I am in receipt of your letter dated November 25, 2014 with attached photographs, which were received here at 200 Main Street on December 4, 2014. Please be advised that the photographs which you sent to us are outdated. Most of the reusable items depicted in the photograph you submitted were screened from public view or removed when I visited the property on November 25, 2014. There were no rubbish or garbage bags at this property. Also there was no evidence of any leakage of hazardous wastes nor the existence of any items that were leaking toxic materials. Health Inspector James Parziale, R.S. issued the property owner a $100.00 non-criminal ticket citation on November 24, 2014 due to the property owner's failure to screen receptacles and plumbing fixtures from public view. I then visited the property at 3:00 p.m. on November 25`" and later telephoned you to let you know that the rubbish barrels were screened from public view. Also, most of the other reusable-items were also screened from public view on that date. The wheel barrow, log splitter and firewood are exempt. According to the recently adopted Town Ordinance (Chapter 54), the property owner has six months to screen all other items. J The Health Division staff will re-visit the site and will monitor this situation on a regular ` basis as well as take appropriate enforcement.,action against the property owner when/if a health violation is observed. is y, U McKean, C.H.O. The town Councilors' office suggested we put together a summary of what has been happening at the property over the last 2 years so we would all have the same understanding of it. .max We appreciate all that you have done so far. This situation has affected the real estate value of our property and the use of our home. You have to realize that what you see in the attached photos is the only view from our home. Who would like this across from their home? I Summary: Health Department records show that beginning 2013 regular phone calls regarding neighborhood concerns that the residence at 20 Sunset Terrace Hyannis has violated health department regulations. The residential property is regularly used as a storage and transfer station for old and new commercial heating/cooling equipment and debris from.a business conducted onsite. Items include: furnaces, hot water heaters, commercial A/C units, 250 gallon oil tanks, metal pipes/cement,stacks of PVC pipe, motors, large metal sheeting used to fashion system piping onsite, as well as other items. Items are stored from the street edge to the back property line and then across the side of the front lawn. The area is zoned residential. (Please see photos attached) i Additionally,several rubbish barrels are always located in the front of the house and are the only view we.have from our front living room window. And 2 unregistered vehicles. ( enclosed photos.) All material is stored outside, near and visible from the street,which as you let us know is in direct violation of the Town Ordinances: * Chapter 54-3 regulating outdoor storage......personal property shall be kept within enclosed structures or screened from public view." * Chapter 54-5 Storage and removal of rubbish, garbage and refuse, Section C: "Receptacles shall be located in such a manner... to provide maximum screening from the street,..may be placed in the open near a street within 24 hours of scheduled collection and disposal by a contractor.......and returned to a screened location within 24 hours thereafter." * Chapter 54-2 Compliance with other town and state regulations(water supply protection, solid waste) The chemicals that may leak from these old units could contaminate the 4 nearby groundwater wells used for town drinking water. The attached map shows this residential property is within the protective zone for these town wells and very close to them. Once chemicals enter the groundwater during storms it is not possible to retrieve them and it only takes a very.small amount to affect the drinking water. Sand and gravel at the Cape percolates and transfers chemicals at a very rapid rate. Since this is a residential area it does not have the safeguards for collecting runoff requiredj'.i F ideOf al d s jr- stormwater permits in commercially zoned areas. This neighborhood is posted with town signs re: protection of the water supply. (photo attached) Y V We have spoken with one of your health agents.lim Parziale a number of times and he seems like a very nice young man however, at this point perhaps another health inspector with more experience would have the ability to resolve this situation which has continued for 2 years. For the last 2 years we have not been able to open the window shades that look out into our front yard due to the landfill view. A sheet metal business has been conducted on the property and a record of an electrical house fire from this type of work being conducted inside the house required the fire department and electric company to respond during the middle of the night a couple of months ago with the electrical company replacing the entire electrical line going into the house from the pole after it had caught on fire. This is a highly dangerous situation using commercial torches on residential property to fashion sheet metal. Jim's record notes from 2013 continually downplay the magnitude of this situation on what is regularly stored there and refers to it only as trash and one or two items, not as multiple and diverse commercial items from a business.,Our photos of the residential property for this entire period show commercial heating and cooling items, constructions debris, as well as trash. New items are delivered and the old materials ripped out of the buildings being worked on are stored at the property sometimes for weeks at a time. This is a residentially zoned area in a drinking water protected area. Jim mentioned he had spoken to someone at the house but was unclear on who it was and it has taken nearly 2 years for a violation to be issued. When you and I spoke at the town hall a few weeks ago you were surprised that this situation had not been brought to your attention given the length of time it was going on and we thank you for prompting action on this. It has been very difficult to reach Jim during the office hours listed on his business card and he has had little time to talk on the phone so we appreciate your assistance. This situation has affected the real estate value of our property and the use and enjoyment of our home. We know from speaking with you directly that you feel this situation has gone on way too long and should be resolved for health and safety reasons, and we all agree that this situation is just wrong on a number of levels. We appreciate all that you have done to work towards resolving this issue. At our age and a year from retirement this is a lot for us to be doing. So all of us playing phone tag. The letter you attached was a letter that went out to the resident at 19 Sunset. The woman at 20 Sunset was complaining about their trash etc. She also admitted to our staff of which we have three witnesses, that she was attempting to rent out 20 Sunset and couldn't because of the trash at 19 Sunset. We have spoken to 19 Sunset and the location is now cleaned up minus the exempt items. 20 Sunset also got our standard letter when we discover that they are renting out or attempting to rent out a property. I guess she is upset that she got that letter due to her complaint on her neighbor. Of course we have to follow through on any information we receive. Fire and Police onsite because Mr. Ricci called stating that his neighbor installed a new fence over a gas line and hit the gas line and he smelled gas. Gas odors were not observed on the property. Mr. Ricci then began to complain that the Kuboto tractor in his backyard is now stuck there and he cannot get it out. DS asked Mr. Ricci about how the cesspool collapsed when he was mowing the lawn and he stated he was not mowing the lawn. He stated that he drove the Kuboto tractor over the cesspool a while back(he was unsure but thought it was several weeks ago)and the cesspool collapsed. He stated that the cesspool he collapsed was his neighbors and it was located on his property. DS reviewed the recent engineered plans for the septic system at Mr. Ricci's house and it appears that his retaining wall was going to be located 1.5'off the property line. The neighbors new fence appeared to be approximately 1.5' of the property line as well (approximately 3' between the wall and the fence. Posted signs placed on fence. Mr. Ricci continued to complain about the fence blocking his access to get the tractor out of his backyard. The neighbor(#20 Sunset)was not home. She is aware of the collapsed cesspool as a septic installer contacted the Health Division several weeks ago about the collapsed cesspool. It was explained to him that several of the people onsite from the Town were not"from the Cape" Mr. Ricci then stated that he was from "Leominister", to which one of the police officers stated he was from "Leominster"as well. He continued to think there was a problem with the gas line and the fence. He was told he could contact the gas company as well as the building department if he had any further issues. He was also told he has the right to hire an attorney as this appears to be a civil dispute over the property line and the damaging of the cesspool. DS consulted TM to which we will do a letter to the owner of# 20 Sunset Ave to correct the violation of a collapsed cesspool. DS will type up a letter when he gets time.
