REQUEST FOR MOIDIFIEID IRA PLAN

Dear Mr. Sousa:
On November 15, 1999, the Department of Environmental Protection, Bureau of Waste Site
Cleanup received a report titled "Revised Immediate Response Action Completion Report" (the IRA
Completion Report) dated. September 1999 and prepared by the Gulf of Maine Research Center,
Incorporated(the Gulf of Maine). The IRA Completion Report stated that a total of four(4) 10,000 gallon
underground storage tanks were removed from the site in March 1999. The tanks were located adjacent to
an existing building and contained gasoline and diesel fuel. Approximately 10,000 gallons of petroleum
impacted groundwater were removed from the excavation during the.tank removal process. A groundwater
sample was collected from the excavation and analyzed for volatile petroleum hydrocarbons(VPH).
A review of the analytical data revealed that the C9-C12 aliphatic fraction, the Cg-C10 aromatic
fraction,.methyl tertiary butyl ether (MTBE), benzene, toluene and naphthalene were detected in the
groundwater sample collected from the tank excavation at a concentration of 10,700 micrograms'per liter
(ug/1), 5,140 ug/l, 66,800 ug/l, 380 ug/l,2,440 ug/l and 194 ug/l, respectively. These concentrations exceed
the Method 1 Cleanup Standards established for Groundwater Category GW-l. The concentration of the
Cg-C 12 aliphatic fraction, the C9-C 10 aromatic fraction and methyl tertiary butyl ether detected in the
groundwater sample also exceed the Method 1 Cleanup Standards established for Groundwater Category
GW-2. The Groundwater Category GW-1 and GW-2 Cleanup Standards were developed to protect
potential drinking water sources and indoor air, respectively. Volatile petroleum hydrocarbons were also
detected in MW-102 and MW-103 above Method 1 Cleanup Standards for Groundwater Categories GW-1
and GW-2. In addition,the IRA Completion Report also stated that the Gulf of Maine conducted a slug test
in monitoring wells MW-102 and MW-103 on September 2, 1998.
On January ,11, 2000, the Department issued you a Decision to Grant a Tier IC Permit. . The
Department also requested that an Immediate Response Action Plan be submitted to address a potential
condition of Substantial Release Migration pursuant to 310 CMR 40.0006 and 310 CMR 40.0413. On
March 13,2000,the Department"received an Immediate.Response Action Plan(the"IRA Plan')for the site
dated March 2000 and prepared by the Gulf of Maine.

The IRA Plan proposed that a soil-gas survey be conducted along the southeast comer of the site to
evaluate the migration of vapors into buildings. The survey was to consist of the installation of an unknown
number of soil-gas probes located between monitoring wells MW-102 and MW-103 depicted on Figure 3
titled "Site Features— 14 East Main Street, West Yarmouth, MA". A soil gas sample was to be collected
from each probe and analyzed in accordance with Department Policy titled "Characterizing Risks Proposed
by Petroleum Contaminated Sites, Implementation of MA-DEP, VPH/EPH Approach Public Comment
Draft"dated October 31, 1997. In addition,a slug test was to be conducted in MW-103 as part of the IRA.
The Department has determined that migration of dissolved and vapor,phase constituents off the
property must be evaluated. The Department therefore determined that the IRA Plan is inadequate to
evaluate the potential Substantial Release Migration (SRM) condition described above and denies the IRA
Plan. A modified IRA Plan should be submitted to the Department within fourteen (14) days of receipt of
this letter and include a schedule and a description of all off-site activities proposed to evaluate the SRM
condition. The Department recommends that the IRA Plan include the installation of a monitoring well off
the property in the area east and west corner of Dan's Tire and Auto. The need to conduct additional
response actions at the site including the installation of monitoring wells should based on the outcome of this
investigation,the Phase II Comprehensive Site Assessment and a Risk Characterization.
If you do not take the necessary response actions, or fail to perform them in an appropriate and
timely manner,the Department is authorized by M.G.L. c.21E to perform the work. By taking such actions,
you can avoid liability for response action costs incurred by the Department in performing these actions and
any sanctions,which may be imposed,for failure to perform response actions under the MCP.
