There is a second container on our property which is shared by two other tenants of our building for the same reasons. These other tenants are The Osterville Package Store and Baker Books. I can see no possible way in which we all can manage our trash containment and comply with your most recent requirement, and would like to have a variance or some other type of relief from these restrictions. We sell Newspapers, Magazines,Candy, Cards, and some gift items. The soda fountain has been serving coffee, donuts, assorted pastries, ice cream,.Frappes, and floats. It has. been serving these items . for at least 50 plus years according to our customers. We have been asked many times if we sell sandwiches. We have not. We feel however in order to make a living and also because of the growth in our community with new business's, we would like to offer sandwiches and salads. We have done a verbal survey and it has been greatly recieved. We know we will need the proper equipment and have been in the course of purchasing it, as well checking_ with our plumber to install the right sinks necessary in order to proceed. We plan to use 100% paper goods and plastic.utensils. We also plan to buy everything prepared. So the only -thing we would be doing is the actual assembly of sandwiches and salads on the premises, Wetwill offer any products containing mayonaise only in individual packets purchased by our distributor, so the customer has the option of.using' outside.the store: We do.not plan to do any cooking on the premises and -will only serve..foods already prepared. Food distributors such as Sysco have such 'items and we have already made contact with their representative. Our ptoblem is , as we just found out is that our building does not have Title V septic. Our landlord, Gail Nightingale (. Daniel TrustY has told 'us ,.that oor 1cufrent.system has five cesspools and are inspected yearly. She does not at this time plan to upgrade because of a meeting on September 18, 1997 ( see -attached) she was told by Mark Ells that Osterville Village ( downtown area ) was being _evaluated for possible development of waste alternatives. She was told as a property owner not to do any upgrading at this time. And to wait for a possible connection to a new alternative wastewater solution. At this time we are requesting a Variance to install a Grease Interceptor underneath our triple compartment sink,( in compliance with 248 GMR 2.09 (2) of the state plumbing code. We understand that this is a conditional variance. We intend to fully comply with any upgrades in the future as soon as determined by our .landlord and the Town of Barnstable. We ask at this time the the Board. of Health grants our request so we may go on with our changes in our business. We have always complied with the Board of Health and taken the food handling course every two years. We have always been very. conscientous of the environment and work hard to keep a very .clean store. We will comply in everyway according to the rules and regulations of the Board of Health. We are a hard working, couple with four.children and have been owners. of the Newstand for three. years. We have made it our business to be involved in our community. The plan focuses on how we will address disposal of our wastewater, now and in the future while protecting natural resources and allowing for residential and commercial growth:„ Phase I of the project was conducted in 1993 and consisted of assessing our wastewater situation. During `.' Phase I, 25 areas where identified as areas of concern based on documented on-site wastewater problems. Four of these areas of concern are within the village of Osterville. They include.the `.. .. Marina area (01), the Downtown Osterville area (02), the Parker Pond area (03), and the East Bay area (04) (See map'on page 2). t The Marina area (01) consists of a total of 45 units, 40 are residential and 5 are commercial. At least two lots are located entirely within 100 feet of North Bay. Most of the houses were built for seasonal use and have been converted to year-round use. One private and two public marinas are in this area,but there is no boat pumpout facility available, except for hauled boats at this time. The Downtown Osterville area (02) consists of a total of.106 units, 50 are residential and 56 are commercial. Part of this area is troubled by high groundwater conditions, very small lots, and flooding during rain events. These conditions make many lots unsuitable for on-site sewage disposal. During the summer, these dwellings often have more people occupying the dwelling than the septic system or the dwelling was designed to handle. In addition, many of the lots-lack-the', physical space for a Title 5 system. The Parker Pond area (03) consists of a total of 20 units, all of.which are residential. The East. Bay area (04) consists of a total.of 41 units, 39 are residential and 2 are commercial. Both of these areas have high groundwater conditions, or lots which contain large bog or.wetland sections which are unsuitable for sewage disposal. Soils tend to be highly:permeable therefore provide little filtration of contaminants: Phase II of the Wastewater Facilities Plan, completed in 1995, included developing and.screening alternative solutions to the wastewater problems defined in Phase I. Currently, we are proceeding with Phase III, a detailed 'evaluation of the alternative solutions that weighs cost-effective, environmentally sound remedies. Alternatives identified to remediate wastewater problems within each of the four areas are summarized on the back page. Included in the summary are the total capital costs and the average capital costs per unit for each of the screened alternatives (See cost estimates on page 3). The options of using single unit on-site systems is the most cost-effective solution for all of the areas of concern within Osterville, except for the downtown area (02).
