sewage disposal system at 299 Eel River Road, Osterville.
The following variance was granted:
Section 360-1 of the Town of Barnstable Code::. To install a soil absorption
system and reserve area less than 100 feet away from a coastal bank.
This variance is granted because the physical constraints at the site severely restrict the
location of the septic system components due to wetlands in the area.

For septic system variance requests, each of five packets must include:
1) Variance Request Form,
2) Letter for the Board with further information on the reason for the septic
variance request (Optional),
3) MA DEP Approval letters for proposed Innovative Alternative (I/A) septic
system or a proposed secondary treatment unit (S.T.U.)
4) Engineering plans,
5) Floor plans.
In additional to the five septic packets above, include one copy of the seven (7) page checklist,
the authorization letter, copy of abutters notice, and fee, if applicable (see checklist below).
Please send one electronic submission using a PDF or .jpg of the engineering plan and floor
plans to email: healtha-town.barnstable.ma.us. (Total email must be less than 10 megabytes.)
For grease trap variance requests, each of five packets must also include a full menu. (see
checklist-below).

SEPTIC VARIANCE REQUEST
For

299 Eel River Road, Osterville '

The project site is located at 299 Eel River Road in Osterville. The property is a l+ acre
parcel of land divided in 1967 and purchased by die current family owners in 1977. '
Septic permits were previously granted but not constructed for similar.septic systems on
dhis site in 2002, 2014, and renewed 2017.
In 2014 FEMA updated die 100 year Flood Zone Maps for die Town of Barnstable and
raised die dieoretical 100 year flood elevation from 11 (NGVD) to 12 (NAVD). Following die
topography of die landform, this increase in die dieoretical flood elevation shifted die limit of
Conservation jurisdiction 10 - 15' landward towards Eel River Road.
A new Order of Conditions for proposed development of a single-family dwelling was
issued by die Town of Barnstable Conservation Commission in June 2020. -The approval was
appealed to die Department of Environmental Protection by abutters, and a Superseding Order of
Conditions was issued by die Department in March 2021 Affirming die approval.
Due to die landward shift of Conservation jurisdiction resulting from die dieoretical 100
year flood mapping, a variance from Town of Barnstable Board of Healdi Regulation 360-1 (100'
setback) is now required for die system.
Tlhis State Defined Coastal Bank is non-eroding, not seaward facing, and not immediately
landward of anodier coastal wedand. The proposed SAS requires no State variances, is located
approximately 250' from die Town Defined Coastal Bank/actual shoreline, and more than
adequately protects die public healdh, safety,welfare, and the environment.
