The hearing was opened on November 16,1995,at which time the applicant,through their Attorneys office,by letter dated November 14, 1995,requested a continuance and provided an extension of time for filing of the decision. The petition was continued to January 10, 1996 at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Emmett Glynn,Ron Janson,Gene Burman,Elizabeth Nilsson,and Chairman Gail Nightingale. Attorney Charles M.Sabah represented the petitioners before the Board. The locus is in an RD Residential D Zoning District which requires one acre minimum lot size and a minimum width size of 125 feet. When the Petitioner applied for a Building Permit,it was denied as it does not comply with current zoning. Attorney Sabah agrees that the lot was not grandfathered and therefore he is requesting a Variance. The conditions for the Variance can be satisfied. Attorney Saban continued and stated that the lot has always been assessed as a buildable lot and when the petitioners bought the lot they assumed it was buildable. The present owners do have a purchaser for the lot The granting of relief for this Variance would not derogate from the spirit and intent of the Zoning Ordinance in the Town of Barnstable,as the lot size of the locus is consistent in size with all other lots In the immediate area. This lot is the only lot in the Immediate area that has does not have a home built on It This creates a unique condition and a hardship would incur if the relief were to be denied. According to Attorney Saban the Variance conditions are the financial hardship,the fact that the relief would not be in derogation to the spirit and Intent of the Zoning Ordinance,the other lots in the area have the some lot size, and also this is the only lot without a home built upon It. A Public Hearing before the Zoning Board of Appeals.was duly advertised and notices sent to all abutters In accordance with MGL Chapter 40A. The hearing was opened on November 15,1995,at which time the applicant,through their Attorneys office,by letter dated November 14, 1995,requested a continuance and provided an extension of time for filing of the decision. The petition was continued to January 10. 1998 at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Emmett Glynn,Ron Jansson,Gene Burman,Elizabeth Nilsson,and Chairman Gall Nightingale. Attorney Charles M.Saban represented the petitioners before the Board. The locus is in an RD Residential D Zoning District which requires one acre minimum lot size and a minimum width size of 125 feet Lot 175 Is 13,90D sq.ft(about 113 acre)and has a width of 120 feel. The lot was held In common ownership with Lot 168,Lot 169,Lot 174 and lot 176 until June 1971. In 1971 the lots were conveyed out and in 1983 Lot 175 was conveyed to the Petitioners. Zoning in this area changed from an RB 1 to an RD-1 Zoning District and the minimum lot size iric ressed,however,these lots were created in 1958,prior to the zoning change. in 1988-1969,the lots lost protection and when the lot went into separate ownership in 1971,they were no longer protected.. When the Petitioner applied for a Building Permit,it was denied as It does not comply with current zoning. Attorney Sabatt agrees that the lot was not grandfathered and therefore he is requesting a Variance. The conditions for the Variance can be satisfied. Attorney Sabah continued and stated that the lot has always been assessed as a buildable lot and when the petitioners bought the lot they assumed it was buildable. The present owners do have a purchaser for the tot The granting of relief for this Variance would not derogate from the spirit and Intent of the Zoning Ordinance in the Town of Barnstable,as the lot size of the locus is consistent in size with all other lots In the immediate area. This lot is the only lot in the Immediate area that has does not have a home built on It This creates a unique condition and a hardship would incur if the relief were to be denied. According to Attomey Saban the Variance conditions are the financial hardship,the fact that the relief would not be in derogation to the spirit and Intent of the Zoning Ordinance,the other lots in the area have the same lot size, and also this-is the only lot without a home built upon it On June 28, 1983,the lot was purchased for$13,900 which Mr.Saban contents was the market value of a buildable lot. The public was asked to comment,No one spoke in favor or in opposition. Zoning Board of Appeals-Dedslon and Notice Appeal No.1996453-Malloy Finding of Facts: Based upon the testimony given during the Public Hearing on this appeal,the Board unanimously found the following findings of fact: 1. The property Is located at Lot 175 Cottonwood Lane,Centerville and consists of.36 acres(approximately 1/3 of an acre). 2. it is located in an RDA Residential D-1 Zoning District,which requires one acre of contiguous upland and 125 feet of width. 3. The lot at issue is less than the area requirement as well as 5 feet short of the width requirement. 4. The lot was created in 1958 and held In common contiguous ownership until 1971. 5. The property is registered land. 6. All the surrounding lots are all built upon and therefore there is no available land to add to this tot 7. The surrounding lots are all of similar size to the locus. S. In granting of the Variance would not be detrimental to the neighborhood nor in derogation of the spirit and Intent of the Zoning Ordinance. 9. To deny the relief would be a severe financial hardship as in 1983.the Petitioner paid what appears to have been full market value for the lot Decision: Based on the positive findings,a motion Is made to Grant the Variance being sought in Appeal Number 1995- 163 with the following conditions: 1. Background: The petitioners are seeking a Variance to Section 3-1.1(5)for Lot 175 Cottonwood Lang in the Wequaquet Lake area of Centerville. The locus is in an RD Residential D Zoning District which requires one acre minimum lot size and a minimum width size of 125 feet. Lot 175 is 13,900 sq.ft. (about 1/3 acre) and has a width of 120 feet. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on September 25, 1995. A Public Hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on November 15, 1995, at which time the applicant, through their Attorneys office, by letter dated November 14, 1995, requested a continuance and provided an extension of time for filing of the decision. The petition was continued to January 10, 1996 at which time the Board found to grant the appeal with conditions. Board members hearing this appeal were Emmett Glynn, Ron Jansson, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Charles M. Sabatt represented the petitioners before the Board. The locus is in an RD Residential D Zoning District which requires one acre minimum lot size and a minimum width size of 125 feet. Lot 175 is 13,900 sq.ft.(about 1/3 acre) and has a width of 120 feet. The lot was held in common ownership with Lot 168, Lot 169, Lot 174 and Lot 176 until June 1971. In 1971 the lots were conveyed out and in 1983 Lot 175 was conveyed to the Petitioners. Zoning in this area changed from an RB 1 to an RD-1 Zoning District and the minimum lot size increased, however, these lots were created in 1958, prior to the zoning change. In 1968-1969, the lots lost protection and when the lot went into separate ownership in 1971, they were no longer protected. When the Petitioner applied for a Building Permit, it was denied as it does not comply with current zoning. Attorney Sabatt agrees that the lot was not grandfathered and therefore he is requesting a Variance. The conditions for the Variance can be satisfied. Attorney Sabatt continued and stated that the lot has always been assessed as a buildable lot and when the petitioners bought the lot they assumed it was buildable. The present owners do have a purchaser for the lot. The granting of relief for this Variance would not derogate from the spirit and intent of the Zoning Ordinance in the Town of Barnstable, as the lot size of the locus is consistent in size with all other lots in the immediate area. This lot is the only lot in the immediate area that has does not have a home built on it. This creates a unique condition and a. hardship would incur if the relief were to be denied. According to Attorney Sabatt the Variance conditions are the financial hardship, the.fact that the relief would not be in derogation to the spirit and intent of the Zoning Ordinance, the other lots in the area have the same lot size, and also this is the only lot without a home built upon it. On June 28, 1983, the lot was purchased for$13,900 which Mr. Sabatt contents was the market value of a buildable lot. The public was asked to comment. No one spoke in favor or in opposition. Zoning Board of Appeals-Decision and Notice Appeal No. 1995-153-Malloy Finding of Facts: Based upon the testimony given during.the Public Hearing on this appeal, the Board unanimously found the following findings of fact: 1. The property is located at Lot 175 Cottonwood Lane, Centerville and consists of.36 acres (approximately 1/3 of an acre). 2. It is located in an RD-1 Residential D-1 Zoning District, which requires one acre of contiguous upland and 125 feet of width. 3. The lot at issue is less than the area requirement as well as 5 feet short of the width requirement. 4. The lot was created in 1958 and held in common contiguous ownership until 1971. 5. The property is registered land. 6. All the surrounding lots are all built upon and therefore there is no available land to add to this lot. 7. The surrounding lots are all of similar size to the locus. 8. In granting of the Variance would not be detrimental to the neighborhood nor in derogation of the spirit and intent of the Zoning Ordinance. 9. To deny the relief would be a severe financial hardship as in 1983, the Petitioner paid what appears to have been full market value for the lot. Decision: Based on the positive findings, a motion is made to Grant the Variance being sought in Appeal Number 1995- 153 with the following conditions: 1. The petitioner shall comply with all regulations of the Board of Health in the Town of Barnstable with regards to septic requirements. 2. The lot shall be used only for a single family residence. VOTE: 4 AYE: Elizabeth Nilsson, Gene Burman, Ron Jansson, Emmett Glynn, and Chairman Gail Nightingale. NAY: None. Order: Appeal Number 1995-153 the Variance has been Granted With Conditions. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year.
