8/30/2021 Enforcement Order #2 issued – Unauthorized activity beyond scope of OOC (SE3-5739)
Stone wall was supposed to be at 50’ appeared within the 50’ buffer
Vinyl sheet wall was out of foot print (was supposed to be along WLL).
In the 50’-100’ unpermitted structures include: shed, extra steps, retaining walls
along west property line, retaining wall out of footprint, outdoor firelplace,
walkways, spa with surrounding deck, driveway reconfigured and expanded

9/7/2021 Enforcement Order #2 heard, amended and ratified.
An Existing Conditions Plan was submitted for review (rev. 9/3/2021 by Daniel
Ojala (see below). Driveway not included on this plan.
The amendments to the order were as follows:
Homeowner to hire an independent consultant to perform weekly site visits and
provide a weekly report to the Commission.
Project Engineer to compile a report addressing the sheet pile wall and stone
wall in the 50’ buffer and the pros and cons of leaving vs removal (received
10/19/21)
Submit a plan showing all existing hardscape (permitted and unpermitted) for
discussion with the Commission relevant to the engineers report (see above).

9/15/2021 Enforcement Order #2 amended – to include the specific conditions imposed by the
Commission (see above).
10/19/21 Engineers Report on site conditions and location of walls in the 50’ buffer and potential
impact of leaving in place vs. removing from the 50’.
11/2/2021 Discussion of the Engineers Report and Existing Conditions Plan
A summary of construction activities was presented by Mike Ball, Marsh
Matters, the designated independent consultant hired by Mr. Davitoria.
Weekly reports by Mike Ball to continue until no outdoor work activity is being
conducted on site and site is prepared for winter.
The Commission Ordered:
o A portion of the rock retaining wall to be relocated to the original
footprint approved under SE3-5739.
o The spa/deck to be removed.
o A detailed protocol will be provided to Conservation Staff prior to
removal and relocation of the wall. Received 12/8/21 with Wall Demo
Sketch Plan
o An Amended Order of Conditions with revised plan showing changes in
wall location as well as any additional hardscape and corresponding
mitigation or plan changes from plan of record for SE3-5739 within the
50-100’ buffer and a planting plan for the area between the rock wall
and vinyl sheet wall. Detailed mitigation calculations should be
provided.
o Weekly reports to continue through the wall relocation.
01/31/2022 Received Structural Engineers Report pertaining to stone wall location with respect to
maintaining structural integrity of the house foundation.
09/08/2022 Discussion of plan to remove a portion of a retaining wall from the 50’ buffer.
At their Nov. 2, 2021 meeting the Commission ordered as much of the retaining
wall within the 50’ as possible be removed and relocated to original approved
position (based on Structural Engineers letter, see above).
The Proposed Wall Site Plan dated March 1, 2022 by Daniel Ojala was approved
ONLY for the removal and relocation of the stone wall.
Allowed for the stone wall removal and relocation to begin but required Mike
Ball’s weekly reports to continue.

05/03/2022 Amended Order of Conditions (AOOC) hearing for proposed changes to SE3-5739.
Applicant to reassess reductions in hardscape (a number of unpermitted
hardscape additions exist and more are proposed. There is not enough room to
mitigate for all hardscape plus all that is proposed.
The Commission was clear that because the 70’ of stone wall remains in the 50’
buffer , the buffer is disturbed and that makes the applicant subject ot
mitigation planting.
Revised plan will be submitted for May 24, 2022 meeting.

05/24/2022 Continued AOOC hearing.
Unpermitted hardscape was noted again.
There shouod be more emphasis on putting plantings by the wing walls.
Some of the hardscape should be removed.
A continuance was requested to June 21, 2022.

7/9/2022 Present,
STAFF RECOMMENDATION for RESOLUTION:
1. Do Not Allow any additional hardscape to be built (RED). Spa/deck should be removed. If not, proof
of connection to a drywell required.
2. Revise plan to account for true configuration of driveway expansion adjust mitigation calc
accordingly.
3. Expand the proposed mitigation planting areas in both 50’ (200-300 sq ft available) and 100’ buffers.
Fill with variety of plants (not just wildflowers) and ensure both species and height diversity. Ensure
that mitigation areas between plantings are planted with appropriate ground cover, not left to
naturalize. Supply a planting plan with palette for review of mitigation planting.
4. One (1) plan needs to be generated that incorporates all approvals over the last 2 years. This plan
would act as the plan of Record.
