While at your unit they saw through a window enough evidence that they have condemned the unit. The last time your unit was condemned I spent a significant amount of time (over a year) attempting to get in touch with you. After these lengthy attempts the association was forced to clean out the unit, at significant cost to yourself. The Association can not allow this unit to remain condemned again for over a year. My understanding is that you are not living in this unit but currently using it as "storage". It is not permissible under the Rules and Regulations of Cape Cod Melody Village to use your unit in that manner. Furthermore, it is against the Rules and Regulations to keep your unit in any condition other than a clean and sanitary one. Finally, it is not permissible to change the locks on your unit without providing the Association with a key. If we do not hear from you by Monday, July 2, 2018 regarding this very important matter we will begin fining your unit$10 a day for each violation to the Rules and Regulations. I am particularly concerned about your unit as Cape Cod Melody Village experienced a drainage issue this winter and every unit on your side of the property flooded. At the time we had professional services come and pump water out of the basements, but as I did not have access to your unit and no reliable contact information I was unable to do so for unit 24. If your basement has flooded, which I am sure it has, and you have been storing property down there it is most definitely wet and moldy which poses a serious health risk to you and your neighbors. I am also concerned as the last time we cleaned this unit out we found evidence of rats in the unit and there has been increased rat activity on the property lately. While I'm sure you would like to be able to clean and get your unit un-condemned yourself it is likely that you will need professional help. I have a new clean up man, Dennis of Helping Hands, that could be of service to you. His phone number is 774-408-0358. 9• As I've stated previously the Association cannot allow the unit to remain in this condition. If you do not contact me and show demonstrable progress to solving this problem within thirty days the Association will be forced to take-action and clean out your unit so that it is not in this condition. We have heard through Lisa Dower that you intend to clean and get the condemnation of the unit lifted on your own. While the Board appreciates this is your right, they are concerned that you will not be able to accomplish this task without professional help. As I said in my previous letter you are currently in violation of three Rules and Regulations from the Cape Cod Melody Village Restrictive Covenants. You are keeping your unit not in a clean and sanitary manner, you are using your unit in a manner other than as a private residence, and you have changed the locks without providing the association a key. If these violations are not cured by 7/26/2018 the Association will begin charging your unit $30 a day until the violations are proven cured. As I said in my previous letter I have a new clean up company that would be able to help you with this issue for a rate less than that of the last clean up. If you can prove to the Board that you are going to use a professional company to rectify this situation in a complete and timely manner than they will lift the charges on the unit. Miorandi, RS, Health Inspector for the Town of Barnstable, was called out on June 23, 2018,by Hyannis Fire Department,to respond to 110 West Main Street, Unit#24, Hyannis,Massachusetts due to a complaint of a smoke detector battery chirping continuously and allegedly a rat seen in the window. It was observed through the window piles of garbage bags. It has obviously been restored to the status.of May 15, 2014 when it was previously condemned. The owner's name in this dwelling is Sriruen Chunephisal. Based on the results of that inspection, the Barnstable Health Department finds that the dwelling is unfit for human habitation. Pursuant to M.G.L. c. 127B and 105 CMR 410.831 (D),the Health Department further finds that the conditions within the dwelling are such that the danger to the life or health of the occupants of the subject dwelling is so. immediate that no delay may be permitted in making this finding. O'Connell RS, Health Inspecfor for the Town of Barnstable, on May 15, 2014, conducted an inspection of the'dwelling located at 110 West Main Street, Unit#24 Massachusetts. The owner's name in this dwelling is Sriruen Chunephisal. Based on the results of that inspection, the Barnstable Health Department finds that the dwelling is unfit for human habitation. Pursuant to M.G.L. c. 127B and 105 CMR 410.831 (D), the Health Department further finds that the conditions within the dwelling are such that the danger to the life or health of the occupants of the subject dwelling is so immediate.that no delay may be permitted in making this finding. Conditions found within the dwelling, which give rise to the emergency finding of unfitness and determination of immediate danger, include: 410. 450: Means of Egress 410. 451: Egress Obstruction t 410. 452: Safe Conditions _ S 410. 750(G): Conditions Deemed to Endanger or Impair Health or Safety Large piles of personal belongings were observed stacked up in the apartment completely:blocking egress and passageways. Front and only door to dwelling could only be opened roughly one foot and led only to a wall of stacked up belongings. Based upon these findings any and all occupants are hereby ordered to vacate and the landlord/owner is ordered to secure the subject dwelling within 48 hours of receipt of this order. If any person refuses to leave a dwelling or portion thereof, which was ordered vacated she may be forcibly removed by the local Board of Health (Massachusetts General Laws C. 127B), or by local police authorities at request of the Board of Health. Furthermore, anyone who fails to comply with any order of the board of health may be subject to fines ranging from $104500. Each day's failure to comply with an order shall constitute a separate violation. Once vacated this unit may not be occupied without the written approval of the Board of Health. , Note: This is an important legal document. It may affect your rights. O'Connell RS, Health Inspector for the Town of Barnstable, on May 15, 2014, conducted an inspection of the dwelling located at 110 West Main Street, Unit#24 Massachusetts. The owner's name in this dwelling is Sriruen Chunephisal. Based on the results of that inspection, the Barnstable Health Department finds that. the dwelling is unfit for human habitation. Pursuant to M.G.L. c. 127B and 105 CMR 410.831 (D), the Health Department further finds that the conditions within the dwelling are such that the danger to the life or health of the occupants of the subject dwelling is so immediate that no delay may be permitted in making this finding. Furthermore, anyone who fails to comply with any order of the board of health may be subject to fines ranging from $10-$500.
