Atlantic 1801yanough Road, Hyannis, MA 02601 MassDEP RTN No.4-716 AET ENVIRONMENTAL TECHNOLOGIES,INC. 1 BACKGROUND 1.1 RAM Completion Report of August 25, 2006 Nelson Coal and Oil, shown on Figure 1, which shut down operations in 2005, decided to remove all tanks on the property in 2006 in preparation for an effort to sell the property. Saunders Associates submitted a RAM Completion Report in August 2006 to the MassDEP reporting that ten tanks, pipe lines and supporting containment walls were removed from the site during the week of April 17, 2006. The former locations of nine above ground tanks and one underground tank are shown on Figure 2. In addition to the tank removals, several areas of contaminated soil were removed. 1.2 Post Class C RAO Status Report and Periodic Review-October 2006 In October 2006, Saunders Associates submitted a 5-year status report on the Class C RAO filed in 2001 and a periodic review of the temporary solution. The major conclusions reached in status report and review are listed below: 1 Groundwater monitoring over the prior five years showed a steady improvement of groundwater quality. 2 The RAM conducted in Spring 2006 resulted in the removal of additional contaminated soil. 3 The feasibility of reaching a permanent solution was hindered by the lack of a defined source area that could be addressed by specific response actions. 4 The condition of No Substantial Hazard had been maintained, based upon the groundwater monitoring results and implementation of the RAM. 5 Biannual monitoring of monitoring wells NOC-9 and NOR-1B should continue to insure that the temporary solution is maintaining a condition of No Substantial Hazard. 2 POST CLASS C RAO STATUS REPORT 2006 TO 2011 2.1 Soil Sampling Conducted in the Former Tank Containment Area Saunders Associates completed six soil borings within the former tank containment area. These locations are shown on Figure 3. Split spoon samples were collected at five foot intervals and screened with a PID. Borings 1-4 showed elevated headspace readings and odor at the water table. Boring B-06-5 encountered odor and elevated volatiles at 15 ft below grade. A file review at MassDEP revealed a kerosene or fuel oil release occurred in the late 1980s in the vicinity of former Tanks#2 and#3 on Figure 2. The field boring logs of Saunders Associates are included in Appendix A. One new groundwater monitoring well (B-06-6) was placed in borehole B-06-6. This new monitoring well is down gradient of the former containment area for eight of the tanks which have been removed.. i Post Class C Rao Status Report&Peridoc Review Nelson Coal&Oil,Inc. Saunders noted that if the existing buildings are razed, a subsurface investigation in the area including former Tanks#2 and#3 should be considered. 2.2 Groundwater Monitoring-2007 to 2011 Groundwater sampling was conducted between 2007 and 2011. Three groundwater monitoring wells down gradient of the former containment area and tanks were sampled. These wells are B-06-6,NOR-1B and NOC-9. Table 1 summarizes all laboratory data. The trends on groundwater quality can be seen as the monitoring well data for each well is on a separate page. 2.2.1 Monitoring Well B-06-6 Exceedances of the MassDEP GW-1 Cleanup Standards were present over the last five years, But contaminant levels were declining over the period of 2007 to May 2011. Increased contaminant levels for some parameters were observed in November, 2011,but these are probably the result of a drop of 1.4 feet in the water table compared to May, 2011. As a general rule, a substantial drop in groundwater elevation can result in significant changes to groundwater quality. 2.2.2 Monitoring Well NOR-1B NOR-1B is located west of the railroad tracks as shown on Figure 3. Declining contaminant levels overall have been measured in NOR-1B during the period 2007 to 2011 as identified in Table 1. 2.2.3 Monitoring Well NOC-9 NOC-9 is located east of the railroad tracks. Throughout the period 2007 through 2011, MassDEP GW-1 Cleanup Standards were met, with the exception of two constituents in late 2009 and one constituent in early 2010,both of which have been below reporting levels since then. The groundwater quality in NOC-9 is strong evidence that a Substantial Hazard does not exist at the site. 2.3 Maintenance of Conditions for a Class C RAO It is recommended that biannual sampling in the spring and fall of monitoring wells B-06-6,NOR-1B and NOC-9 be continued in order to monitor the condition of no Substantial Hazard. 3.0 PERIODIC REVIEW OF TEMPORARY SOLUTION Under 310 CMR 40.1051(3)(b), a periodic review of the Temporary Solution is required this year. 3.1 Effectiveness of Temporary Solution Groundwater sampling conducted since 2006 has continued overall to show improvement. Although the most recent round did indicate increases in a few parameters, that is believed to be associated with a lower groundwater table in the recent round of sampling. The primary downgradient well, NOC-9, continues to show that the Temporary Solution has been effective in maintaining a condition of No Substantial Hazard. 2 Post Class C Rao Status Report&Peridoc Review Nelson Coal&Oil,Inc. The soil (S-3) and groundwater (GW-1 and GW-3) categories remain unchanged for the Site. There has been no change in exposures or use of groundwater. A sale of the Site is scheduled to occur at the end of 2011. The new owner reportedly proposes to raze all of the buildings and structures that remain at the site. 3.3 Feasibility of Implementing a Permanent Solution Insofar as conditions at the Site have remained unchanged, the original Temporary Solution evaluation remains accurate. It is not buried up to 10% underground as you have quoted me from the fire code, but rests on the ground in an area surrounded by a concrete containment wall. All seven of the other tanks are approximately 8 feet off the ground and inside a containment wall as well. These are also not underground tanks. The base of the tank in question was excavated by me and a member of the Nelson staff and was found to be approximately 4 inches below grade and sitting on a concrete slab and, in order to be classified as an underground tank, would have to be only 40 inches tall. Gentlemen: This letter concerns the existence of petroleum hydrocarbons present in the environment in and around the Nelson Coal & Oil Company, Inc. (NCO) , property located at 180. Iyanough Road in Hyannis, Massachusetts (hereafter referred to as the "site") . IEP Inc. , on behalf of the Barnstable Water Company, conducted a limited hydrological investigation in order to determine the source of the contamination affecting the Maher wells located downgradient from the site. Results of analyses of well water samples obtained at and near the site indicate the presence of volatile organic compounds (VOCs) . This situation constitutes a release and a continuing threat of release of oil or hazardous materials at and from the site. The prevention and mitigation of such release and threat of release is governed by M.G.L. , Chapter 21E, the Massachusetts oil and Hazardous Material Release Prevention and Response Act (hereinafter, M.G.L. , C. 21E) . The site is also subject to 310 CMR 40. 000, the Massachusetts Contingency Plan (hereinafter, MCP) , promulgated pursuant to M.G.L. , C. 21E. The MCP defines the purpose, scope and required activities in successive phases of investigation and remedial action at a site. (Copies of the MCP can be obtained from the Sate House Book Store) . Based upon the available information, the Department has reason to believe that NCO is a party with liability under M.G.L. , C. 21E, Section 5. M.G.L. , C. 21E, Section 5 provides that parties responsible or liable to the Commonwealth for costs incurred at or relative to the site by the Commonwealth include: current and past owners and/or operators of a site; any person who transported, stored, disposed of or treated hazardous materials to or at the site; or any person who in any way caused the release or threat of release of oil or hazardous materials. The nature of .. this liability is joint and several and without regard to fault. t I -2- The Department is authorized pursuant to M.G.L. , C. 21E, Sections 3A(j ) and 4 to take such response actions at the site as it deems necessary should NCO fail to respond to these releases in an appropriate and timely manner. Any response actions taken by the Department will be. dictated by the individual characteristics of the site and by the time lines set out in M.G.L. , C. 21E, Section 3A, and the MCP. Under M.G.L. , C. 21E, NCO may be liable for up to three times the cost of any and all response actions conducted by the Department due to the release, including all contract and administrative costs. If you fail to reimburse the Department for its response actions, the Department may place a lien on. all of your property in the Commonwealth. The Commonwealth may choose to foreclose on that property in order to satisfy the lien or it may choose to instruct the Attorney General of the Commonwealth to recover the debt or any part of it in a court action against NCO. NCO's liability may also include damages for any injury to or for destruction or loss of natural resources resulting from the release. Additional liability may be imposed under M.G.L. , C. 21E, Section 11 in the form of fines or penalties for each violation of Chapter 21E. As a party liable for the release/threat of release at the site, the Department requires that NCO take the steps outlined below: 1. Provide the Department with a written response to this letter within ten (10) days of receipt hereof. 2 . Contract with a consultant knowledgeable in hazardous waste site assessment and abatement to conduct the following work in accordance with the MCP. a. Complete and submit, within forty-five (45) days of receipt of this Notice, a Preliminary Assessment Report (copy enclosed) meeting the requirements of the MCP. b. A Phase I-Limited Site Investigation as outlined in 40. 543 of the MCP. The Phase I Report documenting all Phase I activities shall be prepared and submitted to the Department within 90 days of receipt of this letter. c. In conjunction with the development of the Preliminary Assessmnent Report and the Phase I Report, the consultant shall evaluate the need for a Short Term Measure (STM) as defined in 40. 542 of the MCP and notify the Department immediately if a STM is deemed necessary. This evaluation shall continue throughout the assessment process for the site. 3 . Presure test all existing underground storage tanks and filler lines and submit to the Department the tank test results. For all tanks that fail the test, make arrangements to remove them from the . ground and notify the Department in advance so that Department personnel can be present at the time .of tank removal. -3- Depending on the information generated by the above work, the Department may require additional investigations, studies and actions. If NCO fails to take this actions or if NCO fails to perform these tasks in accordance with the standards of the Department, the Department may perform response actions in NCO's stead and recover its costs from NCO in accordance with the provisions described above. Be advised that the sending of this letter coincides with the placement of this site on the Massachusetts Hazardous Waste Site List in accordance with M.G.L. , C. 21E, Section 3A, and will result in the tracking of the progress of this site by the Department. You must notify the Department of your decision to accept or not accept the permit. To accept this Permit, the applicant shall sign and submit to the Department the completed Permit Acceptance Statement within thirty(30) days of issuance of the Permit. If the signed permit is not received within the thirty (30) day deadline, the Department may consider this permit void. Consequently, you may be required to submit a new permit application and the appropriate fee in order to obtain a permit to conduct response actions. Pursuant to 310 CMR 40.0770, any person who is aggrieved by a decision of the Department with respect to any Tier I Permit Application may request an adjudicatory hearing before the Department. Please refer to 310 CMR 40.0770 and 310 CMR 40.0050, for conditions upon which an adjudicatory hearing may be requested. .Unless a request for adjudicatory hearing is made pursuant to 310 CMR40.0770, in accordance with 310 CMR 40.0750, the permit shall become effectively twenty-one (21) days after the date of issuance by the Department and the receipt of the signed permit acceptance statement, whichever is later. REFUND OF APPLICA TION FEE The Department was not able to complete the review of the permit application within the timelines as defined in 310 CMR 4.00. As such, you are entitled to a refund of the permit fee. The Department has prepared the necessary paperwork to authorize the refund to Nelson Coal and Oil, if applicable,or the person or organization that paid the Permit Application. SCOPE OF WORK APPROVAL The Department reviewed the Scope of Work and supporting documentation and agrees that additional response actions are necessary to define the extent of contamination at the site and achieve a permanent solution pursuant to 310 CMR 40.1000. The Department therefore approves the Scope of Work with the following conditions: 1. According to the report titled "Unit 3 Group, Barnstable Aquifer Protection Project, Phase II Comprehensive Site Assessment Report" dated March 24, 1997 and prepared by SEA Consultants, Incorporated, the site is located in a Zone II established for the Town of Barnstable Maher Municipal Wellfield. The Report also stated that a sheen was observed on the groundwater surface of monitoring well NCO-3 in July 1996. Total Petroleum Hydrocarbons were also detected in the well at a concentration of 51 milligrams per liter (mg/1). This concentration exceeds the Method 1 Cleanup Standards established for Groundwater Category GW-1. The GW-1 Standard is protective of drinking source areas. Therefore, BARNSTABLE-BWSC/SMP RTN4-00716 Page 3 of 5 Decision to Grant Permit-Remedy Operations Status Submittal additional monitoring wells should be installed on and off the property to delineate the full extent of contamination in the vicinity of this well pursuant to 310 CMR 40.0835. 2. The RAM Status Report/RAM Plan Addendum, dated October 1997, and prepared by Saunders Associates, stated that five (5) steel product distribution lines were replaced with double walled piping in the summer of 1997. The distribution lines conveyed gasoline,fuel oil and diesel fuel from the tank farm to .two (2) dispenser pump islands located adjacent to the Office .Building. Approximately twenty (20) cubic yards of petroleum-impacted soil were removed during the replacement of the lines. Post excavation soil samples were also collected and analyzed for Volatile and Extractable Petroleum Hydrocarbons. A review of the analytical data indicated that naphthalene, the C9- C,p aromatic fraction and the C,t-CZZ Aliphatic<fraction exist in the soil adjacent to the dispenser pumps at concentrations of 13 milligrams per kilogram (mg/kg), 500 mg/kg and 670 mg/kg, respectively. These concentrations exceed the Method 1 Cleanup Standards established for Soil Categories S-1, S-2 and S-3 located in a Zone II. Therefore, additional response actions should be conducted in the area of the dispenser pumps to achieve a level of no significant risk in the soil pursuant to 310 CMR 40.0900. 3. The assessment activities should be expanded to address the potential impacts associated with the following: a. The former cesspool located north of the tank farm. b. The dry well located in the tank farm containment area. In addition, the Phase II Comprehensive Site Assessment Report should also describe the construction of the dry well and identify all the influent and discharge points. c. The 250-gallon waste oil underground storage tank located adjacent to the east wall of the Vehicle Storage Building. d. The 560-gallon underground storage tank removed by Clean Harbors in 1987 and used to store leaded gasoline. The Site Map contained in the Phase II Report should be modified to depict the location of this tank. In addition, any documentation generated during the removal of the tank should also be included in the Phase II Report. e. The delivery truck parking area and the loading dock located west of the Office Building. 4. The potential for the 16-inch water main to be a preferential means of contaminant transport and a migration pathway should be addressed in the Phase II Report. The Site Map contained in the Phase II Report should also be modified to depict the'location of the 16-inch main. i «. BARNSTABLE-BWSC/SMP RTN4-00716 Page 4 of 5 Decision to Grant Permit-Remedy Operations Status Submittal ADDITIONAL SUBMITTALS To avoid the need to submit a second Permit Extension Application prior to the September 28, 2001 deadline, you should submit a Class C Response Action Outcome (RAO) or a Remedy Operation Status (ROS) pursuant to 310 CMR 40.0893,,if a Class A RAO, Permanent Solution, cannot be achieved. Operation, Maintenance and Monitoring (OMM) is required for either a Class .0 RAO or ROS (refer to 310 CMR 40.0897(3) and 310 CMR 40.0891, respectively). Both the Class C RAO and ROS allow for additional time to achieve a Permanent Solution, provided all substantial hazards have been eliminated. The Class C RAO, however, requires periodic evaluation of the Temporary Solution no less than once every five (5) years, pursuant to 310 CMR 40.1050. Upon successfully achieving a Class C RAO, or submitting a Phase IV Completion Statement stating that Phase V activities are required, Tier I Annual Compliance Fees will be suspended and Post-RAO OMM or Phase V Annual Compliance Assurance,Fees.of.$500 will,be assessed. , Please note that the Department may perform an audit of this site in the future to ensure compliance with the terms and conditions of the permit and the requirements of the MCP.
