Tl e`inventory'total4from March 23,2005 indicates that you-have approximately 218 gallons of toxic and hazardous•materials being used/stored/generated/disposed of at your place of business. (Please refer to your copy of the Toxic and Hazardous Materials Onsite Inventory), A follow up visit to-the site was performed on May 5, 2005 by the Hazardous Materials Specialist. During that follow up visit, orders to correct noncompliant issues were found to be incomplete.. The Town of Barnstable Board of Health has determined that using,storing, generating and/or disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain an annual Hazardous Materials License. The fiscal year for the Town of Barnstable begins July I"of each year. The inspection on March 23, 2005 was for the fiscal year 2004-2005. A payment for the fiscal year 2005-2006 is now due. A permit to store/handle 111 gallons or more of hazardous materials for the year 2004-2005 and 2005-2006 shall be purchased by your business. You have 14 days to comply. You will receive your Hazardous Materials permit after you have passed your inspection and paid the license fee. Your continued cooperation is greatly appreciated. If possible,,shut off any sources of ignition and/or the source of the spill without endangering yourself or others 2 Evacuate the immediate area, making sure to close all doors behind you ' 3. Consult the MSDS for proper decontamination methods and medical requirements if exposed to the chemical in question. 4. Once safety has been confirmed for all involved, refer to MSDS for cleanup and disposal procedures. II. Fire 1. Sound the ala.rm if not already sounding 2. Dear Mr. O'Brien: Thank you for your time and cooperation during the hazardous materials follow up visit at Radisson Inn on May 5, 2005. This letter contains information from that visit that was found to be completed or still non compliant with the Town of Barnstable Ordinance Chapter 108: Hazardous Materials. Please note the problems and the recommendations or orders identified at your place of business during the hazardous materials inspection and the observations from May 5 202005: PROBLEM: • MSDS (Material Safety Data Sheets)are not available on site for all hazardous materials being used or stored at this facility. ORDER March 29,2005: • Obtain MSDS for all hazardous materials on site. • Create a binder that includes all master MSDS and keep in a location that is accessible to all associates. The Right to Know Law is part of the Massachusetts General Law, Chapter 111F. • The laundry facility is the only area in compliance. OBSERVATION May 5,2005: • MSDS on site,currently located in sales office. Recommended to have at the front desk as well in a binder labeled MSDS. M PROBLEM: • The housekeeping in the closet near the pool area must be maintained. ORDER March 29,2005: • The storing of hazardous materials should always be in on an impervious,chemical- resistant surface compatible with the materials being stored. Please see Chapter 108: Section 108-5B. • The non hazardous materials in the closet are flammable and may be an ignition source to the chemicals being stored in there. • Remove the non hazardous materials from the closet or remove the hazardous materials from the closet and place in an area specifically designed to store them,i.e. a metal storage cabinet. • Label all hazardous storage areas throughout the facility. OBSERVATION May 5,2005: • Carpet was removed from the closet. Chemicals are on an impervious surface. • Do need to be stored in a flammables cabinet due to the make up of the chemicals. • All non hazardous materials shall be removed from the closet until a metal storage cabinet is provided. • Area is not labeled as a hazardous storage area. PROBLEM: • There is no contingency plan or an emergency plan present in the facility in the event of an accidental.releas �r-spill:of al;azaFdouatal�s.:w ._. ORDER March 29,2005: " • Submit a contingency plan when applying for the Hazardous Materials Permit. All requirements for such a plan are listed in Chapter 108: Section 108-6E(4). OBSERVATION May 5,2005: • No Application or contingency plan has been submitted as of this date. PROBLEM: • Five CO2 cylinders are sitting on the ground in a high traffic area. ORDER March 29,2005: • These need to be chained up or removed immediately this is a requirement by the local Fire Department. OBSERVATION May 5,2005: • Area to store CO2 cylinders has chains available. • Approximately 5 cylinders located in the basement area are not chained up and are not free from accidental damage. PROBLEM: • Hazardous waste located on site. ORDER March 29,2005: • The waste oil and waste Freon located in the enclosed area outside the facility should be removed. • All hazardous waste must be labeled as"Hazardous Waste"and removed and disposed of in accordance with the Massachusetts Waste Management Act. Refer to Section 108-5C. OBSERVATION May 5,2005: w • Waste oil and waste Freon are still located in the enclosed area outside the facility. • 7 air conditioner units were observed in place. . • Gasoline storage inside wooden shed located next to enclosed area outside the facility. This must also be stored in a metal flammables cabinet. PROBLEM: • There is no spill kit available. ORDER March 29,2005: • Obtain a spill kit and place it in the laundry facility. There are higher quantities of hazardous materials being used and stored in this area. • This requirement is part of the contingency plan listed in Chapter 108: Section 108-6 E (3-4). OBSERVATION May 5,2005: • No spill kit available in the facility. OBSERVATIONS: • Temporary eyewash stations are in place. RECOMMENDATION March 29,2005: • Ensure enough of the eyewash solution is readily available to those who use it. OSHA standards require that there be at least 15 minutes of continual flow to both eyes. Please train the staff on MSDS location and what its uses are, spill kit location, once obtained, and its uses, and the contingency plan,which will be submitted with the application for the permit. With proper training,the staff will be able to assist if an emergency situation arises. The information provided in the last letter was intended to educate you,a business owner/operator in the.Town of Barnstable,in order to keep your business operations in compliance with local,state and federal toxic and hazardous materials laws so that you can avoid future regulatory problems. Complying with the Hazardous Materials ordinance(Chapter 108)can prevent contamination of Barnstable's existing and future drinking water supply,prevent environmental contamination which can bankrupt site owners, lower or destroy land values,drive out residents and industry, depress local economies and endanger public health. You currently are non compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous Materials. A representative from the Public Health Division will re-visit your business during the next 30 days to further advise you on your compliance. Failure to comply with these orders will result in a written warning with possible legal action.
