NOTICE THAT VIOLATIONS OF 105 CMR 410.000, STATE SANITARY CODE II -
MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND ARTICLE
51 OF THE TOWN RENTAL ORDINANCE HAVE BEEN CORRECTED.
The property owned by you located at 26 Louis Street,.Hyannis, was re-inspected on March 13,
2004 by David Stanton R.S., Health Inspector for the Town of Barnstable, at the request of the
owner that the violations cited previously had all been corrected.
The following violations of the State Sanitary Code were observed corrected:
105 CMR 410.351: Owner's Installation and Maintenance Responsibilities: A water pipe
was observed leaking in the basement.
105 CMR 410.353: Asbestos: Asbestos wrapped pipe in the basement was observed in
disrepair with defects of holes, cracks and tears.
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements: The upstairs
bathroom ceiling was observed sagging down.
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements: There was a
large hole observed in the floor in front of the toilet in the upstairs bathroom.
105 CMR 410.150: Washbasins, Toilets, Tubs, and Showers: There was a large gap
observed between the back splashguard of the washbasin, and the wall.
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements: There were
several cracks and water stains observed on the ceilings of the main level, including the computer
room, and the dining room.
105 CMR 410.500: Owner's Responsibility to Maintain Structural Elements: There was a
hole observed in the ceiling of the dining room above the chandelier.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY CODE II
- MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND ARTICLE
51 OF THE TOWN RENTAL ORDINANCE.
The property owned by you located at 26 Louis Street, Hyannis, was inspected on December 1,
2003 by David Stanton R.S., Health Inspector for the Town of Barnstable, because of a
complaint.
The following violations of the State Sanitary Code were observed:
V 105 CMR 410.351: Owner's Installation and Maintenance Responsibilities: A water pipe
was observed leaking in the basement.
105 CMR 410.353: Asbestos: Asbestos wrapped pipe in the basement was observed in

You are directed to correct the violations listed above within thirty (30) days of your
receipt of this notice, by repairing the leaking pipe in the basement, by repairing or
removing the asbestos wrapping on the pipes in the basement in accordance with 310 CMR
7.00 and 453 CMR 6.00, by repairing the bathroom ceiling so it does not sag down, by
repairing the hole in front of the toilet so it is filled in and finished off with a cleanable
watertight finish, by filling in the back splashguard of the washbasin with caulk or the like,
so it is watertight, smooth and cleanable, by repairing the cracks in the ceilings and
stopping the source of the water damage, and by securing the ceiling plate of the chandelier
to the ceiling so it does not create an area for insect harborage.
You may request a hearing before the Board of Health if written petition requesting same is
received within ten(10) days after the date the order is served.
Non-compliance, could result in a fine of up to $100.00 per violation. Each day's failure to
comply with an order shall constitute a separate violation.

We received several letters from the attorney representing the landlord since January 5th regarding this matter. Most of
the repairs have been made. The landlord has made attempts to repair the remaining violations; however it has been
reported to us that the tenants have not been cooperative with the contractors. Below is detailed information in this
regard:
- January 5, 2004-Attorney Joseph Maruca wrote a letter to the tenants indicating that Richard Rakauskas, a
contractor was at the house that morning to replace the bathroom ceiling, to fix a hole in the dining room ceiling,
and to fix stains and cracks in the main level ceilings. A tenant named, Rachel,told him to stop and leave.The
letter further reads: "Please call Mr. Rakauskas at 508 737-4854 and reschedule the work. Do not delay."
- January 6, 2004—Mr. Maruca reported to the Health Division that the following violations have been remedied:
- Water pipe leak in basement
- Asbestos-wrapped pipes
- Hole in floor in upstairs toilet
- Gap between splashguard and wall
January 12, 2004-Attorney Joseph Maruca wrote a letter to the tenants informing them that they missed an
appointment with the contractor, Mr. Linell. An appointment was made for 4:30 p.m. on Friday January 91h. Mr. Linnell
arrived to do the work and there was nobody to let him in.
January 20, 2004- On January 20th, a contractor named David Linnell came into the Health Division Office and
verbally reported to me that he attempted to make appointments to return to the house to make repairs on two
separate occasions. The tenants were uncooperative with him; they did not keep the appointments made. Mr. Linnell
stated he will prepare a written statement to that effect for our file.
January 20, 2004-The Health Division received a copy of a letter from the landlord's attorney, Joseph Maruca dated
January 16th addressed to the tenants which reads as follows: David Linnell, the contractor hired by your landlord to
complete the repairs at your property, reports that you called him and told him not to get involved in this situation, you
discourage him from working at the premises, and were rude to him." The further indicates that a plumber was being
contacted to repair the frozen pipe in the first floor bathroom. The letter further reads: "Please cooperate with the
plumber by being there when he arrives, not interfering with his work, and try not to be rude."
What is the telephone number for Mr. Greaney(there is a digit missing in your email)? I will be happy to call him back
today.

I called Mr. Greaney back. We had a conference call with Attorney Joseph Maruca. Mr. Maruca stated that he will contact
the landlord and will make arrangements to have another contractor go back there to make repairs later this week. Mr.

Re: Extension of Order Letter Deadline
You have been granted an extension to the 30 days for compliance to our letter dated December
4, 2003,for the property owned by you at 26 Louis Street,Hyannis. We are in receipt of your
letter stating that the tenants did not meet you at the scheduled appointment that they setup with
you to make the necessary repairs. Your extension has been granted because the tenants have not
complied with 105 CMR 410.810 Access for Repairs and Alterations: Every occupant of a
dwelling, dwelling unit, or rooming unit shall give the owner therof, or his agent or employees,
upon reasonable notice,reasonable access, if possible by appointment, to the dwelling, dwelling
unit, or rooming unit for the purpose of making such repairs or alterations as are necessary to
effect compliance with provisions of 105 CMR 410.000. Your extension is granted to have the.
repairs completed by January 27,2004. Failure to comply with this new deadline will result in
$100/day/violation fine(s.) The tenants claim there is mold inside the dining room closet. Please
have your contractor clean the mold in the closet during his repairs. Should you be denied access
to conduct the repairs again,please provide our office with letter(s) stating the dates and times
you attempted to gain access,but were denied. If you have any questions, please feel free to
contact me. When the repairs are completed, please contact me so that I may witness that the
work has been completed.

I understand that the contractor, Richard Rakauskas, visited
the premises yesterday to determine the extent of repairs needed,
and that he made an appointment with you to return today to start
making repairs. Mr. Rakauskas informs us that he .arrived at the
appointed time today and there was nobody at the premises to let
him in. , He waited•. a half=hour and nobody came.

Also, when.Ms. Tonge called me on December 16 , 2003, she told

Dear Mr. McKean:
I am writing on behalf of Yolima Vasquez, the owner of the
above-referenced property. Ms. Vasquez is in receipt of your
letter of December 4, 2003 (copy enclosed) regarding violations
of the State Sanitary Code.
Please be advised that Ms.. Vasquez has remedied the water
pipe leak in the basement (105 CMR 410. 351) and corrected the
asbestos problem (105 CMR 410. 353) .
Ms. Vasquez has also hired a contractor, Richard Rakauskas
o.f_.�.Hyannis to fix the other five items listed in your letter.
You should, however, be aware that"'there',•_may �ibe some diffi-
culty in completing the repairs within the 30.-day period required
because the tenants have changed the locks and will not provide a
key. Gaining access to the property by the contractor may be a
problem, but all reasonable efforts will be made in order to get
the work done on time.
Finally, Ms. Vasquez's address is 51 Pond Street, Natick, MA
01760 (not Westboro, MA) . Please correct your records according-
ly.
Please let me know when you plan to, schedule a re-inspection
of the premises. In the meantime, feel free to call me if you

Asbestos
Hazards Microscopic asbestos fibers from friable (loose or
crumbling) asbestos can be suspended in air and
inhaled. Once inhaled, fibers remain in lungs, causing
lung cancer.
• Asbestos may be found in pipe insulation and
insulating boards, textured wall surfaces, electrical
equipment, floor and roofing tiles and certain
adhesives.
Handling . If asbestos is in good condition, and fibers are not
exposed, it does not need to be removed.
• Slightly damaged or Loose asbestos can be re-
wrapped rather than removed.
• Asbestos should be handled by a certified asbestos
abatement contractor (call Massachusetts Department
of Labor and Workforce Development at 800-425-
0004 for list of licensed abatement contractors).
• DEP requires notification at least 10 business days
prior to any asbestos removal activities. Call 617-292-
5983 for more information.
• All asbestos containing materials must be
containerized, labeled and removed in accordance
with DEP regulations (see 310 CMR 7.15). Asbestos
must be adequately wetted so that fibers will not be
released, and sealed in leak-tight, properly labeled
containers. If bags are used, they should be thick
plastic (6 mil) and double bagged. The same handling
procedures are required for contaminated clothes and
equipment. Container must then be labeled with an
OSHA approved asbestos warning label.
• Do not dust, sweep or vacuum particles suspected of
containing asbestos.
Management • All asbestos materials must be disposed of in landfills
Options permitted to receive asbestos. Currently there is only
one such permitted landfill in Massachusetts:
_Chicopee Landfill (formerly Partyka) 413-594-4172.
• Asbestos-containing asphalt roofing materials and
vinyl asbestos floor tiles that are not broken and are
removed in accordance with DEP regulations can be
disposed of in designated solid waste landfills.
Asbestos containing materials should never be
disposed of in a combustion facility or compacted
because fibers may be released to the surrounding
area.

It seems you missed another appointment with a contractor
who was to make repairs at the house you rent from Ms. Vasquez.
This time the contractor, David Linnell, says that he made an
appointment with Charles for 4:30 p.m. on Friday, January 9,
2004 . Mr. Linnell arrived to do the work, and there was nobody
to let him in.
Mr. Linnell was going to fix the ceilings. Please call Mr.
Linnell at 508/344-8858 to reschedule the appointment so the
repairs can be completed.
I also understand that you have not paid your December or
January rent. I will once again ask you to pay the rent.
As I have previously explained, you are not entitled to

David Linnell, the contractor hired by your landlord
to' complete the repairs at your property, reports that you
called him and told him not to get involved in this situa-
tion,- you discouraged him from working at the premises, and
were rude to him.
I also understand that you have reported a frozen pipe
in the first floor bathroom. Your landlord, Yolima Vasquez,
is calling plumbers to try and find one to come and fix the
problem. Please cooperate with the plumber by being there
when he arrives, not interfering with his work, and try not
to be rude.

On Tuesday February 17, 2004, the Board of Health held a public meeting to discuss
your request for additional time, submitted on behalf of your client Yolima Vasquez, to
complete the required repairs at 26 Louis Street Hyannis. Your request regarding the
above referenced matter was scheduled on that agenda; however you were not present at
the meeting.
Two letters dated January 26, 2004 (one addressed to Thomas McKean, and the other
addressed to Brandon Hart and the other occupants) were reviewed by the Board of
Health members.
After some discussion, the Board voted unanimously to grant you additional time, until
March 30, 2004, to rectify all of the violations.
This extension is granted because contractors have been experiencing difficulties gaining
access to the property, as outlined in your letter.

On behalf of Yolima Vasquez, the owner of 26 Louis Street,
Hyannis, I am_ requesting additional time to complete the repairs_
required pursuant to your December 4, 2003, Notice To Abate
Violations.
Ms. Vasquez has made an effort to have the work done, but
due�t& difficulties with contractors gaining access to the
property (as outlined in previous letters) and the difficulty of
getting new contractors on short notice;`:•=the repairs to the
ceilings have not been done.
Two new contractors are planning to visit the property this
week to escalate the work that needs to be done and give esti-
mates. - They• are Stewart Painting and Darrel Diaz. Steward
Painting has. an appointment at the premises on Wednesday, January
28, 2004, at 11 a.m.
