THE PARTIES 1. The Department of Environmental Protection (the "Department") is a duly constituted agency of the Commonwealth of Massachusetts. The Department maintains a primary office at One Winter Street, Boston, Massachusetts 02108, and a regional office at 20 Riverside Drive,Lakeville, Massachusetts 02347. 2. The Department is charged with the implementation and enforcement of the Massa�1114_ etx>s. Hazardous Waste Regulations as contained in 310 CMR 30.000, adopted ursuarif to the•• authority of Chapter 21C, §§ 4,6 and 9, and the Massachusetts Air Po l tion Cbntral, Regulations as contained in 310 CMR 7.00, adopted pursuant to the authority of Massachusetts General Law Chapter 111, §§142A-E and J, and Chapter 21C, §§4 and 6 as applicable. 2. The Department is authorized to assess Civil Administrative Penalties by M.G.L. c.21A, §16 and regulations at 310 CMR 5.00. 3. Unless otherwise stated herein, the terms used in this Consent Order are defined pursuant to the regulations codified at 310 CMR 30.000, 310 CMR 7.00, and 310 CMR 5.00. III. STATEMENT OF FACTS 1. Ford of Hyannis is an automotive dealership which sells new and pre-owned vehicles and also provides automotive repair services. 1. On April 1, 2005, Department personnel conducted a Multi-Media inspection of Ford of. Hyannis at 332 Falmouth Road,Hyannis. The purpose of the inspection was to determine the status of Ford of Hyannis relative to compliance with the Massachusetts Air Pollution Control Regulations, set forth at 310 CMR 7.00, the Massachusetts:. Hazardous Waste Regulations set forth at 310 CMR 30.000, f C -2- the Massachusetts Toxic Use Reduction Regulations set forth at 310-CMR 50.00, and the Division of Water Pollution Control Regulations set forth at 314 CMR 1.00-12.00. 3. A review of the hazardous waste manifests from 2002 to December 2004 revealed that Ford of Hyannis has been generating Large Quantity Generator(LQG) amounts of Waste Oil and Very Small Quantity amounts of Hazardous Waste. Ford of Hyannis is registered with the Department as a Small Quantity Generator of Hazardous Waste with no separate generator status for Waste Oil using EPA Id. #MAD981065147.4. . The facility has been exceeding the monthly generation limit of 1,000 kgs (approximately 250 gallons) of any hazardous waste,regulated recyclable material or combination of both wastes.By generating the amount of wastes as stated,Ford of Hyannis is acting out of status in violation of 310 CMR 30.351(7)which references 310 CMR 30.351(1)(a). 4. Ford of Hyannis has increased their generation rate to that of a large quantity generator (LQG) of hazardous waste/waste oil and failed to notified the Department of their change of status in violation of 310 CMR 30.303(3)(a). 5. Ford of Hyannis recycles waste oil that is generated on site by means of a waste oil space heater for energy recovery. Ford of Hyannis failed to first notify the Department or obtain approval for this recycling activity. This constitutes conditions of noncompliance with 310 CMR 30.222(5)(b)at the facility. 6. Ford of Hyannis failed to comply with the requirements governing emergency procedures, prevention, and response. Specifically, the facility did not have an up-to-date list posted next to each telephone at the site of generation throughout the facility. This constitutes conditions of noncompliance with 310 CMR 30.351(9)(c)(6) at the facility. 7. Ford of Hyannis failed to conduct weekly inspections of the hazardous waste accumulation area. This constitutes conditions of noncompliance with 310,CMR 30.686 at the facility. 8. Ford of Hyannis failed to label the waste oil drain stands as satellite containers in violation of 310 CMR 30.253(6)(a)which references 30.341(2) (a) thru (c). 9. Ford of Hyannis failed to clearly mark (clearly visible line or piece of tape on the floor) the hazardous waste accumulation area in the paint shop. This constitutes a condition of noncompliance with 310 CMR 30.341(5) at the facility. 10. Ford of Hyannis had two (2)waste oil/regulated recyclable storage tanks that were open when not in use in violation of 310 CMR 30.253(6)(a)which references 30.342(1)(c) and 30.685(1). I� r -3- 11. Ford of Hyannis was not maintaining records of the volatile organic compound(VOC) emissions from the paint spray booth for the year 2004 in violation of 310 CMR 7.02(2)(e). IV. DISPOSITION 1. As a result of communications between the Department and Ford of Hyannis and without adjudication of any fact or law set forth above, the Parties have agreed to this Consent Order rather than expending the time and resources necessary to adjudicate this matter. 2. This Consent Order is issued by the Department pursuant to its authority under Massachusetts General Laws, Chapter 21A, Chapter 21C and Chapter 111 as applicable. 3. Ford of Hyannis assents to the authority of the Department to issue this Consent Order and waives its rights to further administrative or judicial review of this Consent Order. Ford of Hyannis reserves their rights to challenge any requirements imposed by the Department beyond those set forth in this Consent Order. 4. This Consent Order is not an admission of liability or a waiver of defenses,which Ford of Hyannis might raise in any proceeding to enforce this Consent Order. 5. Nothing in this Consent Order shall be construed as, or operated as, barring, diminishing; adjudicating, or in any way,affecting any legal or equitable right of the Department to issue any future Order with respect to the subject matter covered by this Consent Order, or in any way affecting any other claim, action, or demand which the Department may have with respect thereto. 6. This Consent Order is also a Notice of Noncompliance, issued pursuant to M.G.L. Chapter 21A, Section 16 and the regulations promulgated thereunder at 310 CMR 5.00. 7. 'The Department hereby determines, and Ford of Hyannis thereby agrees, that the deadlines set forth above in this Consent Order constitute reasonable times to perform the acts expressly agreed to in this Consent Order and that the activities required pursuant to this Consent Order otherwise meet requirements of 310 CMR 30.000 and 310 CMR 7.00. 8. The activities required pursuant to this Consent Order are subject to approval by the Department and shall comply with all other applicable federal, state and local laws. 9. This Consent Order shall apply to and be binding upon Ford of Hyannis and their respective successors, heirs and assigns. No change in property ownership will alter in any way the responsibility of Ford of Hyannis under this Consent Order. A signed copy of this Consent Order shall be provided to any successor, heir or assign of the Ford of Hyannis. 4 -4- 10. Any extensions to the performance dates in this Administrative Consent Order must be approved by the Department, in writing. 11. Ford of Hyannis shall not violate this Consent Order and shall not allow its successors, heirs, agents, or contractors to violate this Consent Order. V. ORDER 4. Within one (1) day of the effective date of this Order and thereafter, Ford of Hyannis shall conduct weekly inspections in the areas where hazardous waste containers are accumulated. 2. Within one(1)iday of the effective date of this Order and thereafter,Ford of Hyannis shall ensure that the two (2)waste oil/regulated recyclable storage tanks remain closed when not in use in accordance with 310 CMR 30.685(1). 3. Within five (5),days of the effective date of this Order, Ford of Hyannis shall ensure the following up-to-date information is posted next to each telephone: a. The name(s) and telephone number(s) of the emergency coordinator; b. The location(s) of the fire extinguisher(s) and spill control material(s), and if present,the fire alarms; c. The telephone number of the fire department, or, if there is a direct alarm system, instruction on how to activate it, or both; and d. Evacuation routes,where applicable. . 4. Within five (5) days of the effective date of this Order, Ford of Hyannis shall label all satellite waste oil containers in accordance with.310 CMR 30.341(2) (a)thru(c). 5. Within five (5) days of the effective date of this Order, Ford of Hyannis shall ensure that all areas where hazardous wastes are accumulated are clearly marked (e.g. visible line, piece of tape on the floor). 6. Within ten (10) days of the effective date of this Order,Ford of Hyannis shall accurately complete the Notification of Hazardous Waste Activity in Massachusetts application form to change their status to reflect their current generation rate of waste oil and hazardous waste using their #MAD981065147 generator number. A Notification of,Hazardous Waste Activity Form has been enclosed for your convenience. I .. -5- 7. Within ten (10) days of the effective date of this Order, Ford of Hyannis shall complete . and submit the Class A Notification form if Ford of Hyannis elects to continue their waste oil recycling operations; otherwise, Ford of Hyannis shall immediately begin managing the waste oil in accordance with the facility's specific generator status. A Class A Notification Form has been enclosed for your convenience. 8. Within thirty(30) days of the effective date of this Order and thereafter,Ford of Hyannis shall submit to the Department copies of the required air quality recordkeeping- for the year 2004 for the entire facility as required by 310 CMR 7.02(2)(e). VI. PENALTIES 1. In resolution of this matter, the Department assesses a total Civil Administrative Penalty in the amount of Two Thousand, Six Hundred and Thirty Dollars ($2,630). Ford of Hyannis agrees to-pay to the Commonwealth, pursuant to Chapter 21A, Section 16, $2,630, for the violations set forth in Section III above, within thirty (30) days of the Effective Date of this Consent Order. Payment must be made by certified check, cashier's check, or money order, payable to the Commonwealth of Massachusetts. No other form of payment shall be accepted. 2. The name "Ford of Hyannis"the document file number ACOP-SE-05-9013-27, and your -Federal Employer Identification Number (FEIN), shall be printed clearly on'the face 'of the certified check, cashier's check, or money order. STIPULATED PENALTIES: of the effective date of this Order and thereafter shall pay to the Department 'stipulated penalties in the amount of$1,000.00 per day for each day of each violation which extends beyond the compliance deadlines specified herein. This letter contains information from that visit that will help you become compliant with and remain compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous Materials. Enclosed is a copy of the Toxic and Hazardous Materials On-Site Inventory form from the site visit. Please note the problems identified at your place of business during the hazardous materials inspection and their corresponding orders or recommendations listed below. PROBLEM: • The waste oil and new oil tanks have releases on the top of the tanks and speedy dry, rags, and absorbents around the base of the tanks used to clean up the release. ORDER: • Remove all speedy dry,rags and absorbents from the base of the tanks and clean the area out. • To keep leaks and minor releases from reaching the base of the tanks,please place absorbents on the tops of the tanks to catch any releases before getting to the ground. This will make it easier to clean up in the long run. Once the absorbents are fully absorbed,they can be disposed of in the regular trash. PROBLEM: • Manifests for the disposal of the solvent from the oil/water separator are not readily available. ORDER: • All manifests are to be kept on site at all times and shall be readily available during inspections. PROBLEM: • Parts cleaner lid was open when not in use. RECOMMENDATION: • Keep lid closed when not in use to prohibit vapors and fumes from exiting the system. This is a fire and health hazard. PROBLEM: • Used shop rags were on the floor and on storage containers. RECOMMENDATION: • Used shop rags must be picked up and stored in a metal container with a lid at all times. Containing your shop rags properly can prevent a fire hazard. PROBLEM: • Tires being stored outdoors behind the building. Remove tires RECOMMENDATION: • Please remove tires on a regular basis to prevent mosquito accumulation. Mosquitoes are known to carry the West Nile Virus. OBSERVATIONS: • Cylinders are chained. • Fixed eyewash station is in place. • All containers are labeled with contents • Rag cans with lids present. The following is our written contingency plan, designed to prevent and minimize hazards to public health or to the environment from fires, explosions, spills or any other unplanned release of hazardous waste to the air, soil, surface or ground water. The plans will be administered by the Emergency Coordinator,who is the Owner/General Manager or Service Manager. FIRE RESPONSE Use of Fire Extineuishers. In the event that a fire does start, associates may respond with ABC-rated dry chemical fire extinguishers if the fire is small and they can approach it without endangering themselves. In such cases one associate should call the Fire Department(911)while others try to contain the fire. If associates are alone,they are instructed to call the Fire Department--not to fight the fire. If associates determine that they can use the fire extinguishers without endangering themselves,they should remove the pin of the fire extinguisher,point the nozzle at the base of the flames, squeeze the handle and direct the output to sweep back and forth at the base of the flames. During this operation it is important to be alert so that the fire does not cut off the associates' escape route,and that their lives are not threatened by smoke inhalation.If either of these conditions seems possible,they are instructed to get out fast,and leave the fire fighting to the Fore Department. Generally, water is not effective in fighting flammable and combustible liquid fires. Gasoline and oil float on water, so pouring water on this type of fire may actually spread the fire. Natural Gas Line. There is a gas line coming into a shut off and meter located in the outside of the building as shown in the "Evacuation Plan". In the event of fire or leaking gas the Emergency Coordinator should close this valve if it can be done without endangering themselves. Otherwise they should alert Fire Department and Gas Company workers. SPILL PREVENTION AND RESPONSE Initial response and[Morting spills. If there is a leak, immediately stop the discharge if it can be done quickly and without risk.Notify the Hazardous Waste Emergency Coordinator at once(phone numbers for the Emergency Coordinator are under"Emergency Phone Numbers"). Whenever the Emergency Coordinator determines that there is an imminent or actual emergency which could threaten public health, safety,welfare or the environment,they shall immediately: 1. Activate internal facility alarms or communications systems to notify all personnel. 2. Notify local agencies with designated response roles if their help is needed. 4M1 08/05/2005 13:38 4135677844 STEVE FITTS PAGE 03 Gasoline Solvent and Oil Spills If flammables are present,use only non-flammable tools and eliminate all sources of ignition. If the smell is very strong evacuate the area. Windows and doors may be opened to reduce odors, but do not turn on fans or other electrical equipment,unless they are explosion proof when flammables are involved. If there is a fire,don't open windows and doors, since the air will make the fire burn faster. For small spills pour ground clay(e.g. Speedi-Drii)around the spill, building a dike to prevent its spread. Pour additional ground clay on top of the spill. Remove or stop the source of the spill. Often this involves transferring material to an approved non-leaking container, such as DOT specification 17E closed head drum. In some cases it may be possible to tip a leaking drum on its side so that the hole is on the top. After the spill is stopped and absorbed,shovel the ground clay into an approved container,such as DOT specification 17H open-head drum with a Hazardous Waste label filled out. Acid Spills. Electrical storage batteries are a potential source of sulfuric acid spills if dropped or otherwise damaged. Spilled acid from batteries is hazardous waste because it is corrosive, and also may contain toxic substances including lead and arsenic. WARNING: SULFURIC ACID CAN CAUSE SEVERE SKIN BURNS, AND BLINDNESS IN THE CASE OF EYE CONTACT! In case of contact with acids, first rinse skin for at least 5 minutes(15 minutes for eyes)with cold running water then go for medical help. There is an eye wash flushing station at each dealership. If someone else is present,then get medical help while rinsing continues. Large acid spills(more than a quart)can be confined by pouring a dike of ground clay around the spill.The subsequent clean up of a large spill should be left to professionals. Small acid spills can be neutralized with sodium bicarbonate(baking soda)or sodium carbonate (soda ash). Wear protective clothing including eye goggles since there will be bubbling and splashing. Apply soda by sprinkling the powder,or an aqueous soda solution,on the aid spill gradually. The neutralization process is exothermic(gives off hear). Diluting strong acid solutions with water also generates heat that can cause boiling and splashing. The bubbles of carbon dioxide gas evolved during neutralization are not flammable but acids corning in contact with some metals including zinc generate flammable hydrogen gas. Always make sure that there are no sources of ignition at any acid spill and that flammables are kept separate. When enough soda has been added to neutralize the acid,the bubbling will stop even if more soda is added. Neutralization should be checked by dipping a piece of pH paper in the liquid and comparing the color of the paper with the chart on the package of paper. A pH of 7 is completely neutral,but a reading of 6 or above is acceptable. Clean up the neutralized spill with a mop and place in approved labeled Hazardous Waste containers. A DOT specification 17H drum is acceptable if a heavy duty polyethylene liner is put in the drum first. Rinse the area with mop and water. The first rinse water should go into the drum also.
