Fire extinguishers are serviced. • An emergency phone list is posted. • MSDS's are present and signage is posted for location. • Metal rag cans with lids are present in the facility. Please place all oily rags in the cans when finished. • Cylinders of acetylene and oxygen are chained up. A representative from the Public Health Division will re-visit your business during the next 30 days as a follow up to further advise you on your compliance. No shop can for rags. Open containers of oil/AF. No real absorbant on hand. MSDS in office/online. Manifests are there but he is new and not sure of the location. ORDERS: obtain a metal shop can with metal lid for rags,no open spill containers of oil and AF,clean up waste oil filter barrel and label all HW barrels"toxic"and"hazardous waste". Move HW barrels from blocking the emergency exit. Service fire extinguishers. Obtain absorbant. Renew hazmat permit within 30 days. I will follow up to assist him with these issues. 8/6/04 Follow up inspection. HW barrel moved from emergency exit.Barrel label in place. DOES HAVE an oil/water seperator. FAILED: spills and releases in several places on floor. No absorbant used on these. Fire extinguishers still not serviced. "Chainstar"called but no service yet. Used oil and used AF container and drum are sloppy. Recommend spill tray for top of used AF barrel. ORDER: • Section 108-5B of the Town of Barnstable General Ordinance states, "Provisions shall be made to contain the product(i.e.hazardous materials)in the case of an accidental release." I • Plan and conduct staff"refresher"training in hazardous materials identification, handling,PPE(personal protective equipment)and proper spill response. • Please instruct your staff to focus on taking a few moments during their workday to implement safety measures in order to prevent hazardous materials spills and releases of any kind. • Utilize a spill kit that is easily accessible to all staff members in the event of a spill or release. ORDER: • Keep all hazardous and flammable materials stored in capped containers. • Empty all waste oil catch pans immediately. • This is recommended for health reasons as well as fire hazard prevention. PROBLEM: • Housekeeping in the service areas needs to be a priority. ORDER: • Housekeeping is a controllable expense. The easier it is to get around your facility,the less of a chance for you to experience a worker's compensation claim. • Clean areas in your storage rooms and keep all materials off the floor. This will prevent possible slips and falls. • All hazardous materials should have a home. Keep all flammables in a metal fire proof cabinet;keep all oxidizers away from heated areas. • Clean the speedy dry up off the floor after absorbing the released petroleum products. 69 p) PROBLEM: 1 • One of the waste oil accumulation satellite stations is leaking waste oil. ORDER: • Chain up all cylinders, empty or full,to ensure compliance. I PROBLEM: • Used shop rags were on the floor and on storage containers. ORDER: • Used shop rags must be picked up and stored in a metal container with a lid at all times. Containing your shop rags properly can prevent a fire hazard. PROBLEM: • Have not registered for the 2005-2006 Hazardous Materials Permit. ORDER: • Please submit the enclosed application to obtain a Hazardous Materials Permit for 2005- 2006. In order to comply with these regulations, protect the environment, and ensure the ability of Monro Muffler and its' employees to have a safe and healthy work environment, the steps and procedures outlined in this plan shall be strictly complied with. To accomplish this goal, each employee will be provided training on the plan, be given a copy of the plan, and sign the attached verification, that they have been provided the necessary instruction and will abide by the outlined procedures. In addition, a copy of this plan shall be posted in the Vehicle Repair area in a place that is accessible by all employees at any time of the day. In discussion with the Massachusetts Department of Environmental Protection, it has been determined that spills of less than ten (10) gallons that are immediately cleaned up by the spiller, and do not reach the waters of the state, do not need to be reported. If the spill is larger than ten (10) gallons and/or impacts the waters of the state, the incident must be reported immediately. This plan will outline the procedures that have been adopted by Monro Muffler to meet this reporting requirement, and the steps that are to be taken by employees to control and clean-up the spill. The most effective Spill Plan involves the handling and use of oils and/or hazardous materials in a safe and controlled manner. Although, Monro is sure that their employees attempt to work under those conditions, we must prepare for the event whereby these materials are released to the environment. Over the next several pages you will find the EMERGENCY SPILL PROCEDURES, COMPANY SPILL REPORTING FORM, and the outline of necessary notifications that Monro has determined to implement in order to meet the requirements of the State of Massachusetts. I EMERGENCY SPILL PROCEDURES Massachusetts STORE PERSONNEL Every spill must be reported to the Market Manager regardless of the time. The appropriate telephone numbers are listed at the end of this procedure. Obviously, if the spill is still occurring, or if there is immediate danger to safety, the actions below must come before the notification. STEP 1 — Determine the source of the leak or spill. STEP 2 — Stop any more material from leaking if possible by performing one of the following: • Upright the overturned container, or; • Shut-off equipment that is transferring material, or; • Plugging of holes, tears, or openings in container, or; • Dike areas with absorbent. STEP 3— If you can't stop or contain the spill, remove all possible sources of ignition to prevent possible fire or explosion. If a vehicle is sitting in the spill, do not move it. STEP 4— Remove all non-essential personnel from the immediate area. Block the area to traffic, both vehicle and pedestrian. STEP 5— Contain the spill to prevent the material from spreading. • Put on personal protective equipment (gloves and goggles). • Using absorbents to stop the spread of materials. • Allow the absorbent adequate time to soak up the material, then sweep it up and place the used absorbents into the disposal drum at the site. • When the disposal drum is nearly full, contact T. Giannone, Director of Facilities, to make the necessary arrangements to have this drum picked up for regulatory disposal. • Perform inventory of absorbents, etc., to determine if replacements are needed. Contact T. Giannone, Director of Facilities, for additional supplies, if needed. !VERY IMPORTANT! DO EVERYTHING POSSIBLE TO PREVENT MATERIALS FROM ENTERING STORM, SANITARY, OR OTHER DRAINS! IF CONDITIONS ARE SUCH THAT STORE PERSONNEL CANNOT DEAL WITH THE INCIDENT OR IF IMMEDIATE DANGER TO LIFE AND PROPERTY IS PRESENT CONTACT THE FIRE DEPARTMENT FOR ASSISTANCE. STEP 6— If the spill/release was the result of failure or breakage of oil storage and/or transfer equipment, this equipment is to be immediately taken out-of-service until such 4 time as the necessary repairs are completed. It will be the responsibility of the Market Manager to ensure that these repairs are given immediate attention. STEP 7— No statements are to be given to the media. Refer all Media to Monro's corporate offices. STEP 8—Once the situation is under control and the Market Manager has been contacted by telephone, it is important that the Store Manager, Assistant Manager, or Employee in Charge fill out the attached Spill Report Form. Fax the completed form to Attn: T. Giannone, Monro Muffler, at 585-647-0947, as soon as possible after all information has been generated. A copy of this report is to be kept on file at the store, with an additional copy to be maintained by the Market Manager. Common Sense must be used regarding the treatment of a spill or any other hazard. The above procedures are suggested guidelines. Each incident is different and may require more comprehensive.measures than are outlined in this text. If in doubt about how to handle this type of situation, and you are unable to contact your Market Manger, call Tom Giannone at 585-647-6400, Ext. 378. I EMERGENCY SPILL PROCEDURES Massachusetts MARKET MANAGER As previously stated, Massachusetts requires that all spills larger than ten (10) gallons, and/or that reach the waters of the state must be reported to the Department of Environmental Protection. To ensure continuity and maintain a single point of contact, Monro Muffler has designated the Market Manager as the person responsible to fulfill this requirement. To accomplish this, the Market Manager will be take the following actions: STEP 1 —When receiving the telephone call from the store, gather the following information: • Date of spill • Time of spill • Person making notification • Material spilled • Amount spilled • Has spill been stopped • Has spill been cleaned up • Were any resources affected, (land, water, air, drainage systems) • Was Fire Department or other outside agency involved STEP 2— Make the notification to the Massachuesetts Department of Environmental Protection (if necessary) at 1-888-304-1133. Give them the information that you were able to receive from the store and determine if they will require additional actions. Make sure that a Spill Number is assigned and that you are given this number for Monro records. Ask if a Spill Response person will be traveling to the store. STEP 3—Contact the store to determine if any additional information or items of concern have arisen. Give the Spill Number, if assigned, to the Store Manager so that it can be entered on the Monro reporting form. STEP 4— Contact Tom Giannone at 585-647-6400, Ext. 378, to advise of the spill and status of clean-up. STEP 5—Travel to the store to confirm the following: • Situation was as reported • Clean-up is under way or complete • All equipment is in good working condition • All necessary information has been placed onto the reporting form • Replacement of absorbent materials and equipment, as needed • Maintain record of spill(s) that material has been placed into disposal drum • Ensure copy of completed report form is FAX'd to the Corporate Offices STEP 6—When store advises that disposal drum is full, notify Tom Giannone, Director of Facilities, to have drum picked up by a registered disposal firm and provide empty drum for future use. STEP 7 — Ensure that all forms, letters, and any other information generated by a spill event are forwarded immediately to Tom Giannone, Director of Facilities. The Health Department may, according to law, enter upon any premises at any reasonable time to inspect for compliance. B. Upon request of the Health Department, the owner, individual identified on a registration or license application, or operator of any premises at which toxic or hazardous materials are used or stored shall furnish all information required to monitor compliance with this chapter.A sample of wastewater disposed to on-site septic systems, dry wells or sewage treatment systems may be required by the Health Department at the operator's expense. C. All records pertaining to storage, removal and disposal of toxic or hazardous wastes shall be retained for no less than five years by the registration holder or license holder, and shall be made available for review by the Health Department upon request. D. The Building Commissioner of the Town of Barnstable shall condition issuance of building and occupancy permits upon conformity with the requirements of this chapter respecting any hazardous materials and/or acutely hazardous materials to be used in the course of such construction or occupancy. Q8 13. Notice of violation. Written notice of any violation of this chapter shall be given by the Health Department, specifying the nature of the violation; any corrective measures that must be undertaken, including containment and cleanup of discharged materials; any preventive measures required for avoiding future violations; and a time for compliance. Requirements specified in such notice shall be reasonable in relation to the public health hazard involved and the difficulty of compliance. The cost of containment and cleanup shall be borne by the owner and operator of the premises. §%a8-14.Violations and penalties. Et A. Any person who shall violate any section of this chapter for which penalty is not otherwise provided in any of the General Laws shall upon conviction be fined $300. B. Any person who shall fail to comply with any order issued pursuant to the sections of this chapter shall, upon conviction, be fined $300. Each day's failure to comply with an order shall constitute a separate violation.. C. In the alternative to criminal prosecution, the Health Department may elect to utilize the noncriminal disposition procedure set forth in MGL C. 40, §21 d. Noncriminal ticket citation for any violation of any section of this chapter shall be in the amount of$75 for the first violation and $25 for each additional violation. This letter contains information from that visit that will help you, as a business manager,become compliant with hazardous waste regulations in the Town of Barnstable. Enclosed is a copy of the town's General Ordinance,Article 39: Control of Toxic and Hazardous Materials for your reference. Please note the problems identified at your dace of business during the second hazardous materials inspection and their corresponding orders listed below: PROBLEM: • Several hazardous material spills ("releases")were observed on the.floor of your shop with no catchment/containment from the vehicles being repaired. • This is in direct VIOLATION of Article 39, Section 9-1. • These were spills of oil and antifreeze. There was no absorbent material(Speedy-Dry, absorbent pads)used to contain or clean up these releases. ORDER: • Beginning immediately,please use proper catchment pans/trays under vehicles when they are being worked on and liquid hazardous waste is drained from them. • Empty all catchment/containment trays and containers into the hazardous waste tanks and barrels IMMEDIATELY. Do not leave these on the floor. • Place a large portion of Speedy Dry on the spills in your shop and DO NOT REUSE this absorbent material. • Absorbent materials should be cleaned off the shop floor and disposed of DAILY. • Antifreeze must be contained because it is especially toxic and can cause irreversible health problems or death. PROBLEM: • The barrels containing hazardous waste and hazardous materials are stored directly above a large drain that leads to the town sewage system. • This is in VIOLATION of Article 39, Section 5-2. ORDER: • Please RELOCATE ALL barrels/containers/tanks containing hazardous waste and hazardous materials AWAY from all drains. • Keep these barrels on a concrete surface and store absorbent materials nearby in case of an accidental spill or release of these hazardous materials. PROBLEM: • There were several containers and bottles of used oil and antifreeze stored un-capped on the floor of this shop,particularly among clutter on the floor. • This is in direct VIOLATION of Article 39, Section 5-3. ORDER: • Please empty all temporary containment and storage trays/containers of hazardous waste into appropriate storage tanksibarrels immediately after draining them from vehicles or cleaning up spills. PROBLEM: • Used shop rags stained with petroleum products were on the floor and in open/uncovered storage containers. This is a fire hazard. • The fire extinguishers in this shop have not been service as ordered at the first inspection on July 1, 2004. ORDER: • Used shop rags must be picked up and stored in a metal container with a metal lid at all times. • Containing your shop rags properly can prevent a fire hazard. • Shop rags, as well as uniforms and fender covers, should be professionally laundered and not disposed of as solid waste. • SERVICE the fire extinguishers in this shop as soon as possible. This letter contains information from that visit that will help you, as a business manager,become compliant with hazardous waste regulations in the Town of Barnstable. Enclosed is a copy of the town's General Ordinance,Article 39: Control of Toxic and Hazardous Materials for your reference. Please note the problems identified at your place of business during the second hazardous materials inspection and their corresponding orders listed below: PROBLEM: • Several hazardous material spills("releases")were observed on the floor of your shop with no catchment/containment from the vehicles being repaired. • This is in direct VIOLATION of Article 39, Section 9-1. • These were spills of oil and antifreeze. There was no absorbent material(Speedy-Dry, absorbent pads)used to contain or clean up these releases. ORDER: • Beginning immediately,please use proper catchment pans/trays under vehicles when they are being worked on and liquid hazardous waste is drained from them. • Empty all catchment/containment trays and containers into the hazardous waste tanks and barrels IMMEDIATELY. Do not leave these on the floor. • Place a large portion of Speedy Dry on the spills in your shop and DO NOT REUSE this absorbent material. • Absorbent materials should be cleaned off the shop floor and disposed of DAILY. • Antifreeze must be contained because it is especially toxic and can cause irreversible health problems or death. PROBLEM: • The barrels containing hazardous waste and hazardous materials are stored directly above a large drain that leads to the town sewage system. • This is in VIOLATION of Article 39, Section 5-2. ORDER: • Please RELOCATE ALL barrels/containers/tanks containing hazardous waste and hazardous materials AWAY from all drains. • Keep these barrels on a concrete surface and store absorbent materials nearby in case of an accidental spill or release of these hazardous materials. PROBLEM: • There were several containers and bottles of used oil and antifreeze stored un-capped on the floor of this shop,particularly among clutter on the floor. • This is in direct VIOLATION of Article 39, Section 5-3. ORDER: • Please empty all temporary containment and storage trays/containers of hazardous waste into appropriate storage tanksibarrels immediately after draining them from vehicles or cleaning up spills. PROBLEM: • Used shop rags stained with petroleum products were on the floor and in open/uncovered storage containers. This is a fire hazard. • The fire extinguishers in this shop have not been service as ordered at the first inspection on July 1, 2004. ORDER: • Used shop rags must be picked up and stored in a metal container with a metal lid at all times. • Containing your shop rags properly can prevent a fire hazard. • Shop rags, as well as uniforms and fender covers, should be professionally laundered'and not disposed of as solid waste. • SERVICE the fire extinguishers in this shop as soon as possible.
