For your information, the property contains approximately .91 acres and has about 200' feet of frontage on Connors Road. It is comprised of Lots 29 and 30, shown on a. plan of land recorded with the Barnstable County Registry.of Deeds in Plan Book 47, Page 119, a copy of which is enclosed,. ,Title to locus.is presently held by Virginia B. Upham, who inherited the property from her father, Heyworth Backus, in 1977. Heyworth Backus obtained title to Lot 29 on December 22, 1950. The record title to Lot 30 is a bit confusing, but of no consequence from the perspective of zoning. Mr. Backus took title to Lot 30 by confirmatory deed recorded in 1960, which'deed states that it is to confirm the deed given to him'in 1943,which was lost. In any event Mr. Backus appears to have held title to both Lots since at least 1960. In running the record title"to the abutting properties, I find that none of them have been held in common with locus since at least 1955, except that since 1993,.1ot`39,which abuts, locus on the southeast, has been owned by both the said Virginia B. Upham and her husband, John E. Upham. - e It is my understanding that the.property in question is improved with a garage, which was constructed many years ago by Mr. Backus and used in conjunction with his home on the other side of Connors Road. This garage has been and continues to be used for storage for the extended Backus family. If you have any questions or need any further information, don't hesitate to call. Thank you for your assistance in this matter. When I met with you with regard to this matter, you requested that I provide you with copies of deeds in the chains of title to the above-referenced property, as well as all abutting properties. Enclosed are those copies, as well as a copy of a plan recorded in Plan Book 89, Page 63, which is aresubdivision of Lot 28, which abuts locus on the northeast, as well as other lots in the area. For our purposes, Lot 28 on the plan delivered to you with my September 20 correspondence is shown as Lot 28A on this, latter plan. Since our meeting, locus has been conveyed by.Virginia,Uphdm to her daughter and her son-in-law,NCaryl.A,`and'Williain.D_'Steward,j and a copy of that deed is also enclosed herewith. Boudreau September 20, 2002 Thomas Perry, Building Commissioner Barnstable Town Hall 367 Main Street Hyannis, MA 02601 Re: 145 Connors Road Centerville, Massachusetts Barnstable Assessor's Map 251, Parcel36 ' Dear Mr. Perry: I represent the owner of the above-referenced property, Virginia Upham and would appreciate it if you would confirm that the property has retained its status as a buildable lot. For your information, the property contains approximately,911acres and has about 00 feet of frontage on Connors Road.-It is comprised of Lots-29'and#301, shown on a plan of land recorded with the Barnstable County Registry of Deeds in Plan Book 47, Page 119, a copy of which is enclosed. Title to locus is presently held by Virginia B.° Upham, who inherited the property from her father,jHeyworth:Back_u`s; in 1977. Heyworth Backus obtained title to Lot 29 on December 22, 1950. The record title to Lot 30 is a bit confusing, but of no consequence from the perspective of zoning. Mr. Backus took title to Lot 30 by confirmatory deed recorded in 1960, which deed states that it is to confirm the deed given to him in 1 1943, which was lost. In any event Mr. Backus appears to have held title to both Lots since at least 1960. In running the record title to the abutting properties, I find that none of them have been held in common with locus since at least 1955, except that since 1993, lot'39, which abuts locus on the southeast, has been owned by both the said Virginia B. Upham and her husband, John E. Upham. I ' 2 It is my understanding that the property in question is improved with a garage, which was constructed many years'ago by Mr. Backus and used in conjunction with his home on the other side of Connors'Road. This garage has been and continues to be used for storage for the extended Backus family. If you have any questions or need any further information, don't hesitate to call. Thank you for your assistance in this matter. Sincerely, Philip Michael Boudreau PMB/hcg Enclosure M a OCUSA* Los, s Q-r3d 772 VZ, a. ANEW'CCHS and EDITH N.
