NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.000, STATE SANITARY
CODE II — MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
AND THE TOWN OF BARNSTABLE CODE CHAPTER 170.
The property owned by you located at 879 Main Street Osterville, was inspected
on July 2, 2007 by Timothy O'Connell, Health Inspector for the Town of Barnstable.
This inspection was conducted on the basis of the rental registration in accordance with
Chapter 170 of the Town of Barnstable Code.
The following violations of the Town of Barnstable Code were observed:
1� 70-10—Smoke Detectors and Carbon Monoxide Alarms. No carbon monoxide
alarms provided.
You are directed to correct the violations listed above within twenty-four (24) hours
of your receipt of this notice by installing CO alarms on every habitable level within
ten (101) feet of bedrooms in accordance with Mass State Fire Codes.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten (10) days after the date the order is served.
Non-compliance will result in a fine of $100.00 per violation. Each day's failure to
comply with an order shall constitute'a separate violation.

Dear Mr. Sullivan:
You are granted variances, on behalf of your client TD Realty Trust, to install an
onsite sewage disposal system at 877 Main Street, Osterville.
The variances granted are as follows:
310. CMR 15.211(1): To install a leaching field only two (2) feet'away from
a property line in lieu of the minimum ten (10) feet
setback required.
310 CMR 15.211(1): To install a leaching field 13.3 feet away from a cellar
wall in lieu of the minimum twenty (20) feet setback
required.
310 CM 15.211(1): To install a septic tank nine (9) feet away from the
cellar wall in lieu of the minimum ten (10) feet setback
required.
B.O.H. Nuisance Control Regulation: To install a dumpster only one (1) foot
away from the property line in lieu of the
minimum ten (10) feet setback required.

These variances are granted with the following conditions:
(1) Food preparation is prohibited at this site. If food preparation is proposed
in the future, the applicant is aware of the requirement for a minimum
1,000 gallon underground grease trap.
(2) No more than one (1) bedroom is authorized at the second floor
apartment. Dens, study rooms, sleeping lofts and similar-type rooms are
considered "bedrooms" according to MA Department of Environmental
Protection.
(3) The designing engineer shall supervise the construction of the onsite
sewage disposal system and shall certify in writing to the Board of Health
that the system was installed in strict accordance with the submitted plans
dated July 8, 2000.
These variances are granted because the designing engineer demonstrated that
the proposed onsite sewage disposal system meets the maximum feasible
compliance standards contained in the Title V, the State Environmental Code.
