Dear Ms. Wolfe:
We have received another complaint regarding sleeping quarters in your
basement.
A copy of the Board's decision letter is enclosed. As you are aware, the
Board of Health met with you on June 16, 2009, and requested the beds be
removed as it is unsafe to sleep in the basement due to the lack of safe exiting.
Due to the findings of the Board of Health decision, we are emphasizing
the issue that the basement is not to be used for sleeping.

Dear Ms. Wolfe:
At the Board of Health meeting dated June 16, 2009, the Board of Health
unanimously voted to uphold the decision of the Health Agent, Timothy
O'Connell, regarding the above-mentioned address.
The basement shall not be used for sleeping purposes t safe in
its current construction. All beds must be removed from the basement
immediately due to the incompliance with the Building Codes for proper egress of
sleeping quarters.

II. Hearing — Housing:
Kimberly Wolfe, owner— 12 Old School House Road, Hyannis,
housing/rental issue.
Kimberly Wolfe and Lori Evans were present. Kimberly said she has removed the
bed in the basement as there is not a second means of egress. There is only a
sofa there, which is acceptable. Ms. Wolfe was looking for clarification on
whether as a owner and not a renter, whether she would be allowed to have a
bed in basement. The Board informed her it is not permitted for either type party
due to safety reasons.
No action is needed.

kids are out playing. 04-07-2010 - Complainant stated that the problem of the illegal
basement apartment has resurfaced.

On 5-4-09 went to said property and met with tenant who has a room within the basement. I
observed 2 bedrooms on main floor of home. Also observed two rooms within basement that had
beds in them. Both rooms due not have second egress windows. I have,not been able to locate
any septic records on this property. Will continue to search. Then draft an order letter once I
know the septic capacity.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II—MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION,
THE STATE ENVIRONMENTAL CODE, TITLE 5.
The property owned by you located at 12 Old School House Road was inspected on May
4, 2009 by Timothy O'Connell, R.S., Health Inspector for the Town of Barnstable. This
inspection was conducted on the basis of a complaint. The following violations of the
State Sanitary Code were observed
410.450 Means of Egress: Observed two (2) rooms within basement being used as
bedrooms without second means of egress. There were a total of two (2) bedrooms
observed on the main floor of this dwelling. Your septic capacity is for three (3)
bedrooms not for four(4).
You are directed to correct the violations listed above within twenty four (24) hours
of your receipt of this notice by removing all beds from basement and ceasing and
desisting from using any part of basement as sleeping quarters. You must install an
egress window if you choose to use it for sleeping. You may install an egress window
into one of the rooms within the basement which would give you a total of(3) three
bedrooms which your septic has been designed for. This must be done with a proper
building permit from the Town of Barnstable Building Division.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order is served. Non-compliance will
result in a fine of$100.00 per violation. Each day's failure to comply with an order shall
constitute a separate violation.
