During installation of storm water catch` basins, an underground storage tank was encountered. The UST was subsequently removed; a vacuum truck offloaded the contents prior to extraction. The Massachusetts Oil and Hazardous Material Release Prevention and Response Act, M.G.L. c.21E, and the Massachusetts Contingency Plan (the,'MCP'), 310 CMR 40.0000, require the performance of response actions to prevent harm to health, safety, public welfare and the environment which may result from this release and/or threat of release and govern the conduct of such actions. The purpose of this notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release at this property. For purposes of this Notice of Responsibility, the terms and phrases used herein shall have the meaning ascribed to such terms.and phrases by the MCP unless the-context clearly indicates otherwise. The Department has reason to believe that the release and/or threat of release which has been reported is or may be a disposal site as defined by the M.C.P. The Department also has reason to believe that you (as used in this letter, "you" refers to Town of Barnstable) are a Potentially Responsible Party (a "PRP") with liability under M.G.L. c.21E §5, for response action costs. This liability is "strict", meaning that it is not based on fault, but solely on your status as owner, operator, generator,transporter, disposer or other person specified in M.G.L. c.21E §5. This liability is also "joint and several", meaning that you may be liable for all response action costs incurred.at a disposal site regardless of the existence of any other liable parties. You may also avoid the imposition of,the amount of or reduce certain permit and/or annual compliance assurance fees payable under 310 CMR 4.00. Please refer to M.G.L. c.21E for a complete description of potential liability. For your convenience, a summary of liability under M.G.L. c.21E is attached to this notice. You should be aware that you may have claims against third parties for damages, including claims for contribution or reimbursement for the costs of cleanup. Such claims do not exist indefinitely but are governed by laws which establish the time allowed for bringing litigation. The Department encourages you to take any action necessary to protect any such claims you may have against third parties. At the time of oral notification to the Department,the following response actions were approved as an Immediate Response Action(IRA): • Assessment. • Removal of Tanks/Drums/Containers. • Excavation and disposal of up to 20 cubic yards of contaminated soil. • Vacuum removal of the contents of the UST. • All Remediation Waste must be properly stored/handled and disposed of within 120 days from the date of generation per 310 CMR 40.0030. ACTIONS REQUIRED Additional submittals are necessary with regard to this notification including,but not limited to,the filing of a written IRA Plan, IRA Completion Statement and/or an RAO statement. The MCP requires that a fee of$750.00 be submitted to the Department when an RAO statement is filed greater than 120 days from the date of initial notification. Specific approval is required from the Department for the implementation of all IRAs, and Release Abatement Measures (RAMS) pursuant to 310 CMR 40.0420 and 310 CMR 40.0443, respectively. Assessment activities, the construction of a fence and/or the posting of signs are actions that are exempt from this approval requirement. In addition to oral notification,.310 CMR 40.0333 requires that a completed Release Notification Form (BWSC-103, attached) be.submitted to the Department within sixty (60) calendar days of May 17, 2002. You must employ or engage a Licensed Site Professional (LSP) to manage, supervise or actually perform the necessary response actions at this site. The Department has Brian Longvall of GeoTech listed as the LSP of record. Unless otherwise provided by the Department, potentially responsible parties ("PRP's") have one year from the initial date of notification to the Department of a release or threat-of a release,pursuant to 310 CMR 40.0300, or from the date the Department issues a Notice of Responsibility,whichever occurs earlier, to file with the Department one of the following submittals: (1) a completed Tier Classification Submittal; (2) a Response Action Outcome Statement or, if applicable, (3) a Downgradient Property Status. The deadline for either of the first two submittals for this disposal site is May 17,2003. Mr. Tyson Rose Received verbal permission to excavate,stockpile on-site and dispose of up to 20 cubic yards of petroleum contaminated soil. * Note Lee McConnell (Town Environmental Officer) contacted Tyson Rose at 10:45 A.M. but she had poor connection and requested Brian Longyal,LSP to make the call to the DEP on behalf of the Town of Hyannis Background: On Friday, May 17, 2002, while excavating for new storm drains during construction activities related to Safety Improvements of Barnstable Road, Pavao Construction Company (Davao), uncovered and removed an underground storage tank (UST) in a Town.owned parking lot situated near the corner of North Street and Barnstable Road. The tank ruptured during the removal and released an unknown quantity of gasoline-impacted water into the excavation hole. The tank was placed in the parking lot adjacent to the excavation, and further excavation ceased. Ms. Lee McConnell, Environmental Officer for the Town of Barnstable Board of Health proceeded to contact police and fire officials to the site. Pavao contacted Mr. Brian Longval LSP of GeoTek Engineering Inc. (GeoTek) to ,provide professional environmental consulting services for the release. Mr. Longval instructed Mr. Josh Hart, Environmental Engineer of GeoTek to visit the site to evaluate the site conditions. Mr. Hart, arrived on site at nine A.M. May 17, 2002 to assess the site and determine if a reportable release had occurred. After speaking with Ms. Lee McConnell, who was present during the time of release, it was determined that the exact quantity of,'the release was unknown, however she indicated it was in excess of 10 gallons. Mr. Hart then took precautions to prevent any additional release by surrounding the tank with sorbant pads. Mr. Joshua Hart communicated the information to Mr. Brian Longval, LSP who then contacted Mr. Tyson Rose of the Emergency Response Division of the Southeast Regional Office of the Department of Environmental Protection (DEP). Mr. Rose provided verbal approval to conduct assessment activities in order to delineate the extent of the release. The disposal site was assigned release tracking number RTN 4-17060. Following the initial containment activities, Mr. Gary Buckman of GeoTek Engineering Inc. arrived on site at 12:00 P.M. May 17, 2002 to provide professional oversight for the tank closure services. Mr. Buckman filed the required permits with the Hyannis Fire Department for cleaning, removal and disposal of the UST. Mr. Buckman contacted CYN Oil Corporation, of 1771 Washington St. Stoughton, MA 02072, to remove the tank contents, clean and inert the tank for transport. The petroleum impacted water and tank sludge were transported to the Mobil Oil Corporation in Albany, NY under a manifest. After CYN completed the cleaning and pumping of the tank, it was removed and transported to James Grant Company, 28 Wolcott St. Readville, MA 02137. GeoTek observed and documented the conditions of the tank following the cleaning. The tank was constructed of single wall steel and was in fair to good condition with the exception of the rupture. Initial IRA Activities: Following the cleaning and removal of the tank Mr. Buckman collected samples from the tank grave representing the North, South, East, and West sidewalls and two bottom samples. The samples were then screened for the presence of petroleum hydrocarbons using a portable Multi RAE photo ionization detector (PID) to determine where surficially the petroleum hydrocarbons were concentrated. 4 Barnstable Road N Barber Shop Drainage . basins i Restaurant Tank Grave Parking Lot T a� t: 0 z GeoTek Engineering Inc Figure A 15 Beulah St 2nd Floor Site Attributes Framingham, MA 01701 RTN 4-17060 Comer North St. and Bamstable Rd: Hyannis, For Illustrative Use Only No Scale The methodology that GeoTek employed for headspace screening follows standard industry practices and protocol for placing soil samples into glass jars sealed with tin-foil and screw covers, warming each sample to ambient temperature, then agitating the samples to disturb volatile gases within the soil pore space, then allowing the samples to equilibrate. GeoTek recorded relative PID responses from the headspace of each sample, using a Multi RAE equipped with a 10.2 electron volt lamp, by inserting the PID probe through the tin foil. . The PID measures the total concentration of hydrocarbon gases in parts per million/volume (ppm/v) in the sample headspace relative to an isobutylene standard calibration gas. The recorded concentrations are actual instrument responses and are isobutylene equivalents. The PID does not discriminate specific compounds. On Tuesday May, 21 2002 Mr. Joshua Hart arrived on site to conduct further assessments of the site to delineate the extent of impacted soil and determine if the release had reached the groundwater. Mr. Hart directed Pavao to excavate test pits surrounding the area in question to delineate the impacted soil and determine the depth to groundwater. Two test pits were excavated to approximately eleven feet deep by three feet across and four feet long and are illustrated in Figure A. The third test pit was excavated to approximately 16 feet to determine groundwater depth. Groundwater was not encountered during the assessment activities. On Test Pits (1) and (3) samples were taken at six and eleven feet and screened using the PID. On Test Pit (2) samples were taken from the surface, six, and eleven feet because this test pit was closer to where the release had concentrated. All headspace screening results, with the exception of the surface of Test Pit (2) were ND (i.e. 0.0 ppm/v). For Illustrative Use Only Hyannis, MA No Scale Based upon the assessment activities the estimated volume of soil that was impacted by the release was determined to be approximately 12-17 cubic yards of soil. Mr. Rose of the DE.P was contacted and the assessment results were conveyed to him to obtain verbal approval to excavate soil for off-site disposal. Mr. Rose provided approval to excavate and stockpile up to 20 cubic yards of contaminated soil. IRA Soil Excavation: On May 22, 2002, wider the direction of Mr. Josh Hart, Pavao excavated the area of impacted soil. The excavation continued until Mr. Hart recorded non-detectable levels (i.e. 0.0 ppm/v) headspace readings with the PID. In addition, Mr. Hart utilized olfactory senses and visual observations to supplement the PID readings. At this time Mr. Hart estimated that approximately 10-12 yards of soil were removed and stockpiled onsite. The contaminated soil was placed on top of 6 ml poly with 6 ml poly covering the stockpile. Following excavation of the delineated area, Mr. Hart confirmed that the remediation was complete by obtaining samples from sidewalls and the bottom of the excavation and conducting jar headspace screening and laboratory analysis. The confirmatory samples were delivered to GeoLabs Inc. Environmental Laboratories in Braintree, Massachusetts under a chain of Custody for analysis for Extractable Petroleum Hydrocarbons and Volatile Petroleum Hydrocarbons. Figure B illustrates the sites former tank grave and the location of the excavated contaminated soil. Analytical: Results of the soil samples follow in Table 1 (VPH) and Table 2 (EPH), and the laboratory- reports provided by GeoLabs are included as Appendix C. The VPH analysis were all non-detectable with the exception of the West Side Wall Carbon Chain C9 — C12 Aliphatics which had a result of 0.559 mg/Kg, considerably below the most conservative Method 1 clean-up standard of 1000 mg/Kg. Purpose,Objective,and Strategy of IRA: The initial IRA implementation was conducted to remove contaminated soil and attempt to eliminate the site conditions that resulted in the reporting condition with the anticipation of achieving a Response Action Outcome Al or A2. Current Conditions: Follo«ring the removal of the source of contamination(i.e. the UST with petroleum and petroleum contaminated water),the excavation and disposal of approximately 10-12 cubic yards of soil. Soil Disposal: The analytical results of the stockpile indicated that the soil met the criteria for recycling at an asphalt hatching facility. GeoTek prepared a Bill of Lading for transport and recycling at Aggregate Industries n Environmental Services in South Dennis,Massachusetts and Pavao Construction transported the soil to the facility on June 14,2002. The laboratory analysis of the stockpile is included as Appendix D. The volume of soil accepted at the facility_ was 13.61 tons or approximately 10 cubic yards. During installation of storm water catch basins, an underground storage tank was encountered. The UST was subsequently removed; a vacuum truck offloaded the contents prior to extraction. The Massachusetts Oil and Hazardous Material Release Prevention and Response Act, M.G.L. c.21E, and the Massachusetts Contingency Plan (the "MCP"), 310 CMR 40.0000, require the performance of response actions to prevent harm to health, safety, public welfare and the environment which may result from this release and/or threat of release and govern the conduct of such actions. The purpose of this notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release at this property. For purposes of this Notice of Responsibility, the-terms and phrases used herein shall have the meaning ascribed to such terms and phrases by the MCP unless the context clearly indicates otherwise. The Department has reason to believe that the release and/or threat of release which has been reported is or may be a disposal site as defined by the M.C.P. The Department also has reason to believe that you (as used in this letter, "you" refers to Town of Barnstable) are a Potentially Responsible Party (a "PRP") with liability under M.G.L. c.21E §5, for response action costs. This liability is "strict", meaning that it is not based on fault, but solely on your status as owner, operator, generator,transporter, disposer or other person specified in M.G.L. c.21E §5. This liability is also "joint and several", meaning that you may be liable for all response action costs incurred at a disposal site regardless of the existence of any other liable parties. At the time of oral notification to the Department, the following response actions were approved as an Immediate Response Action(IRA): • Assessment. • Removal of Tanks/Drums/Containers. • Excavation and disposal of up to 20 cubic yards of contaminated soil. Vacuum removal of the contents of the UST. • All Remediation Waste must be properly stored/handled and disposed of within 120 days from the date of generation per 310 CMR 40.0030. ACTIONS REQUIRED Additional submittals are necessary with regard to this notification including, but not limited to,the filing of a written IRA Plan, IRA Completion Statement and/or an RAO statement. The MCP requires that a fee of S750.00 be submitted to the Department when an RAO statement is filed greater than 120 days from the date of initial notification. Specific approval is required from the Department for the implementation of all IRAs, and Release Abatement Measures (RAMs) pursuant to 310 CMR 40.0420 and 310 CMR 40.0443, respectively. Assessment activities, the construction of a fence and/or the posting of signs are actions that are exempt from this approval requirement. In addition to oral notification, 310 CMR 40.0333 requires that a completed Release Notification Form (BWSC-103, attached) be submitted to the Department within sixty (60) calendar days of May 17, 2002. You must employ or engage a.Licensed Site Professional (LSP) to manage, supervise or actually perform the necessary response actions at this site. The Department has Brian.Longvall of GeoTech listed as the LSP of record. Unless otherwise provided by the Department, potentially responsible parties ("PRP's") have one year from the initial date of notification to the Department of a release or threat of a release, pursuant to 310 CMR 40.0300, or from the date the Department issues a Notice of Responsibility,whichever occurs earlier, to file with the Department one of the following submittals: (1) a completed Tier Classification Submittal; (2) a Response Action Outcome Statement or, if applicable, (3) a Downgradient Property Status. As a PRP, you are required to conduct and complete certain response actions outlined in the MCP to clean up the release of oil and/or hazardous materials expeditiously. What happens if I fail to comply with or respond to the NON? You have 30 days from the date you receive the NON to comply. If you fail to comply, you will be assessed a penalty by the Department. Your total penalty exposure can be considerable. For example, penalties can be assessed for each day you remain in noncompliance. Note that the Department is allowed by law to back calculate daily penalties to begin on the date you received the NON. You can be penalized thousands of dollars should you fail to comply with or respond to the NON by the 30-day deadline. Please refer to the Civil Administrative Penalty Statute, Chapter 21A, Section 16 and 310 CMR 5.00, the Civil Administrative Penalty Regulations, for complete details on the Administrative Penalty rules. When the cleanup contractor finished the work in the field, I thought my dealines with the Department were finished.What more do I have to do? This is a common question asked when a NON is received. PRPs often think their dealings with the Department are over when, for example,the fieldwork is completed by a cleanup contractor. Examples of this type of fieldwork include cleaning up a spill from a saddle tank leak on a roadway, or removing contaminated soil from a tank grave during a tank replacement or oil-contaminated debris from a storage tank after a fire. The fieldwork may be complete, but you still must submit some paperwork to the Department to prove that the cleanup was undertaken in compliance with the MCP. The MCP includes deadlines by which you must complete response actions and submit information about those response actions to the Department. We track the progress of cleanups by checking to see if you are sending information about your cleanup progress to the Department on time. For example, if we do not receive a Response Action Outcome Statement (RAO) before the 1-year anniversary date of the release, we must assume that the environmental cleanup has not been completed. For work to continue after the 1-year anniversary date of the release, the MCP requires that you submit a Tier I or Tier 11 Classification to the Department. If the Department does not receive either an RAO or Tier Classification by the 1-year anniversary date, we must assume that you are not implementing any cleanup at all. Without your fi i cooperation in obtaining the cleanup information, the Department does not know whether serious environmental problems are being addressed. If work is not being performed, the Department must take action to ensure it happens. On the other hand, you may have finished the cleanup but neglected to forward the cleanup documentation required by the MCP. What do I have to do to comply with the NON? First, all response actions not directly managed by the Department staff must be overseen and directed by a "Licensed Site Professional" or LSP. LSPs are licensed by the Commonwealth, and their stamp and signature are required (together with yours) on all but one form you must submit to the Department. If you don't already have the forms and information required for you to comply with this NON, contact the consultant and/or cleanup contractor who worked on your cleanup. If you have not undertaken any cleanup work, contact an LSP immediately. A list of LSPs may be obtained by calling(617) 556-1091 or viewing the list on the Internet at http://www.state.ma.us/Isp. The documents you must submit to the Department require LSP stamp and signature. For example, when a cleanup is completely finished, the MCP requires that you submit a document called a "Response Action Outcome" (RAO) to the Department in which you attest that you have completed the cleanup in accordance with the MCP. If you do not submit an RAO to the Department, the case remains open in the Department's files even if the fieldwork is completely finished. If you received this NON and you think the fieldwork is completely finished, call your cleanup contractor and .LSP to find out how to have an RAO prepared and submitted to the Department. If more environmental studies or cleanup are needed (for example, following the initial cleanup of a highway spill or soil contamination found during a tank replacement), you must submit forms describing your plans to continue the work in a timely manner. Again, these forms must contain an LSP's stamp and signature, and be co-signed by you. Depending on the circumstances, the possible submittals are an Immediate Response Action (IRA) Plan, IRA Status Report, IRA Completion Statement, and/or a Tier Classification Submittal and Tier I Permit Application. You should also be aware that the Department does not become involved in or help mediate billing disputes with insurance companies, cleanup contractors, or LSPs. A common response to a NON is that an insurance company is slow on paying cleanup bills or will not cover various cleanup costs. We also hear that cleanup firms and LSPs will not send in RAOs and other forms because their clients have not paid their bills. These matters must be resolved privately by you. You ultimately must comply.with the attached NON or be subject to significant penalties from the Department.
