The properties,which are located at the south east corner of the downtown Osterville area,contain 19,2.50 sf and 8,671 sf of land area. The properties are located in a BA (business) Zoning District on the fringe of the Estuarine Overlay presently developed with a 5 bedroom dwelling,a 2 bedroom dwelling, and an office building of approximately 1,300 sf. The property at 58 Wianno is in disrepair,-and has been mostly abandoned since at least 2005 when we began work with a prior owner to come up with development plans that would meet the needs of the Village. The current owner purchased the property in 2013,and has been continuing those efforts. The property owner,in consultation with the Village,has come to tine determination that the Village is in need of lodging. With the exception of the Wianno Club,which has some rooming available to their members or guests, the Village has no guest accommodations. A void once filled by the East Bay Lodge just around the corner, which was redeveloped into condos in the late 90's. The property owner also feels that the property presents a unique opportunity for a location to relocate,restore, and preserve other historic structures in the Wianno area,and has,joined with tine adjacent property owner to provide additional land area for such efforts. Under the existing lot configuration,poteutial'redevelopmernt could,be limited to around 10 bedrooms under die Estuaries provisions. Being located irh the BA District,which requires a 20'lot width and no lot area requirements, die properties could theoretically be divided into 16 parcels -each which would be allowed 3 bedrooms under die Estuaries provisions,for a.total of 481edrooms. The applicants believe something more in the 21 bedroom design flow would be more appropriate. Attached to this letter you will find Development Sketches of the Existing Conditions, a very quick 7 Lot Division Plan with buildings and septics(for a total of 21 bedrooms),and a Proposed Development Sketch showing 2 possible buildings, preliminary parking/driveway layouts,and an adequately sized leaching area and reserve area. s We would like to discuss die procedures for septic flow aggregation for these parcels,AND if dhe'Board would consider additional aggregation from other properties within the Wiahuho Area,just outside of the Estuarine Overlay,for some limited additional flow for a small function room, or tavenh. Upon removal of the vessel from the tank grave,a leak from a hole on the belly of the vessel was noted with impact to soils in an approximate 8 inch diameter area. Fire Department personnel reported the incident to the Board of Health as well as to Michael Moran _ at the MA DEP, who recommended that a Licensed .Site Professional be contacted.to ,perform environmental assessment to determine the magnitude and extent of impact to soils. BENNETT.& O'REILLY, INC., was subsequently engaged and responded to the Site to perform such environmental assessment activities and oversee and document soil removal activities. 1 NOVEMBER 29,2005 NIF SHIELDS RESIDENTIAL PROPERTY.BO05-4441 PAGE 2 OF 7 LIMITED REMOVAL ACTION COMPLETION Environmental testing at the property indicated the need to conduct a Limited Removal Action(LRA)wherein impacted soils underlying the vessel were removed from a 5'x 8'area at 2-T below grade surface (bgs) on that same afternoon. At the completion of such work, endpoint samples were collected from the sidewall (SW) and bottom-of-hole (BOH) areas for confirmatory laboratory analysis. Based on the certainty of field screening analyses,Enviro-Safe Corp.personnel backfilled the excavation from the clean overburden stockpile before departing the Site. A total of some 4.38 tons (2.92 yards) of petroleum impacted soils were generated as a result of the LRA on October 31,2005. The impacted soils generated were transported under an approved Bill of Lading to Aggregate Industries in South Dennis,MA,as a licensed asphalt batching facility,on November 23, 2005. Laboratory analyses of soil samples collected at the extent of the excavation from the north, east and west sidewall and BOH areas reported petroleum concentrations below the reportable limits (BRL)of the analyses,with the reporting limits being below the applicable RCS-1 and most stringent S-1/GW-1 Method 1 - Risk Characterization standards. The SW-S: 3-T sample reported residual aliphatic concentrations,again significantly below the applicable RCS-1 and S-1/GW-1 standards, as approaching background conditions. As such, regulatory closure objectives have been met in accordance with the provisions ofthe Massachusetts Contingency Plan(MCP)pursuant to 310 CMR 40.0318, as specific to the area of the former UST. The work conducted by BENNETT&O'REILLY,INC.,represented herein,has proceeded under my supervision in a manner consistent with the MCP Response Action Performance Standards, pursuant to 310 CMR 40.0191 and the QA/QC policies of BENNETT&O'REILLY,INC. The facts and statements herein are,to the best of our knowledge,a true and accurate representation of the site activities,remedial response actions,and environmental conditions associated with the project. As such,this report serves as the technical justification and rationale for the Limited Removal Action Completion and documents regulatory compliance for project closure. ENVIRONMENTAL CONDITIONS [Refer to Appendix A] The subject property at 29 West Bay Road is located on the northeast corner of West Bay Road and Wianno Avenue in Osterville, MA, approximately one- eighth of a mile.south of the intersection of Main Street and West Bay Road [Refer to Figure 1]. The subject parcel of land contains two residential dwellings [29 West Road, 58 Wianno Avenue] on a some 0.41 acre lot identified on the Barnstable Town Assessor's Map 141 as Parcel 003. The area of release (the "Site")is located off the southwest corner of 29 West.Bay Road. Access to the property and the Site As unrestricted with high frequency and high intensity of use with children potentially present. The surrounding area is characterized as residentially and commercially developed. . In review of regional groundwater contours and topographic elevations, groundwater is projected at approximately 15-20'(+/-)below grade surface(bgs)in the area of the release.-Regional groundwater contours indicate a southerly flow direction towards Parker Pond,Neck Pond and the Atlantic Ocean beyond.[Refer to Figure 2]. There may be some localized influence, however, NOVEMBER 29,2005 N/F SHIELDS RESIDENTIAL PROPERTY.BO05-4441 PAGE 3 OF 7 LIMITED REMOVAL ACTION COMPLETION associated with North Bay and its associated wetlands located some one-half of a mile west of the property, and East Bay and its associated wetlands located some one-half of a mile east of the property. Therefore,the North and East Bay,their associated wetlands,Parker Pond,Neck Pond and the Atlantic Ocean beyond are all identified as potential environmental receptors. The MA DEP,BWSC overlay for the GIS mapping program shows the area of the property as at least partially located within a Non-Potential Drinking Water Source Area(NPDWSA). As a portion of the property appears to be located within a potentially productive medium yield aquifer and within the Cape Cod Sole Source Aquifer,the more restrictive groundwater categories will be considered as a conservative measure. The Site is not within a MA DEP approved wellhead protection area(Zone II) [Refer to Figure 3]. The subject property is serviced by the municipal water system. No known private potable wells are located within 500 feet of the area of release. Based on site conditions and the proximity of groundwater, the RCS-1 and RCGW-1 Reportable Concentrations are applicable in review of LRA response action performance standards in accordance with 310 CMR 40.0318. In addition,the S-1/GW-1, GW-2 and GW-3 soil categories and the GW-1, GW-2" and GW-3 groundwater categories are applied to Method 1 - Risk Characterization, in accordance with the provisions of 310 CMR 40.0932. These standards are developed in review of potential ingestion,inhalation,dermal contact and environmental exposures. BACKGROUND [Refer to Appendix B] On October 31 2005 Enviro-Safe Corporation personnel, as well as COMM Fire � Department personnel,were on Site to conduct the removal of a 275-gallon underground storage tank (UST). Enviro-Safe Corp. cut and cleaned the tank, removing 168 gallons of#2 Fuel Oil as representing the remaining contents of the vessel. It then became evident from the observation of a hole in the tank belly and staining to soils underlying the tank that a release had occurred. The COMM Fire Department notified the Barnstable Health Department as well as the MA DEP. Mike Moran of the MA DEP recommended that a Licensed Site Professional(LSP)be engaged to conduct environmental assessment activities to determine the extent of impact. As such, BENNETT & O'REILLY,INC.,was contacted and engaged to provide LSP services to assess the apparent impact and ultimately oversee soil removal operations under a Limited Removal Action. .ENVIRONMENTAL ASSESSMENT [Refer to Appendix B] BENNETT & O'REILLY, INC. responded to the subject property, as authorized on the afternoon of October 31,2005,to meet with the property owner and inspect the area of the release. Upon inspecting the removed vessel,a hole and stained metal was noted in the belly ofthe tank. Soil samples were collected from within the tank grave in the bottom of the hole.[BOH @ 5'] and along the north, east and south sidewalls [SW-N: 2-5', SW-E: 2-5' and SW-S: 2-5', respectively]. Composite soil samples were collected in 250-milliliter glass jars and sealed with aluminum septa. The samples were then agitated to develop organic vapors and field screened with a photoionization detector (PID) [Photovac 2020, 10.2 eV lamp calibrated to a benzene standard] for total organic volatiles(TOV)by"jar headspace"method as consistent with the MA DEP"Interim Soils Policy..." WSC 94-400. Field screening indicated a TOV reading of 62 ppmv in the BOH @ 5' sample, as NOVEMBER 29,2005 N/F SHIELDS RESIDENTIAL PROPERTY./BO05-4441 PAGE 4 OF 7 LIMITED REMOVAL ACTION COMPLETION evidence of petroleum hydrocarbon impact below the belly of the former tank, as corresponding to the area of the hole and metal staining. The SW-N, SW-E and SW-S samples reported low-level TOV readings of 18 ppmv,4.0 ppmv and 0.2 ppmv,respectively. Based on such observations and field testing, it was apparent that all.significant petroleum hydrocarbon impact to soils could be readily addressed by nominal soil removal: Therefore, it was recommended that additional soil be removed from the bottom-of-hole area, with the sidewalls to be extended moderately. The Barnstable Health Agent was advised of such conditions, and informed that a Limited Removal Action (LRA) would be conducted to absolve Notification and Remedial Response liabilities associated with an apparent minor release of fuel oil. REMEDIAL RESPONSE/LIMITED REMOVAL ACTION [Refer to Appendices C and D] On the afternoon of October 31,2005,BENNETT&O'REILLY, INC.personnel were on- site to oversee and provide technical assistance for soil removal operations. Enviro-Safe Corp. personnel operated a mini-excavator to perform the removal of soils. Soils were removed to approximately 7' bgs in the tank grave as assisted by TOV screening. Represented endpoint soil samples were then collected from each of the sidewalls and the bottom-of-hole for confirmatory laboratory analysis at the extent of excavation. Soil samples SW-N:3-7',SW-E:3-7'and SW-W:3-7' were preserved and submitted to Groundwater Analytical of Buzzards Bay,MA for Total Petroleum Hydrocarbon (TPH) analysis Via Hydrocarbon Fingerprint method. Soil samples SW-S, as : . representing a "worst case" sample based on TOV bias, and BOH @ 7' were submitted for Extractable and Volatile Petroleum Hydrocarbon(EPH/VPH)analysis,in accordance with the MA DEP VPH/EPH Guidance Policy. Based on the certainty of field testing, the excavation was backfilled from the clean overburden stockpile. Contaminated soils were stockpiled in the front yard of the house and lined with polyethylene sheeting. Subject to the receipt of analytical data, a Bill of Lading was prepared and on November 23,2005,the impacted soils were loaded and transported to Aggregate Industries of South Dennis,MA. Laboratory analytical results received November 9; 2005 reported a TPH concentration of 220mg/Kg for the contaminated stockpile sample,as exceeding the RCS-1 Reportable Concentration of 200mg/Kg and further substantiating the need for the LRA as conducted. Laboratory analysis of soil samples collected at the extent of the excavation from the north,east,west sidewalls(SW)and bottom-of-hole (BOH) areas were reported as BRL, wherein the reporting limits were below the applicable RCS-1 and most stringent S-1/GW-1 Method 1 -Risk Characterization standards. The SW-S: 3-T sample reported a fraction EPH concentration of 41 mg/Kg in the C9 - C18 Aliphatic Hydrocarbons range and 37 mg/Kg in the C19-.C22 Aliphatic Hydrocarbons range,.as below both.the RCS-1 and S-1/GW-1 Method 1 -Risk Characterization standards of 1,000 mg/Kg and 2,500 mg/Kg, respectively. The: Clean overburden (OB) stockpile reported a Total Petroleum Hydrocarbons concentration of 130 mg/Kg, as below the RCS=1 Reportable Concentration of 200 mg/Kg. This analytical data demonstrates that the contamination from the leaking UST has been successfully mitigated through Limited Removal Actions. NOVEMBER 29,2005 N/F SHIELDS RESIDENTIAL PROPERTY.BO05-4441 PAGE 5 OF 7 LIMITED REMOVAL ACTION COMPLETION RISK CHARACTERIZATION [Refer to Appendix D] Soil As previously represented,the RCS-1 Reportable Concentration soil category was considered in review of LRA performance standards,in accordance with the provisions of 310 CMR 40.0318. These criteria are consistent with the most stringent S-1/GW-1 Method 1 Risk Characterization thresholds. Laboratory analytical results reported petroleum concentrations at each discrete sidewall and bottom-of-hole area at the extent of excavation below the RCS-1 and S-1/GW-1 standards, as meeting or approaching background conditions. These conditions represent a condition of"No Significant Risk"for all foreseeable activities and uses of the.Site specific to the area of investigation [Refer to Table I]. As such,a Limited Removal Action Completion(LRAC)is appropriate to support project closure specific to the approximate 5'x 8'x 2-T (D)area of excavation off the southwest side of the subject dwelling, as noted on the Site Plan in Appendix A. A discrete vertical limit of significant soil impact was defined within T of grade.surface with all petroleum hydrocarbons and target analytes reported as BRL. Background conditions were reported in the bottom-of-hole area wherein the reporting limits of the analyses were less than RCS-1 Reportable Concentrations,as well as the most stringent S-1/GW-1 Method 1 -Risk Characterization standards as a measure of potential leaching of contaminants to groundwater. As such,no threat of groundwater impact is apparent and no groundwater analysis was undertaken nor deemed necessary in support of the Limited Removal Action Completion. CONCLUSIONS The Limited Removal Action completed at 29 West Bay Road in Osterville, MA, includes the excavation and recycling of some 4.38 tons (2.92 yards) of contaminated soil from an approximate 5'x 8' x 2-7' (D) area off the southwest side of the dwelling, as corresponding to the location of the former UST. Laboratory analysis of the endpoint soil samples report petroleum concentrations as meeting or approaching background conditions in all areas wherein all reported concentrations were below the applicable RCS-1 Reportable Concentrations and the S-1/GW-1, Method 1 -Risk Characterization standards,as demonstrating a condition of"No Significant Risk" wherein regulatory closure objectives are met and environmental impact mitigated. - A review-of cost and feasibilityto meet background conditions through additional soil-removal was conducted as part of this LRA,in accordance with the provisions of 310 CMR 40.1020. 'Wherein a condition .of "No Significant Risk" has been established for the area of fuel oil release as approaching background conditions,the costs and risks to Site workers and damage to the adjacent structure is unwarranted wherein no reduction of significant risk is accomplished. As such,in accordance with the provisions of MA DEP Policy WSC-04-160,additional soil removal without significant risk reduction is considered practically infeasible as technically and financially unjustified. As such, no further remedial response has been conducted nor deemed warranted at this time. The findings of this investigation,as represented herein, set forth the rationale and technical justifications for project closure, as established by the Limited Removal Action Completion Statement specific to the former underground storage tank previously located off.the south side of the dwelling. The LRA report is based upon the available data and regulations in effect at the time of this reporting. The 275. gallon tank with an approximate section of 2' X 3' of the top of the tank removed for pump ing"and cleaning of product was completed prior to arrival. _Upon complete excavation. and removal, an area on the bottom of the tank approximately 4 inches in diameter was .wet with fuel oil and two 1 inch diameter holes through the tank were observed. Positive ground contamination was noted with an area approximately 8 inch diameter where the holes in the tank were located was wet with fuel oil. Removal contractor on site stated that approximately 168 gallons of product was pumped from the tank, leaving 107 gallons unaccounted for. Called fire alarm to start an incident and requested notification and response from Department of Environmental Protection and Town of Barnstable Health Departments. DEP: Agent Michael Moran called via landline 508-946-2855. Advised Mr., Moran of the incident and the actions taken to date. Advised Mr. Moran of the specifics of the incident relative to tank size, owner information, removal contractor and tank breach information. I advised Mr. Moran that I would not estimate how muchproduct was released into the earth, but that approximately 107 gallons were unaccounted for. Town of Barnstable Health Agent David Stanton 508-862-4644. arrived on scene. Briefed Mr. Stanton of the events taken to date and no to DEP. Mr. Stanton spoke with Mr. Moran regarding the incident. Post conversation with Mr. Moran, Mr. Stanton stated that DEP was requesting a Licensed Site Professional to the scene for soil analysis. ; Supervisor with Envirosafe on site and coordinated LSP with homeowner. TOB Health Agent requested that Envirosafe*dig approximately 12 inches below 'the area of ground contamination. Earth removal was done by shovel and earth placed into plastic 5 gallon container. Earth at approximately 18 inches had no odor concurrent with fuel oil. The rest of the excavation was left untouched and the hand-dug sample was preserved for LSP for monitering purposes.
