RE: 148 West Main Street, Hyannis and Chapter 170 - Rental Ordinance—of the Town
of Barnstable Code.
Dear Britt,
In October 2006, a new ordinance was put into affect in the Town of Barnstable
requiring all residential rental properties to register with the Town of Barnstable Health
Department. There are some exemptions to this ordinance which include: amnesty
properties, properties owned by Barnstable Housing Authority, and any other facility that
has yearly inspections through a State Agency. Because the above referenced property is
inspected by HUD and Mass Housing, they are exempt from this ordinance and are
compliant with the Town of Barnstable.

EMERGENCY CONDEMNATION AND ORDER TO
VACATE
Finding of Unfitness for Human Habitation and
Determination of Immediate Danger
In accordance with M.G.L. c.111, sec. 127A and 127B, 105 CMR 400.000: State
Sanitary Code, Chapter I: General Administrative Procedures and 105 CMR
410.000: State Sanitary Code, Chapter 11: Minimum Standards of Fitness for
Human, David W. Stanton, R.S. and Marybeth McKenzie, Health Inspectors for
the Town of Barnstable, on September 10, 2007 conducted an investigation of a
dwelling unit located at 148 West Main Street, Hyannis,Unit D-112 (Fawcett's
Pond Apartments), Hyannis. The owner of this dwelling unit is Fawcett's Pond
Apartments.
Based on the results of that investigation, the Barnstable Health Department finds
that the dwelling is unfit for human habitation. Pursuant to M.G.L. c. 127B and
105 CMR 410.831 (D), the Health Department further finds that the conditions
within the dwelling are such that the danger to the life or health of the occupants of
the subject dwelling is so immediate that no delay may be permitted in making this
finding.
Conditions found within the dwelling, which give rise to the emergency finding of
unfitness and determination of immediate danger, include:

410.750 (1) Objectionable odors emanating to the outside of said dwelling unit
caused by the occupant of the unit. Occupant's bed was covered in feces.
Based upon these findings any and all occupants are hereby ordered to vacate and
the landlord/owner is ordered to secure the subject dwelling within 48 hours of
receipt of this order. If any person refuses to leave a dwelling or portion thereof,
which was ordered vacated she may be forcibly removed by the local Board of
Health (Massachusetts General Laws C. 127B), or by local police authorities at
request of the Board of Health.
Furthermore, anyone who fails to comply with any order of the board of health may
be subject to fines ranging from $104500. Each day's failure to comply with an
order shall constitute a separate violation.
Once vacated this unit may not be occupied without the written approval of the
Board of Health.

The following conditions, when found to exist in residential premises,
shall be deemed conditions which may endanger or impair the health, or safety
and well-being of a person or persons occupying the premises. This listing
is composed of these items which-ire deemed to always have the potential to'-
endanger or -materially impair the health or safety, and well-being of the
-occupants or the public. Because Chapter II, 105 CMR 410.000 through 410.499
state minimum requirements of fitness for human habitation, any violation has
the potential to fall within this category in any given situation but may not
do so in every case and therefore cannot be included in this listing:- Failure
to include shall in no way be construed as.a determination that other.
violations may not be found to fall within this category. Nor shall failure
to include affect the duty of the local health 'official to order repair or
correction of the violations) pursuant to 410 CMR 410.830 through 410.833

EMERGENCY CONDEMNATION AND ORDER TO
VACATE
Finding of Unfitness for Human Habitation and
Determination of Immediate Danger
In accordance with M.G.L. c.111, sec. 127A and 127B, 105 CMR 400.000: State
Sanitary Code, Chapter I: General Administrative Procedures.and 105 CMR
410.000: State Sanitary Code, Chapter ll: Minimum Standards of Fitness for
Human, David W. Stanton,R.S. and Marybeth McKenzie, Health Inspectors for
the Town of Barnstable, on September 10, 2007 conducted an investigation of a
dwelling unit located at 148 West Main Street, Hyannis, Unit D-112 (Fawcett's
Pond Apartments), Hyannis. The owner of this dwelling unit is Fawcett's Pond
Apartments.
Based on the results of that investigation, the Barnstable Health Department finds
that the dwelling is unfit for human habitation. Pursuant to M.G.L. c. 127B and
105 CMR 410.831 (D), the Health Department further finds that the conditions
within the dwelling are such that the danger to the life or health of the occupants of
the subject dwelling is so immediate that no delay may be permitted in making this
finding.
Conditions found within the dwelling, which give rise to the emergency finding of
unfitness and determination of immediate danger, include:

410.750 (I) Objectionable odors emanating to the outside of said dwelling unit
caused by the occupant of the unit. Occupant's bed was covered in feces.
Based upon these findings any and all occupants are hereby ordered to vacate and
the landlord/owner is ordered to secure the subject dwelling within 48 hours of
receipt of this order. If any person refuses to leave a dwelling or portion thereof,
which was ordered vacated she may be forcibly removed by the local Board of
Health (Massachusetts General Laws C. 127B), or by local police authorities at
request of the Board of Health.
Furthermore, anyone who fails to comply with any order of the board of health may
be subject to fines ranging from $10=$500. Each day's failure to comply with an
order shall constitute a separate violation.
Once vacated this unit may not be occupied without the written approval of the
Board of Health.
Note: This is an important legal document. It may affect your rights.

Your unit C-213 was inspected on September 5, 2001. Brett O'Hera informed Mr. Barry
that a friend of yours volunteered to clean up the unit two days prior to the inspection
conducted by Mr. Edward Barry.
However,the unit had an unbearable order of human waste when he arrived. Also,the
sofa in the living room was badly stained with parts of the fabric removed.
In addition,the bedroom had two mattresses and:a box spring of which three (3) were
stained top to bottom encompassing a diameter of almost two (2) feet. These large stains
penetrated deeply though the sofa and through the mattress and box spring.
It is strongly recommended that the sofa and two of the mattresses and box spring be
removed and discarded prior to re-occupancy of the apartment unit.

This-letter is in response to your communication dated November 14, 1997 regarding one of our
tenants, Sandra Leneten C-I I I and your visit on that date.
With regard to,the leaking ceiling. We were initially denied access to patch the ceiling but it has
since been patched and we are now being denied access to paint by the resident.
Your report also indicates chronic dampness. As we are aware under State Sanitary Code
Section 410.045 - chronic dampness means the regular and or periodic appearance of moisture,
water, mold or fungae. We have been in the apartment on various occasions and at no time has
there been any signs of this.
We have requested Ms. Leneten meet with Kate McDermott, Regional Director and Lisa Trevani,
Service Coordinator on Tuesday,November 25th at 10:00 to try and resolve any issues she may
have. If you have any further questions,please do not hesitate to call me in the office.

With reference to screen doors for the Village at Fawcett' s Pond.
About .2i years ago Domonic DiNatale took a petition to the 96
tenants and obtained 85 signatures from those who wished to have
screen doors installed. The remaining tenants were not in at that
time.
Every year CMJ sends out questionaires to the tenants and they
have persistantly requested screens, storm doors, until finally
officials came down for coffee hour one Wednesday, to tell us they
didn't have enough cash-flow to. make such an investment, and that
it would spoil the appearance -.of the buildings. Several tanants
asked permission to purchase them individually and were denied.
CMJ has ignored repairs to leaking ceilings on the third floor,
specificly, D 313 and 316. I
All tenants on the first floor in' both .buildings, have endured
serious problems with water coming in and causing mildew and
mold, because of being on the ground. floor. level_built. on a slab.
Baseboards are pulling away from the walls and soaked carpeting,
slimy mattresses and no dehumidifiers. Those who have bought theft
own are- taking out an average of two gallons per day!
CMJ loaned a dehumidifier to an unfortunate tenant and paid the
electricity ,. until she could get her own, then reimbursment was_
denied. _ ..
After snow and ice storms the ice freezes on the door casing in-
side, as well as snow drifts in around ,the doors where they gap
peeling off the paint and soaking the carpeting on the third floor
facing the pond.

The. Board of Health voted unanimously of this decision after considering you and your
attorney Norma Mann's testimony at the public meeting held August 22, 1989.
Our inspector, Edward Barry, visited the site on December 11, 1989, and did not observe
any screen doors at the:-units.
You are reminded of the order to place combination (replaceable type) storm and screen
doors on all ninety-eight (98) units front and back doorways within the time specified,
which is ten (10) days from the date of this letter.
Non-compliance may result in a fine of up to $500. Each day's failure to comply with
an order shall constitute a separate violation.

HUD.They have two other retirement condos on the Cape,

SCREEN DOOR PROBLEM: Residents have been requesting screens for
their two exterior door apartments for over three years
with no sucess.The Town of Barnstable Board of Health
gave them 120 days to put on combination screen doors.
This meant that the screen door had to be installed
by Dec. 19, 1989.An inspection of The Village At Fawcetts
on Dec. 19, 1989 at 11 :30 am by Edward Barry showed that
no door combination screens had been installed by the due
date.A certified letter was sent to CMJ following this
inspection.
Marion Lawhead said that CMJ could not afford
the expense so had to borrow $399000.00 from HUD to
be able to install the screen doors.

molding for the space to make up the difference. Without that,

to the outside from any dwelling unit. A copy of the Regulation
is enclosed. You are directed to correct the violations 410.552
within thirty ( 30) days of receipt of this notice.
You may request a hearing if written petition requesting same
is received by the Board of Health within seven (7) days of

410.552: Screens for Doors
The owner shall provide a screen door for all doorways opening
directly to the outside from any dwelling unit or rooming unit where
the screen door will be permitted to slide to the side or open in an
outward direction, provided, that in an owner-occupied unit, the
owner need provide screens only for those doorways used for ventila-
tion. All new or replacement screens in screen doors shall be of not
less that 16 mesh per square Inch.
(A) Said screen door:
(1) shall be equipped with a self-closing device except where the
screen is designed to slide to the side; and
(2) shall be tight-fitting as to prevent the entrance of insects and

I would like to confirm a conversation I had with Mr. Barry of your office
on Friday, August 4, 1989.
Mr. Barry stated that CMJ Management would be entitled to a hearing
as according to the procedure stated in the Sanitary Code.
This hearing would allow CMJ the opportunity to discuss this issue with
the Board and request an extention of time if that is necessary.
Mr. Barry stated that you would notify me as to the hearing date and
that date would possibly be August 22, 1989.

According 105 CMR 410. 552, of the State Sanitary Code, the owner
shall provide a screen door for all door-ways opening directly
to the outside from any dwelling unit. A copy of the Regulation
is enclosed. You are directed to correct the violations 410. 552
within thirty ( 30) days of receipt of this notice.
You may request a hearing if written petition requesting same
is received by the Board of Health within seven ( 7 ) days of
receipt of this notice.
