Ambient weather conditions were cloudy with strong winds from the north/northwest; it was not raining at the time. The paint spray booth is equipped with inlet filters and a heater and two series of exhaust filters. The paint spray exhaust system terminates at two stacks located on the roof of the building. There was no evidence of paint overspray on the exhaust stacks. In coordination with John Trotto, I witnessed the mixing of a clear coat(Glasurit 923460 Multipurpose Gloss, 929-94 Hardener and 352-91 Reducer) and its application to the entire body of a car in the paint spray booth. Once spraying had begun John and I.walked the perimeter of the property in the attempt to detect an odor. A slight, inconsistent odor was detected at the property line to the south (See attach photo with notes). While standing in the parking lot adjacent to 15 Aldeas Avenue for a period of five minutes no odor was detected: The initial clear coat spray job lasted approximately twenty minutes, followed by a ten to fifteen minute drying period and a second, twenty minute application of clear coat. John Trotto stated that there has been no change in coatings, filters or daily operations in years. John Trotto has agreed to coordinate another site visit and spray job on November 20, 2012. The Facility was storing a hazardous waste,waste paint and solvent,in a drum in the spray booth area that was not labeled in violation of 310 CMR 30.351(8)(a). ACTION(S)TO BE TAKEN AND THE DEADLINE FOR TAKING SUCH ACTION(S): The following action(s)to be taken have individual deadlines associated with them. The Facility shall take the necessary steps to correct the violations within the specified deadlines as noted and shall return to compliance with the requirements described below. Hyannis Auto Inc., dba Hyannis Collision located at 478 West Main Street is a Massachusetts Corporation in Hyannis, Massachusetts, herein referred to as "Hyannis Collision." II. STATEMENT OF LAW AND REGULATION 1. The Department is charged with the implementation and enforcement of the Massachusetts Hazardous Waste Regulations as contained in 310 CMR 30.000, adopted under the provisions of Sections 4, 6 and 9 of Chapter 21C and the Massachusetts Air Pollution Control Regulations as contained in 310 CMR 7.00, adopted pursuant to the authority of Massachusetts General Law Chapter 111, §§142A-E and J, and c.21C, §§4 and 6 as applicable. 2. The Department is authorized to assess Civil Administrative Penalties by M.G.L. c.21A, §16 and regulations at 310 CMR 5.00. 3. Unless otherwise stated herein, the terms used in this Consent Order are defined pursuant to the regulations codified at 310 CMR 30.000, 310 CMR 7.00, 310 CMR 5.00 and 310 CMR 4.00. III. STATEMENT OF FACTS 1. Hyannis Collision is an auto body facility that conducts repairs and finishing of automobiles. 2. On April 1, 2005, Department personnel conducted Multi-Media inspection of Hyannis Collision at their 478 West Main Street facility. The purpose of this inspection was to determine the status of the Hyannis Collision relative to compliance with the Massachusetts Air Pollution Control Regulations, -2- set forth at 310 CMR 7.00, the Massachusetts Hazardous Waste Regulations set forth at 310 CMR 30.000,the Massachusetts Toxic Use Reduction Regulations set forth at 310 CMR 50.00, and the Division of Water Pollution Control Regulations set forth at 314 CMR 1.00-12.00. 3. A review of the hazardous waste manifests from 2001 to December 2004 revealed that Hyannis Collision has been generating Small Quantity Generator (SQG) amounts of Hazardous Waste using EPA Id. #MAD982546491. A review of the RCRA Information data base reveals that Hyannis Collision EPA Id. #MAD982546491 was changed from a "Small Quantity Generator to Not A Generator"in 1990 with no explanation.for the change. 4. Hyannis Collision failed to register with the Department as a generator of Hazardous Waste. This constitutes a condition of noncompliance with 310 CMR 30.061. 5. Hyannis Collision avoided paying Annual Compliance Fees (ACFS) applicable to a Hazardous Waste generator of Small Quantity Generator amounts, pursuant to 310 CMR 4.03 (2) Annual Compliance Assurance Fees. As a result, Hyannis Collision realized an unfair economic advantage by avoiding these Annual Compliance Fees (ACFS) in the amount of$525.00 per year for two years. 6. Hyannis Collision failed to comply with the requirements governing emergency procedures,prevention, and response. Specifically, the facility did not have an up-to-date list posted next to each telephone at the site of generation throughout the facility. This constitutes conditions of noncompliance with 310 CMR 30.351(9)(c)(6) at the facility. 7. Hyannis Collision failed to conduct weekly inspections of the hazardous waste accumulation area. This constitutes conditions of noncompliance with 310 CMR 30:686 at the facility. 8. Hyannis Collision failed to post a sign in the hazardous waste storage area with the words "HAZARDOUS WASTE". This constitutes a condition of noncompliance with 310 CMR 30.341(4) at the facility. 9. Hyannis Collision failed to clearly mark (clearly visible line or piece of tape on the floor) the hazardous waste accumulation area. This constitutes a condition of noncompliance with 310 CMR 30.341(5) at the facility. 10. Hyannis Collision was not maintaining records of the volatile organic compound(VOC) emissions from the paint spray booth for the year 2004 in violation of 310 CMR 7.02(2)(e). -3- 11. Hyannis Collision on May 11,2005, submitted by fax a copy of their air quality recordkeeping for the spray booth for the year 2004 as required by 310 CMR 7.02(2)(e). IV. DISPOSITION 1. As a result of communications between the Department and Hyannis Collision and without adjudication of any fact or law set forth above, the Parties have agreed to this Consent Order rather than expending the time and resources necessary to adjudicate this matter. 2. This Consent Order is issued by the Department pursuant to its authority under Massachusetts General Laws, Chapter 21A, Chapter 2 1 C and Chapter 111 as applicable. 3. Hyannis Collision assents to the authority of the Department to issue this Consent Order and waives its rights to further administrative or judicial review of this Consent Order. Hyannis Collision reserves their rights to challenge any requirements imposed by the Department beyond those set forth in this Consent Order. 4. This Consent Order is not an admission of liability or a waiver of defenses, which Hyannis Collision might raise in any proceeding to enforce this Consent Order. 5. This Consent Order is also a Notice of Noncompliance, issued pursuant to M.G.L. Chapter 21A, Section 16 and the regulations promulgated thereunder at 310 CMR 5.00. 7. The Department hereby determines, and Hyannis Collision thereby agrees, that the deadlines set forth above in this Consent Order constitute reasonable times to perform the acts expressly agreed to in this Consent Order and that the activities required pursuant to this Consent Order otherwise meet requirements of 310 CMR 30.000 and 310 CMR 7.00. 8. The activities required pursuant to this Consent Order are subject to approval by the Department and shall comply with all other applicable federal, state and local laws. -4- 9. This Consent Order shall apply to and be binding upon Hyannis Collision and their respective successors, heirs and assigns. No change in property ownership will alter in any way the responsibility of Hyannis Collision under this Consent Order. A signed copy of this Consent Order shall be provided to any successor, heir or assign of the Hyannis Collision. 10. Any extensions to the performance dates in this Administrative Consent Order must be approved by the Department,in writing. 11. Hyannis Collision shall not violate this Consent Order and shall not allow its successors, heirs, agents, or contractors to violate this Consent Order. V. ORDER 1. Within one (1) day of Hyannis Collision reactivating their Hazardous Waste Generator Identification number from the Department, Hyannis Collision shall ensure that only the assigned number is used on future manifests. 2. Within one (1) day of the effective date of this Order, Hyannis Collision shall begin conducting weekly inspections in the areas where hazardous waste containers are accumulated. 3. Within five (5) days of the effective date of this Order, Hyannis Collision shall ensure the following up-to-date information is posted next to each telephone: a. The name(s) and telephone number(s)of the emergency coordinator; b. The location(s) of the fire extinguisher(s) and spill control material(s), and if present,the fire alarms; c. The telephone number of the fire department, or, if there is a direct alarm system, instruction on how to activate it, or both; and d. Evacuation routes,where applicable. 4. Within five (5) days of the effective date of this Order, Hyannis Collision shall post a sign in the hazardous waste accumulation area with the words "HAZARDOUS WASTE" in capital letters at least one inch high. 5. Within five (5) days of the effective date of this Order, Hyannis Collision shall ensure that all areas where hazardous waste is accumulated are clearly marked (e.g. visible line, piece of tape on the floor). -5- 6. Within ten (10) days of the effective date of this Order, Hyannis Collision shall accurately complete the attached Notification of Hazardous Waste Activity in Massachusetts application form to reactivate their EPA Id. #MAD982546491 as a Small Quantity Generator of Hazardous Waste with the Department. VI. PENALTIES 1. In resolution of this matter, the Department assesses a total Civil Administrative Penalty in the amount of One Thousand and Fifty dollars ($1,050). Hyannis Collision agrees to pay to the ,Commonwealth, pursuant to Chapter 21A, Section 16, $1,050, for the violations set forth in Section III above, within thirty (30) days of the Effective Date of this Consent Order. Payment must be made by certified check, cashier's check, or money order, payable to the Commonwealth of Massachusetts. No other form of payment shall be accepted. 2. The name "Hyannis Collision " the document file number ACOP-SE-05-9012-2, and your Federal Employer Identification Number (FEIN), shall be printed clearly on the face of the certified check, cashier's check, or money order. STIPULATED PENALTIES: Hyannis Collision shall pay to the Department stipulated penalties in the amount of$1,000.00 per day for each day of each violation which extends beyond the compliance deadlines specified herein.
