The site plan has been revised to show the Permits ,. ., primary leaching facility as far from the resource areas as practical, as well as now meeting the 20' setback to the proposed foundation. 4 We are responding to Mr. McKean noting the fact that the Disposal Works Application indicates 2 bedrooms, even though the approved septic design plan, as based on Title 5 '95, was for four bedrooms. The original septic upgrade plan was filed for necessary variances(in 1996) and subsequently.approved, signed off by Susan Rask, then chairman of the Board of Health. Upon review of 15.002 (definitions), "approved capacity" for a 1978 Code system is based on the Disposal. Works Application (or Certificate of Compliance), whichever is less. For a system designed in accordance with 310 CMR 15.000 (which this system is), "the approved calculated capacity'is'based on the loading rates found at 310 CMR a 15.242". Subsequent discussion with Brian Dudley from DEP to gain clarification.on the above supports the fact that this is an approved four bedroom system and therefore the owners are entitled to a four bedroom dwelling. The dwelling as.proposed is for 3 bedrooms plus an office. The project consists of moving a portion of the existing dwelling and adding onto that portion, which will bring the dwelling into better zoning conformance than what exists. By moving and angling the dwelling and addition,there is now greater area for the leaching facility to also be in better conformance with Health Regulations. The existing leaching facility, currently straddling the easterly lot line, could not be placed on-site without the need for greater variances than what we are requesting currently, should there be no proposed construction. An attempt to gain an easement from the neighbor was not met with any success. In summary, we do not consider this-project to be"new construction', as under the definition this will be a replacement of a building,in`ekistence as of March 31, 1995;there will not be an increase in design flow, no increase in design flow above the existing approved capacity, no increase in the number of dwellings or dwelling units and no increase in the number of bedrooms.
