FARRINGTON, also known as EDNA MURRAY FARRINGTON, is the owner of the real estate located at 50 Fire Station Road, Barnstable (Osterville),-Barnstable County, Massachusetts (hereinafter referred to as "Premises"), and more particularly bounded and described on Exhibit"A" attached hereto; and WHEREAS, Edna M. If that portion of the Premises shown as Lot A on Land Court Plan 15055-B ("Lot "A") is transferred into ownership separate from that of Lot C-1 on Land Court Plan 15055-C ("Lot C-1") or Lot 9 on Land Court Plan 15005-H ("Lot 9") or Lot A is reconfigured such that the septic system will then be located on a lot that is in ownership separate from Lot C-1 or Lot 9, the then owner of Lot A(or the owner of a lot that derives from Lot A on which the septic { system is located) shall grant an easement to maintain the septic system on Lot A for the benefit of Lot C-1 and Lot 9 unless there is proof that the septic system can be maintained as a matter of right on Lot A or the residence on Lot C-1 is connected to Town sewer. This restriction shall continue in full force and effect until such time that the Premises is connected to Town sewer and there is no regulation in effect at the time of said connection that limits the number of bedrooms to those existing at the time of the connection or the construction or expansion of a residence with greater than four (4) bedrooms is allowed as of right under local, regional and state law, at which time this Restriction will become null and void. The Town of Barnstable may extend this Restriction for additional periods of twenty (20) years from time to time in accordance with the provisions of Chapter 184, §27 of the General Laws, provided that the notice of restriction is recorded prior to the expiration of thirty years from the recording of this Restriction.
