This letter contains information from that visit that will help you become compliant with Chapter 108 of the Town of Barnstable.Code: Hazardous Materials. Enclosed are copies of Chapter 108: Hazardous Materials ordinance and a copy of the Toxic and Hazardous Materials On-Site Inventory form from the site visit. Please note the observations identified at the facility during the hazardous materials inspection and the recommendations listed below: OBSERVATIONS: • Hazardous Materials Permit has not been obtained. • Waste oil tank in the amount of 250 gallons is not in compliance with Chapter 108-5 Storage Controls. "All liquid hazardous materials, which are stored outside, shall be stored above ground in a covered container within a containment area designed to contain a minimum of 110%of the volume of all materials to be stored". • Waste fuel collection takes place on site. Two 55 gallon drums are located outdoors under a roof with secondary containment. Currently investigating the ability to remove this process from the facility. • Flammable cabinets are not properly vented to the outdoors. • MSDS on site and available. • All cleaning products are neatly organized and are locked in a storage area. RECOMMENDATIONS: • To become compliant,install a roof over the waste oil tank. Another option is to remove the 250 gallon waste oil tank entirely and place a 55 gallon drum indoors on secondary containment. The facility does not produce enough waste oil to have the 250 gallon tank. • Please vent the flammable cabinets to the outdoors upon moving the cabinets to their permanent location. • Ensure correct MSDS are present and continue to update the sheets with any new product. On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from April 17, 2007 shows that you have approximately 826 gallons of toxic and hazardous materials being used, stored, generated and disposed of at the Town of Barnstable Structures and Grounds Division located at 800 Pitcher's Way,Hyannis,MA(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). Under the provisions of Chapter 111, Section 31 of the General Laws of Massachusetts, hazardous materials used, stored, and disposed of in the amount of 111 gallons or more a month requires a license from the Public Health Division. Due to the quantity listed above,you are required to obtain a hazardous materials permit with a fee from the Public Health Division. This permit may be obtained from the Town of Barnstable Town Offices,200 Main Street,Hyannis, MA 02601.The application for the year 2007-2008 is due June 30,2007. A follow up site visit will be completed to ensure all recommendations are taken into consideration. Please note the problem areas that need improvement and their corresponding orders/recommendations listed below: Problem: Approximately ten(10)large vehicle batteries are stored outdoors with no secondgU containment and no cover to protect them from exposure the elements. Order: • Please comply with the Town of Barnstable Ordinance: Article 39, Section 5-1 (copy enclosed)which states that all hazardous materials stored outside must have 110% containment and a roof to conceal them from the elements,leakage,accidental damage and vandalism. • If these batteries cannot be contained outdoors,then please keep all waste batteries indoors until they are properly disposed of by a licensed hazardous waste hauler or taken to a place of business that accepts waste batteries and has them disposed of by a licensed hauler. Violation: Vehicle washing with soap is taking place at this location. • The Structures and Grounds building at 800 Pitcher's Way does not have an approved car wash system in place. • The Town of Barnstable has a Vehicle Washing Policy(enclosed)which is enforced under Article 39: Control of Toxic and Hazardous Materials. This policy expressly prohibits vehicle washing at any and all automotive repair shops,bus companies, :a. automobile sales businesses,municipal.owned repair garages,vehicle rental businesses, and any other businesses or governmental agencies where an approved car wash system is not provided which meets all of the requirements of the MA Department of Environmental Protection and the Town of Barnstable General Ordinance,Article 39. • The spraying and rinsing of an engine under-body of a vehicle is also considered`vehicle washing"regardless of whether or not soaps are used to wash or rinse an engine or under- body of a vehicle. • Vehicle washing at this location also violates: 1) 314 Code of Massachusetts Regulations, Section 5.03: Discharges Requiring a Permit: (1)No person shall discharge pollutants to ground waters of the Commonwealth without a currently valid permit from the Department pursuant to M.G.L. c. 21,43 and 314 CMR 5.00. • 2) 314 Code of Massachusetts Regulations, Section 6.06: Minimum Ground Water Quality Criteria: (1)Class 1 and Class 2 Ground Waters(must meet the listed criteria) (aa)All Other Pollutants: None in such concentrations which in the opinion of the Department would impair the waters for use a source of potable water or to cause or contribute to a condition in contravention of standards for other classified waters of the Commonwealth. • 3)Class 3 Ground Waters: (must meet the listed criteria)—All Other Pollutants:None in concentrations or combinations which upon exposure to humans will cause death, disease,behavioral abnormalities,cancer, genetic mutations,physiological malfunctions, or physical deformations or cause any significant adverse effects to the environment,or which would exceed the recommended limits on the most sensitive ground water use. Order: • CEASE and DESIST all car/vehicle washing with soap,car wash detergents, degreasers or any type of"biodegradable"cleaning product. • A"Warning Notice"has been issued.to this division in regards to this violation. • Vehicle bodies(top,sides,.front and back)may be rinsed off with water only. • An approved car wash system(as mentioned above)must be in place to resume regular vehicle washing at this location in the Town of Barnstable. Violation: Waste oil and waste gasoline is accepted from the public at this location for recycling/disposal. The waste oil is not used as heat for any shop onsite. Hazardous waste must be disposed of by a licensed hauler and documentation(manifests)must be made available upon request. There was no hazardous waste disposal information or documentation presented during this inspection. Order: • Please comply with the Town of Barnstable General Ordinance,Article 39: Control of Toxic and Hazardous Materials, Section 12-3 which states, "All records pertaining to storage,removal and disposal of toxic or hazardous wastes shall be retained for no less than five(5)years...and shall be made available for review by the Health Department upon request." • Please keep either the originals or copies of hazardous waste disposal manifests at the Structures&Grounds office at 800 Pitcher's Way. • Self hauling of hazardous wastes must be documented as well to account for the proper handling and compliant disposal of chemical wastes(i.e. "Cradle to grave" responsibility). • From this point forward,please keep records of when any hazardous waste is hauled to a secondary location for disposal or use as heating oil. Please log what material was taken, the amount of the material(must be under 55 gallons per trip)to whom the material was taken,the location, and date of delivery. f w>• • Federal law allows hazardous waste to be self-hauled without a federal i.d.number or permit if the amount is SS gallons or less per trip. Problem: • The waste gasoline barrels and waste oil tank at this location do not specifically indicate the level of health hazard they can have. • The waste oil tank is not labeled to indicate what it contains(which is imperative when responding to an emergency in the Town of Barnstable at any location that stores/uses hazardous materials). • There were some containers found during the inventory that had no labeling to indicate what chemical product they were,their health hazard or storage requirements. • A container of unknown hazardous material and several bags of fertilizer were found cracked/torn open and leaking in the"Poison"storage shed at this location. Order: • . Please label ALL hazardous material/waste containers and tanks with their health hazard (i.e. "TOXIC", "FLAMMABLE", and"HAZARDOUS WASTE"). • In addition to this,the type of hazardous material/waste must be labeled on all storage containers or tanks. • Additional signs should be posted on the waste gasoline storage containment system to indicate flammability and the danger of the material stored there. • All containers used for storage and disposal of hazardous materials should be in good condition(i.e.NO cracks,leaks,containers without caps/lids or containers without secondary containment if the hazardous material should spill or.leak). Problem: • There were several observations of improper storage of hazardous materials during this inspection. • Some of the current storage arrangements could potentially cause an accidental spill,.a health hazard,or fire. Order: • Cans of flammable aerosol products are stored on a wood shelf in the main shop area. These should be relocated to the flammables storage locker. • In the"cage"area of the shop,hazardous material/chemical storage is on the top shelf (close to the low ceiling in this area). This storage location forces workers to reach up onto a shelf and then pull a toxic or hazardous material down toward them. These chemical products should be relocated to shelves that are eye level to ensure worker safety when handling hazardous materials. • Flammable/combustible materials(paint products,thinners,floor sealants)should be relocated from the wood lined shelves to metal shelves only. Wood lining on the shelves is not safe in that it can add to the risk of combustion. Flammables should be stored in the fire proof cabinet,on metal shelves or in secondary containment tubs:(i.e. . Rubbermaid tubs). • Hydrochloric acid was found in two different locations in this shop. Both locations were metal shelving. This material is considered highly corrosive to steel and must not be stored on metal shelving. Please relocate all hydrochloric acid to a plastic secondary containment tub/tray and stored away from metal material. • Flammable aerosol products and acetylene (flammable gas)were stored improperly in the HVAC shed. Please relocate the flammable storage to metal shelving or a flammables cabinet. The acetylene container should be stored securely attached to an approved holding stand and the valves must be checked and also secured. • A hazardous materials storage reference sheet is enclosed with this letter. The Toxic and Hazardous Materials On-Site Inventory from September 8th shows that you have approximately 1,030 gallons of toxic and hazardous materials being used, stored,generated and disposed of at the Town of Barnstable Structures&Grounds shop at 800 Pitcher's Way. The Board of Health has determined that the using,storing, generating and disposing of over 111 gallons of hazardous materials per month requires businesses and municipal facilities in the Town of Barnstable to obtain an annual license/permit. The Structures&Grounds Division permit for fiscal year 2004-2005 should be purchased by the division supervisor,Joe Slominski. One permit should be purchased for all facilities that fall under the Structures&Grounds Division. A permit application is enclosed with the copy of this letter mailed to Mr. Slominski. All 2004 hazardous materials inventories and inspections for Structures&Grounds facilities have been completed. Why are these recommendations being made for the Structures& Grounds Division? • This information is intended to educate you, a facility operator in the Town of Barnstable,in order to keep your division in compliance with local, state and federal toxic and hazardous materials laws so that you can avoid future regulatory,legal and possibly, financial problems. • Complying with the Control of Toxic and Hazardous Materials ordinance (Article 39)can prevent contamination of Barnstable's existing and future drinking water supply and prevent environmental contamination which can bankrupt site owners,lower or destroy land values,drive out residents and industry,depress local economies and endanger public health. Order: CEASE and DESIST all car/vehicle washiri'g,with soap,car wash detergents,degreasers or any type of"biodegradable"cleaning product. • A"Warning Notice"has been issued to his division in regards to this violation. • Vehicle bodies(top,sides,.front and back)may be rinsed off with water only. • An approved car wash system(as mentioned above)must be in place to resume regular vehicle washing at this location in the Town of Barnstable. Violation: Waste oil and waste gasoline is accepted from the public at this location for recycling/disposal. The waste oil is not used as heat for any shop onsite. Hazardous waste must be disposed of by a licensed hauler and documentation(manifests)must be made available upon request. There was no hazardous waste disposal information or documentation presented during this inspection. Order: • Please comply with the Town of Barnstable General Ordinance,Article 39: Control of Toxic and Hazardous Materials, Section 12-3 which states, "All records pertaining to storage,removal and disposal of toxic or hazardous wastes shall be retained for no less than five(5)years...and shall be made available for review by the Health Department upon request.". • Please keep either the originals or copies of hazardous waste disposal manifests at the Structures&Grounds office at 800 Pitcher's Way. • Self hauling of hazardous wastes must be documented as well to account for the proper handling and compliant disposal of chemical wastes(i.e. "Cradle to grave" responsibility). • From this point forward,please keep records of when any hazardous waste is hauled to a secondary location for disposal or use as heating oil. Please log what material was taken, the amount of the material(must be under 55 gallons per trip)to whom the material was taken,the location, and date of delivery. :r • Federal law allows hazardous waste to be self-hauled without a federal i.d.number or permit if the amount is SS gallons or less per trip. Problem: • The waste gasoline barrels and waste oil tank at this location do not specifically indicate the level of health hazard they can have. • The waste oil tank is not labeled to indicate what it contains(which is imperative when responding to an emergency in the Town of Barnstable at any location that stores/uses hazardous materials). • There were some containers found during the inventory that had no labeling to indicate what chemical product they were,their health hazard or storage requirements. • A container of unknown hazardous material and several bags of fertilizer were found cracked/tom open and leaking in the"Poison"storage shed at this location. Order: • Please label ALL hazardous material/waste containers and tanks with their health hazard (i.e. "TOXIC","FLAMMABLE",and"HAZARDOUS WASTE"). • In addition to this,the type of hazardous material/waste must be labeled on all storage containers or tanks. • Additional signs should be posted on the waste gasoline storage containment system to indicate flammability and the danger of the material stored there. • All containers used for storage and disposal.of hazardous materials should be in good condition(i.e.NO cracks,leaks,containers without caps/lids or containers without secondary containment if the hazardous material should spill or leak). Problem: • There were several observations of improper storage.of hazardous materials during this inspection. • Some of the current storage arrangements could potentially cause an accidental spill; a health hazard, or fire. Order: • Cans of flammable aerosol products are stored on a wood shelf in the main shop area. These should be relocated to the flammables storage locker. • In the"cage"area of the shop,hazardous material/chemical storage is on the top shelf (close to the low ceiling in this area). This storage location forces workers to reach up, onto a shelf and then pull a toxic or hazardous material down toward them. These chemical products should be relocated to shelves that are eye level to ensure worker safety when handling hazardous materials. • Flammable/combustible materials(paint products,thinners,floor sealants)should be relocated from the wood lined shelves to metal shelves only. Wood lining on the shelves is not safe in that it can add to the risk of combustion. Flammables should be stored in the fire proof cabinet,on metal shelves or in secondary containment tubs(i.e. Rubbermaid tubs). • Hydrochloric acid was found in two different locations in this shop. Both locations were metal shelving. This material is considered highly corrosive to steel and must not be stored on metal shelving. Please relocate all hydrochloric acid to a plastic secondary containment tub/tray and stored away from metal material. • Flammable aerosol products and acetylene (flammable gas)were stored improperly in the HVAC shed. Please relocate the flammable storage to metal shelving or a flammables cabinet. The acetylene container should be stored securely attached to an approved holding stand and the valves must be checked and also secured. • A hazardous materials storage reference sheet is enclosed with this letter. �y The Toxic and Hazardous Materials On-Site Inventory from September 8th shows that you have approximately 1,030 gallons of toxic and hazardous materials being used,stored,generated and disposed of at the Town of Barnstable Structures&Grounds shop at 800 Pitcher's Way. The Board of Health has determined that the using,storing,generating and disposing of over 111 gallons of hazardous materials per month requires businesses and municipal facilities in the Town of Barnstable to obtain an annual license/permit. We appreciate your intelligent, open-minded approach to our visit as we explained the complex law of EPCRA (Emergency Planning Community Right-to-Know Act) and its mandatory reporting requirements for municipalities and businesses. The walk through of your facility was a great help in the process of determining any hazardous materials amounts, mandatory spill response guidelines and materials storage/safety suggestions. The following bulleted lists are a summary of our site visit and conclusions for Tier II reporting for the Structures and Grounds shop and Joseph P. Kennedy Jr. Memorial Ice Arena: Town of Barnstable— Structures and Grounds Site Visit and Inventory for Tier II: • MSDS (Material Safety Data Sheets) were readily and visibly available in the break area. • The fire proof cabinets provide proper storage of flammable chemical materials. • Hazardous wastes are minimal. • Personal Protective Equipment (PPE) is available in cabinets and throughout the shop. • The staff members at the Structures and Grounds shop were very helpful and courteous during the site information visits. Recommendations for Continued EPCRA Compliance at Structures & Grounds - 800 Pitcher's Way: 1. Updated, clean copies of MSDS are strongly recommended. Storage time for MSDS forms (even if chemical use is discontinued) is ten years minimum. 2. Consider duplication of MSDS forms and store in a shop area location in case the break room MSDS forms cannot be accessed in an emergency. 3. MSDS copies in plastic sheet protectors at satellite cleaning supply closets is recommended for employees reference to health/safety/emergency information for the chemicals used in daily cleaning/maintenance operations. 4. Remove combustible materials (e.g. cardboard box for spray paint cans)from flammables cabinet and store items in a small Rubbermaid tote(s). 5. Remove any flammable/combustible chemicals from wood shelves/cabinets and store in appropriate flammables cabinets or metal shelves. ,Yr 6. Ventilation of flammables cabinets is strongly recommended. 7. Keep PPE (i.e. gloves, eye goggles, N95 face masks) in the same area as flammables cabinet and cleaning chemical storage area to improve accessibility to employees. 8. Remove any chemical products from the top of storage shelves and store at waist level, not at eye level. 9. Post"Emergency Spill Response Plan" in shop, office and break area (Example plan attached. Move 55 gallon drum of unidentified material off sand surface of outdoor lot and move indoors or onto asphalt surface (away from drains) until hazardous materials hauler can identify and remove. 12. Recommend the new/renovated shop establish a readily accessible hazardous materials spill kit or HazMat Spill Supplies Area for use in accordance with the shop's spill response plan. Follow up with HazMat staff at Barnstable County Dept. of Health & Environment to meet and formulate an emergency response communication plan in the event of a hazardous materials emergency with the ammonia tank. Conclusion: • Tier II chemical inventory and discussion was completed at the Structures & Grounds shop site and Joseph P. Kennedy Jr. Memorial Skating Rink. • After researching the chemical types, amounts/conversions found at these two sites, it can be stated by the HazMat staff at Barnstable County Department of Health & Environment that the ammonia stored at the Joseph P. Kennedy Jr. Skating Rink does warrant a Tier II Hazardous Material Facility Report in compliance with EPCRA at the present time. • Ammonia is an extremely hazardous substances (EHS) stored and used by the Town of Barnstable in an approximate amount of 2,000 pounds. This substance is eligible for Tier II reporting, as it is above the threshold reportable quantity at the present time. • Per my discussion with Steve Sundelin on August 17th, a year 2005 Tier II report should be done as a "dry run" with the current EPA software available through the EPA/Tier II Reporting website. • A 2006 Tier II Hazardous Material Facility Report for Structures & Grounds should be completed when the new reporting form is updated and issued from the EPA(after the 1 st of the year 2007). This official report must be submitted to the Barnstable County Regional Emergency Planning Committee (BCREPC) c/o Amy L. Wallace, the State Emergency Response Commission (SERC) and the local Hyannis Fire Department no later than March 1, 2007. • Instructions for submitting this report have been given to Steve Sundelin at the Structures & Grounds site visit on August 17'h. The BCDHE HazMat staff is available at your convenience to assist with any questions or guidance on this reporting form. • Recommendations for EPCRA compliance were discussed in terms of Structures & Grounds staff information/basic training.
