This letter contains information from that visit that will help you become compliant and remain compliant with Chapter 108 of the Town of Barnstable Ordinance: Hazardous Materials. Enclosed are copies of the Code, Chapter 108: Hazardous Materials, and the Toxic and Hazardous Materials On-Site Inventory form from the site visit. Please note the observations identified at your place of business during the hazardous materials inspection listed below. OBSERVATIONS: • MSDS are on site. • Parts washer lid was open when not in use. Please provide training for the staff to keep the lid closed when not in use. • Ensure all waste storage containers are visibly labeled. One drum of antifreeze did not clearly show the label of its contents. • Metal cans with lids available for soiled rags. • Metal can with lid available for soiled mats/pigs. • Rags are being used to absorb spills and releases on the tops of oil and antifreeze drums. Please use absorbent mats(by cutting into a circular shape to match the tops of the drums)to allow the mats to absorb the spills. This provides an easier clean up and less likely for the spill or release to reach the ground. • Ensure buckets and catch pans of waste petroleum products are disposed of in the proper location immediately after collecting. • Eyewash station is in place and in working order. • Hazardous Materials Permit for fiscal year 2006-2007 has been obtained. All owners/operators of facilities with floor drains connected into a leaching structure have three options: 1. Connect the floor drain to a holding tank. The tank will need DEP approval. The DEP approves two types of holding tanks for this waste: new installations and conversions of existing structures (e.g. oil/water separators). These tanks are for non-hazardous, industrial wastewater. If solvents, antifreeze, oil and other fluids are washed down the drain,the waste is likely to be hazardous, 2. Connect the floor drain to a municipal sewer system, if available. Ala oil/water separator is required to be installed under this option. This requires a permit from DEP and the Town of Barnstable Department of Public Works along with the sewer connection application. The amount of discharge shall not exceed ten parts per million(10 PPM). 3. Seal the floor drain. Contact your local plumbing inspector for the appropriate filing form. If choosing this option, all previous discharges to the drain must be eliminated at their source. For example, cars should no longer be washed and floors should no longer be hosed down. Therefore, you are directed to comply with the .Board of Health Floor Drain Regulations by informing this department in writing of what your intentions are to comply with the regulation within ten (10) days of receipt of this notice and by completing the work within ninety (90) days. You may request a hearing if written petition requesting same is received within ten (10)days a e your receipt of this order letter. Failure to comply with an order of the Board of Health may result in a fee of not less than $200, nor more than $1,000.00. All owners/operators of facilities with floor drains connected into a leaching structure have three options: 1. Connect the floor drain to a holding tank. The tank will need DEP approval. The DEP approves two types of holding tanks for this waste: new installations and conversions of existing structures (e.g. oil/water separators). These tanks are for non-hazardous, industrial wastewater. If solvents, antifreeze, oil and other fluids are washed down the drain,the waste is likely to be hazardous. 2. Connect the floor drain to a municipal sewer system, if available. An oil/water separator is required to be installed under this option. This requires a permit from DEP and the Town of Barnstable Department of Public Works along with the sewer connection application. The amount of discharge shall not exceed ten parts per million(10 PPM). 3. Seal the floor drain. Contact your local plumbing inspector for the appropriate filing form. If choosing this option, all previous discharges to the drain must be eliminated at their source. For example, cars should no longer be washed and floors should no longer be hosed down. Therefore, you are directed to comply with the Board of Health Floor Drain Regulations by informing this department in writing of what your intentions are to comply with the regulation within ten (10) days of receipt of this notice and by completing the work within ninety (90) days. You may request a hearing if written petition requesting same is received within ten(10)days C/ your receipt of this order letter. This letter contains information from that visit that will help you, as a business owner/manager,become compliant with hazardous waste regulations. Enclosed are copies of Article 39: Control of Toxic and Hazardous Materials ordinance and a copy of the Toxic and Hazardous Materials On-Site Inventory form from the visit to your shop. Please note the problems identified at your place of business during the hazardous materials inspection and their corresponding recommendations listed below: PROBLEM: • You are in violation of Section 9-1 of Article 39: Control of Toxic and Hazardous Materials,which states, "The release of any hazardous materials and/or acutely hazardous materials upon the ground,or into any surface...within the Town of Barnstable,is prohibited." • Motor oil was observed on the floor(a 2' x 3' puddle)under the waste oil tank with no absorbent,spill pallet,or catchment pan to contain this release. • Approximately ten uncovered/uncapped containers of hazardous materials were observed on benches and on the floor of your shop. • A waste antifreeze puddle was observed on the top of the HW storage barrel. ORDER: • Section 5-2 of Article 39 states,"Provisions shall be made to contain the product(i.e. hazardous materials)in the case of an accidental release." • Starting immediately, advise your staff to use caution and consistently use proper spill containment pans/trays; absorbent pads or Speedy Dry under all hazardous material storage tanks when hazardous materials are transferred into them. • Do not allow access to any hazardous material or hazardous waste tanks/barrels to be cluttered with shop equipment,empty bottles, etc. Cluttered areas around hazardous materials storage areas increase the potential for an accident/spill. • Please advise your staff to cap/contain all hazardous material storage containers after draining hazmat from vehicles and preparing/storing hazmat(i.e.windshield washer fluid)to be put into vehicles. • Please clean the tops of the waste antifreeze barrels. Do not allow puddles of antifreeze to accumulate on these waste storage containers. Spills or releases of Antifreeze must be controlled because it is especially toxic and can cause irreversible health problems or death. • Absorbent materials used to soak up oil and antifreeze should be cleaned off the shop floor and disposed of as hazardous waste. • DO NOT use soap and water to clean spills of hazardous materials off your shop floor unless the waste water is going to be disposed of as hazardous waste. PROBLEM: • The Town of Barnstable requires all businesses to register their hazardous materials and to submit a contingency plan prior to obtaining their Hazardous Materials Storage and Handling Permit(TOB General Ordinance,Article 39, Sect. 6-5,A,B,C,D,E). ORDER: • Please design and submit an Emergency Contingency Plan for spill preparedness and response within the next 30 days. This plan should be posted and visible in your shop and office areas. PROBLEM. • There are two fire extinguishers in your vehicle washing shop area that need to be serviced. • Shop rags were observed on the floor or on work benches in 11 different locations. • No metal shop rag can was observed in the shop or in use. • Cigarette butts and ashes were observed in and around trash barrels of two of your shop work stations. RECOMMENDATION: • Please service these fire extinguishers as soon as possible. • Please obtain and use metal shop rag cans with metal lids. • All shop rags that contain petroleum and hazardous material residue are considered potentially flammable and need to be contained in a shop rag can and emptied daily. • Smoking should not be taking place in your shop area,where hazardous materials and flammable chemical products are in use throughout the day. On Site Inventory Total The Toxic and Hazardous Materials On-Site Inventory from August 20,2004 shows that you have approximately 4,814 gallons of toxic and hazardous materials being used, stored,generated and disposed of at Hyannis Honda(Please see enclosed Toxic and Hazardous Materials On Site Inventory sheet). The Board of Health has determined that the using,storing, generating and disposing of over 111 gallons of hazardous materials per month requires businesses in the Town of Barnstable to obtain Y an annual Hazardous Materials License. This license should be purchased within the next 30 days from the Town of Barnstable Town Offices, 200 Main Street,Hyannis,MA 02601 (application enclosed). Why are these recommendations being made for Hyannis Honda? • This information is intended to educate you, a business owner/operator in the Town of Barnstable,in order to keep your business operations in compliance with local,state and federal toxic and hazardous materials laws so that you can avoid future regulatory problems. • Complying with the Control of Toxic and Hazardous Materials ordinance(Article 39)can prevent contamination of Barnstable's existing and future drinking water supply,prevent environmental contamination which can bankrupt site owners,lower or destroy land values, drive out residents and industry,depress local economies and endanger public health.
