Such presumption may be rebutted by a preponderance of the evidence. 11) Pursuant to M.G.L. c. 2.1E; § 11, in addition to costs incurred by the Commonwealth for the investigation, assessment, containment.and removal of a release or,threat of release of oil or hazardous material, any person who violates any provision of M.G.L. c.'21E, or any order or regulation issued or adopted thereunder: (a) shall be subject to a civil penalty not to exceed twenty- five thousand dollars for each such violation; or (b) shall be punished by a fine of not more than twenty-five thousand dollars,.or by imprisonment for not more than two years in a house of correction,or both,for each such violation. 12) Pertinent provision(s)of the Massachusetts Contingency Plan are as follows:' 310 CMR 40.001.0 Effect of Orders and Appeals The issuance of an order under M.G.L. c.21E, §§ 9 or 10, or.any appeal of an order issued under M.G.L. c. 21E, § 9, shall not prevent MassDEP from issuing any future order(s)or from taking any other action authorized by law, including,but not limited to,taking or arranging for one or more response actions at the disposal site which is the subject of the order or appeal. 310 CMR 40.0560(2) Response Action Deadlines , Except as provided by 310 CMR 40.0530(6), 310 CMR 40.0560(3),or 310 CMR 40.0000 or as otherwise ordered or agreed to in writing by the Department,an RP,PRP or Other Person undertaking response actions at a Tier II disposal site shall submit the following documents to the Department by the following deadlines: (a)a scope of work for a Phase II-Comprehensive Site Assessment pursuant to 310 CMR 40.0834 prior to the implementation of Phase II field work,unless the Phase II field work had been implemented prior to Tier Classification; • e 3 Unilateral Administrative Order Page UAO-SE-08-3T-008 (b)a Phase II Report,and,if applicable,a Phase III ' Remedial Action Plan,within two years of the effective date of Tier Classification; (c)a Phase IV Remedy Implementation Plan within three years of the effective date of Tier Classification; and (d).a Response Action Outcome Statement pursuant to 310 CMR 40.1000 within five years of the effective date of Tier Classification. 13) All terms contained in this Order that are defined in M.G.L. c. 21E and/or the MCP shall have the meaning given to them in M.G.L.c.2 1 E and/or the MCP. IV.STATEMENT OF FACTS 14) For purposes of this Order,the"Site" includes an area on and around 792 Main Street, Barnstable, Massachusetts and all other areas where oil and/or hazardous materials emanating from property have come to be located: 15) The Site was effectively Tier Classified in August of 2000. Dunhill had previously filed a Tier II Classification for the Site; however, at that time,MassDEP was evaluating the potential for the Site to be contained within a Zone II of a public water supply. On August 14, 2000, MassDEP issued Dunhill a notice stating that current hydro-geologic evidence was that the Site was not within a Zone II and that the Tier II Classification would be accepted. 16) A review of MassDEP's records. indicates that Dunhill failed to complete the following comprehensive response actions at the Site. a) Pursuant to 310 CMR 40.0560(2)(b), Dunhill was required to complete a Phase 11 Comprehensive Site Assessment("Phase II") and if necessary a Phase III Remedial Action Plan("Phase III")by August 14,2002. Dunhill has failed to complete a Phase II and Phase III for the Site. b) Pursuant to 310 CMR 40.0560(2)(c),Dunhill was required to complete a Phase IV Remedy Implementation Plan("Phase IV")by August 14,2003. c) Pursuant to 310 CMR 40.0560(2)(d), Dunhill was required to complete a Response Action Outcome for the Site by August 14,2005. 17) On September 14, 2006, MassDEP issued to Dunhill a Notice of Noncompliance ("NON") (NON- SE-06-3T-57). The NON outlined the violations of the MCP above. Among other things,the NON established a deadline of February 1,2007,for Dunhill to submit to MassDEP a Phase II Report. 18) To date,Dunhill has not complied with MassDEP's September 14,2006. V.DISPOSITION 19) This Order is issued by MassDEP pursuant to its authorities under M.G.L.c 21 E§§ 9 and 10. Dunhill shall provide a signed copy of this Order to any subsequent owner, heirs, successors and assigns before rights are transferred. 25) Dunhill shall provide a copy of this Order to each, LSP, contractor or consulting firm retained to conduct any portion of the work pursuant to this Order. 26) Notwithstanding the terms of,any contract, Dunhill shall not violate this Order and shall not-allow their contractors, subcontractors,consultants,LSP, successors,heirs,assigns or agents to violate this Order. The Phase III Report shall evaluate the feasibility of reaching a Permanent Solution at the Site, as the MCP defines that term. d) By September 1, 2008, if the Phase III Report documents that it is infeasible to achieve a Permanent Solution at the Site, MassDEP shall receive a Class C-1 RAO, pursuant to the provisions of 310 CMR 40.1050. e) By December 1,2008, if the Phase III Report indicates that it is feasible to reach a Permanent Solution at the Site, MassDEP.shall receive a Phase IV Report, prepared in full accordance with the provisions of 310 CMR 40.0870. f) By February 1, 2009,,if a Phase IV Report has been submitted to MassDEP,MassDEP shall receive a Phase V Remedy Operation Status Opinion for the Site in accordance with the provisions of 310 CMR 40.0890. g) If at any time before February 1, 2009, MassDEP receives documentation. sufficient to support the conclusion that a Class A RAO has been achieved at the Site in full accordance with the MCP,no further Comprehensive Response Actions are required at the Site,pursuant to 310 CMR 40.0560(3).
