The reason they can move as of right is that the plaza, although located in a Highway Business Zone, is a pre-existing non-conforming use. In keeping with prior treatment of this plaza, you must look to the historical use of each unit as classified under our zoning ordinance. The use of Unit 2 has been retail and will now become personal services under the zoning ordinance. The personal service use requires less parking under the zoning ordinances than retail use. Thus, personal service is considered a less intense use then retail and therefore does not trigger the need for a Special Permit. I have explained to my client that by converting Unit 2 from retail to personal service, he will be unable to put a retail use in said unit in the future unless he first obtains a special permit from the Zoning Board of Appeals.
