The law is implemented through regulations known as the Massachusetts Contingency Plan (310 CMR 40.0000 et seq. – the MCP). Both Chapter 21E and the MCP require the performance of response actions to provide for the protection of harm to health, safety, public welfare and the environment which may result from releases and/or threats of releases of OHM. REASON FOR THIS NOTICE On August 3, 2022 August 3, 2022 the MassDEP received a BWSC-103 Release Notification Form ("RNF") which indicates that a release of oil and/or hazardous material has occurred at the location referenced above. According to the RNF, the following contaminant(s) were detected in soil and groundwater samples collected from the site at a concentration which exceeded the Reportable Concentrations for Soil Category 1 and Groundwater Category 1 per 310 CMR 40.1600. M.G.L. c. 21E and the MCP require the performance of response actions to prevent harm to health, safety, public welfare and the environment which may result from this release and/or threat of release and govern the conduct of such actions. The purpose of this notice is to inform you of your legal responsibilities under State law for assessing and/or remediating the release at this property. For purposes of this NOR, the terms and phrases used herein shall have the meaning ascribed to such terms and phrases by the M.G.L. c. 21E and the MCP unless clearly indicated otherwise. STATUTORY LIABILITY MassDEP has reason to believe that you (as used in this Notice, “you” and “your” refers (Crosby Yacht Yard, Inc), as the current operator of the property where a release has occurred of oil and hazardous material, are a Potentially Responsible Party (PRP) with liability under M.G.L. c. 21E §5, for response action costs. Section 5 makes the following parties liable to the Commonwealth of Massachusetts: current owners or operators of a site from or at which there is or has been a release/threat of release of oil or hazardous material; any person who owned or operated a site at the time hazardous material was stored or disposed of; any person who arranged for the transport, disposal, storage or treatment of hazardous material to or at a site; any person who transported hazardous material to a transport, disposal, storage or treatment site from which there is or has been a release/threat of release of such material; and any person who otherwise caused or is legally responsible for a release/threat of release of oil or hazardous material at a site. This liability is "strict", meaning that it is not based on fault, but solely on your status as owner, operator, generator, transporter, disposer or other person specified in M.G.L. c. 21E §5. This liability is also "joint and several", meaning that you may be liable for all response action costs incurred at a disposal site regardless of the existence of any other liable parties. Pursuant to M.G.L. c. 21E and the MCP the term disposal site means anywhere OHM has come to be located. Notice of Responsibility Page 3 of 4 Release Tracking Number 4-0029459 ` MassDEP encourages parties with liability under M.G.L. c. 21E to take prompt and appropriate actions in response to releases and threats of release of oil and/or hazardous materials. By taking prompt action, you may significantly lower your assessment and cleanup costs and/or avoid liability for costs incurred by MassDEP in taking such actions. You may be liable for up to three (3) times all Response Action Costs incurred by MassDEP. Response Action Costs include, without limitation, the cost of direct hours spent by MassDEP employees arranging for response actions or overseeing work performed by persons other than MassDEP or its contractors, expenses incurred by MassDEP in support of those direct hours, and payments to MassDEP's contractors. (For more detail on cost liability, see 310 CMR 40.1200.) MassDEP may also assess interest on costs incurred at the rate of twelve percent (12%), compounded annually. To secure payment of this debt, the Commonwealth may place liens on your property in the Commonwealth. To recover the debt, the Commonwealth may foreclose on these liens or the Attorney General may bring legal action against you. In addition to your liability for up to three (3) times all Response Action Costs incurred by MassDEP, you may also be liable to the Commonwealth for damages to natural resources caused by the release. Civil and criminal liability may also be imposed under M.G.L. c. 21E, § 11, and civil administrative penalties may be imposed under M.G.L. c. 21A, § 16 for each violation of M.G.L. c. 21E, the MCP, or any order, permit or approval issued thereunder. By taking prompt actions you may also avoid the imposition of, the amount of or reduce certain annual compliance assurance fees payable under 310 CMR 4.00. You should be aware that you may have claims against third parties for damages, including claims for contribution or reimbursement for the costs of cleanup. Such claims do not exist indefinitely but are governed by laws which establish the time allowed for bringing litigation. MassDEP encourages you to take any action necessary to protect any such claims you may have against third parties. If you are a responsible party and you have reason to believe that your performance of the necessary response actions is beyond your technical, financial or legal ability, you should promptly notify the Department in writing of your inability in accordance with MGL c. 21E, subsection 5(e), and 310 CMR 40.0172. If you assert or demonstrate in compliance therewith that performing or paying for such response action is beyond your ability, subsection 5(e) provides you with a limited defense to an action by the Commonwealth for recovery of two to three times the Department’s response action costs and 310 CMR 40.0172 provides you with a limited defense to the Department’s assessment of civil administrative penalties. Please refer to M.G.L. c. 21E for a complete description of potential liability. RELEASE ABATEMENT MEASURE PLAN Release Abatement Measures may not be conducted until a RAM Plan is submitted pursuant to 310 CMR 40.0443. ADDITIONAL ACTIONS REQUIRED Notice of Responsibility Page 4 of 4 Release Tracking Number 4-0029459 ` You must employ or engage a Licensed Site Professional (LSP) to manage, supervise or actually perform the necessary response actions at this site. You may obtain a list of the names and addresses of these licensed professionals from the Board of Registration of Hazardous Waste Site Cleanup Professionals by calling (617) 556-1091 or visiting http://www.state.ma.us/lsp. MassDEP has Matthew Heil of Sanborn, Head and Associates, Inc. is listed as the LSP of Record for this release. Unless otherwise provided by MassDEP, potentially responsible parties (PRP's) have one year from the initial date of notification to MassDEP of a release or threat of a release, pursuant to 310 CMR 40.0300, or from the date MassDEP issues a Notice of Responsibility, whichever occurs earlier, to file with MassDEP one of the following submittals: (1) a completed Tier Classification Submittal; (2) a Permanent or Temporary Solution Statement or, if applicable, (3) a Downgradient Property Status. The deadline for either of the first two submittals for this disposal site is August 3, 2023. The MCP requires that a fee of $1,470.00 be submitted to MassDEP when a Permanent Solution Statement is filed greater than 120 days from the date of notification. This site shall not be deemed to have had all the necessary and required response actions taken unless and until all substantial hazards presented by the release and/or threat of release have been eliminated and a level of No Significant Risk exists or has been achieved in compliance with M.G.L. c. 21E and the MCP. The MCP requires persons undertaking response actions at a Disposal Site to submit to MassDEP a Permanent Solution Statement prepared by an LSP in accordance with 310 CMR 40.1000 upon determining that a level of No Significant Risk already exists or has been achieved at the site. Twelve (12) inches of Non-Aqueous Phase Liquid (NAPL) was identified in an on-site subsurface groundwater monitoring well. Pursuant to 310 CMR 40.0313(1), this release requires notification to MassDEP within 72 hours of obtaining knowledge, and pursuant to 310 CMR 40.0412(1) this release requires that an Immediate Response Action (IRA) be conducted. Chapter 21E and the MCP require the performance of response actions to prevent harm to health, safety, public welfare and the environment which may result from this release and govern the conduct of such actions. ORALLY APPROVED IMMEDIATE RESPONSE ACTION As outlined above, and pursuant to 310 CMR 40.0412(2.), this release requires that an IRA be conducted. At the time of oral notification to MassDEP, the following response actions were approved as an IRA: • Continued assessment • NAPL recover from ground water monitoring well All Remediation Waste generated must be properly stored/handled and disposed as soon as possible and, in all cases, within 120 days from the date of generation per 310 CMR 40.0030. ADDITIONAL ACTIONS REQUIRED Additional submittals are necessary relative to this notification including, but not limited to, a written IRA Plan, IRA Completion Statement and/or a Permanent or Temporary Solution Statement. The MCP requires that a fee of $1,470.00 be submitted to MassDEP when a Permanent Solution Statement is filed greater than 120 days from the date of initial notification. Specific approval is required from MassDEP for the implementation of most IRAs pursuant to 310 CMR 40.0420. Release Abatement Measures (RAMs) may not be conducted until a RAM Plan is submitted pursuant to 310 CMR 40.0443. Assessment activities, the construction of a fence and/or the posting of signs are actions that are exempt from this approval requirement. In addition to oral notification, 310 CMR 40.0333 requires that a completed Release Notification Form (BWSC- 103) be submitted to MassDEP within sixty (60) calendar days of August 31, 2022. The February 2013 inspection indicated no major changes in the types or quantities of hazardous materials. Edits to these notes based on the 2/4/13 inspection have been added in BOLD. The Hazardous Waste Storage Shed contains several fifty-five gallon drums of various hazardous wastes. It is constructed of wood but has a stee lined cement containment area () under the drums. The Shed was labeled correctly; the containers in the shed are also 2 vko+ labeled. There is a spill kit including emergency boom and absorbent material for the waste shed located inside the adjacent building. 3 The Tug Shop houses lwdFlammables Cabinets—one for miscellaneous flammables and one for just MEK related products. There are absorbent pads in the Tug Shop. The Big Shed houses a satellite hazardous waste accumulation area, four flammables cabinets (forty-five gallon capacity each) and various work stations. There are absorbent materials The Paint Locker, a small wooden structure, houses various paints, thinners and miscellaneous cleaners. The Battery Shed is used for the storage of boat batteries. Attached to the shed is a storage compartment for engine oil to be sold in the Parts Department. The oil is packaged in plastic, one gallon and one quart containers. The Oil Shed houses new oil, grease and hydraulic fluids in plastic one and five gallon containers. An additional wooden structure " houses in ers en4-up4e-thirty=en,—_, plastic, gasoline tanks. The Parts Department stores various hazardous material in the form of retail sized containers and spray cans. To prevent and to minimize hazards to employees, public health, safety and the environment from fires, explosions, spills or any other unplanned sudden or non-sudden release of a hazardous material to air, soil, surface or ground water. This plan shall be carried out immediately whenever public health, safety or the environment is at risk. PLANNING/TRAINING A. The effectiveness of a response during an emergency depends on the amount of planning and training performed in advance. All employees are to be informed of their responsibilities under this plan as follows: - When the plan is developed. • - When the employees' responsibilities or designated actions under the plan change. - Whenever the plan is changed. - Annually in conjunction with Right-To-Know Training. B. The actions that shall be taken in the event of an emergency are outlined below. Sea Attachment 4 for a flow chart of the Emergency Response Plan. - Verbal notification will be given to the Emergency Coordinator or his alternate either personally or by telephone using the numbers provided above. - The Emergency Coordinator will evaluate the situation and initiate appropriate action(s) as outlined below: * Notification of Response Team * Notification of on site personnel * Determination of Personal Protective Equipment (PPE) required. Emergency communications equipment, such as the telephone or PA system, shall be utilized for notifying employees of an emergency and for contacting local authorities. i j • C. Arrangements shall be made to familiarize police and fire departments with: - The layout of the facility (See Attachment 1) a - Properties of the hazardous materials (See Attachment 2) Places where facility personnel would normally be working (See Attachment 1) Entrances to the facility and possible evacuation routes (See Attachment 1) I - i EVACUATION A. In the event of a fire or other emergency; employees are to leave by the exit nearest their work area in an orderly fashion. They are to assemble in the upper parking lot, as shown in Attachment 1.-.Once the evacuation is completed, the Emergency Coordinator or his alternate will take a head count of all employees. B. In the event of an uncontrolled release of a gas; 1.. Employees are to exit and assemble in the upper parking lot, as shown in Attachment 1. Based upon the Emergency Coordinator's assessment it may be I necessary to relocate personnel to a position 300 feet to 1/4 mile up wind of the facility. Once the evacuation is completed the Emergency Coordinator or his alternate will take a head count of all employees. 2. Evacuation of surrounding'areas, if necessary, will be conducted by the Fire Department. 5 • C. In the event of a tornado: 1. The formation and approach of a tornado is rapid and unpredictable. The lead- time on a warning is, therefore, limited. The Emergency Coordinator will cause the warning to be announced on the public address system as soon as it comes to his attention. Personnel will stay sheltered inside the building. 2. If the building is struck, personnel should evacuate as soon as the storm has passed and assemble in the upper parking lot, as shown in Attachment 1. Once the evacuation described above is completed, the Emergency Coordinator' or his alternate will take a head count of all employees. D. In the event of a snowstorm, hurricane,flood or other severe weather: The Emergency Coordinator will monitor weather reports. When a warning is issued, he j shall pass the word to employees on the public address system or other means of j communication. All employees except emergency response personnel shall be dismissed from work with enough time to seek proper shelter. I E. In the event of a bomb threat: ! 1. If the facility receives a bomb threat, the threat shall be considered real. 2. The person receiving the threat should try to remain calm and try to gain as much information about the threat as possible: . *Caller's identity -sex, age, etc. *Voice characteristics-tone, impediments, accent, etc. - * Manner-calm, angry, emotional, etc. • * Background noises-street noise, aircraft, animals, quiet, etc. * Bomb facts type, size, location, time of detonation, etc: 3. At the conclusion of the conversation, the person receiving'a telephone threat should try to use the *69 or*57 feature of the telephone to trace the source of the call. 4. The Emergency Coordinator will be notified immediately. He will in turn relay the information to the emergency responders listed in Attachment 3. 5. Employees will be notified and instructed not to touch or move any unusual j packages, boxes, brief cases or other containers. Employees are to leave by the exit nearest to their work area in an orderly fashion and assemble in the upper parking lot, as shown in Attachment 1. Once the evacuation is completed the Emergency Coordinator or his alternate will take a head count of all employees. Based upon the Emergency Coordinator's assessment it may be necessary to relocate personnel to a position 300 feet to 1/4 mile up wind of the facility. F. The drawing provided in Attachment 1 shows locations where personnel may be working; j exit and entry routes; telephones and communications equipment; fire extinguishers; the main electrical panel; water faucets; paint, flammable and hazardous waste storage areas; and emergency response and clean up equipment(e.g. shovels, boots, booms, pads). G. Location drawings are posted throughout the facility to direct employees to the exit -nearest their work area. 6 1 I 1 • SITE SECURITY It is often necessary during an emergency to secure the area to prevent access of unauthorized personnel and to protect vital records and equipment. An off-limits area must be established by cordoning off the area with temporary barriers and warning tape. The Emergency Coordinator will notify local law enforcement to help secure the area if required. EMERGENCY SHUTDOWN PROCEDURES A. Activate the warning system and the emergency plan. If the situation is imminent, notify the appropriate responders, (see Attachments 3 and 4). I B. If the emergency involves the release of a flammable liquid, gas leak or heater malfunction, the Emergency Coordinator must initiate the following actions. - Shut off electrical service at the main electrical service disconnect located: 1 panels located in each section of the building powers p 9 the south side of the building at the fuel dock for the docks&fuel dock, as shown in Attachment 1. - Reset thermostats to their lowest setting. e Shut off the"Emergency Shut Off Switch",for the heating units, located: at each of the heating units, as shown in Attachment 1. Secure gas supply if this can be done safely, located along the west wall of the building outside the Wood Shop, as shown in Attachment 1. , MEDICAL TREATMENT The Emergency Response Personnel from the Medical Facility listed in Attachment 3 will perform medical duties, other than minor first aid. During extreme emergencies, Company Policy is to provide assistance and assessment of a medical emergency while awaiting the arrival of professional responders. I RESPONSE MATERIALS A. Response materials, including those listed below, are to be maintained at the Fuel Dock, as shown in the plan provided in Attachment 1. - Disposable Bags - Absorbent Pads - Recovery Drum - Boots I Broom and Dust Pan Tyvek Suits - Temporary Barriers and Warning Tape . Splash Goggles Fire Extinguishers - Neoprene Gloves - Mop and Pail - Rain Gear - Shovels(non-sparking) - Plastic Sheets r - .Containment Booms B. See Attachment 5 regarding Personal Protective Equipment(PPE). I • I 7 I f , i • DECONTAMINATION A. Decontamination procedures may need to be implemented before personnel are allowed out of the area to avoid spread of the spilled material. To accomplish this, a separate area should be set up adjacent to the spill area. Decontamination procedures involve the physical removal and/or neutralization of harmful contaminants. The extent of decontamination necessarily depends on the type of hazard and the quantities of the contaminant. j B. Basic decontamination should primarily consist of washing and rinsing with soap and water to remove contaminants from the exterior of protective gear. This is followed by doffing the gear (see Attachment 5). Coveralls and gloves shall be removed by turning the clothing inside out. Most protective gear such as boots and gloves can be cleaned and reused. Other- equipment, such as Tyvek suits, are disposable. Disposal of contaminated protective equipment is to be in accordance with statutes governing disposal of contaminated solid waste. The complexity of decontamination will vary with the size of the release and the toxicity of the material being dealt with. Large operations involving very toxic material may require additional steps. i C. Equipment for decontamination of PPE and clothing should include the following: t - Drop cloths or plastic tarps - Collection containers such as drums or lined trash cans i - Wading pool to hold wash and rinse solutions - Long handled, soft bristled brushes - Hand pumps or pistol grip bottles for washing and rinsing - Paper or cloth towels for drying equipment POST EVALUATION i A. As these two tanks are connected together with a syphon - pi-pe ,--it--is-i-mposs-ible-to-cone-lude- from- the-test-wh-e-th-ex tb-e- piping is leaking or there is actually a leak in one or both- of the tanks. Up until the test, we have been using these tanks. Our daily record of fuel usage did not indicate the slightest loss of product. So our suspicion is that the leak is probably in the piping. In any evevnt, we have another 2,000 gallon tank which passed the test. We will use this for our diesel storage. . The two questionable tanks are- empty and we would like to leave, them this way until we have the time to dig up the piping and further check it out. This being our busy time, we won't be able to get to this until mid summer and request that we"be per- mitted .to follow this plan. Thank you for your coope n. Since ichard B. The i .2000 gallon gasoline tank passed and can be continued in use. However, the two diesel tanks failed and cannot be used. They must be replaced by• tanks conforming to Town health regulations. If you do not desire to replace these tanks, please contact the Osterville Fire Department for instructions on neutralizing " them. I The Air Pressure Test is only authorized as a test for empty tanks, so evidently they are empty at this time. If they are not, they must be emptied immediately. Re: Your underground fuel storage .tanks located 72 Crosby Circle (Ncs: West Bay Road) Dear Sir: On March 11 and September 30, 1980, you were sent a copy of the Board of Health Regulation for Underground Fuel Storage and a card to fill out and return listing information concerning your underground tanks. You have not returned the card nor acknowledged our letter. Town records indicate that you have received' a permit to store fuel underground. Please be advised that if you do not return the enclosed card within five (5) days, steps will be taken to revoke your permit. Appropriate action will then be 1 taken to have your tanks neutralized or removed. 3 You are also reminded that any tank fifteen years of age or older must be tested by the Kent-Moore Pressure Test. An empty tank may be tested by a 5PSI Air Pressure Test. This testing. must be done. immediately. The enclosed card must be filled out and returned immediately.
