The complaint cited violations of 521 CMR 23.2.1, for a failure to have the minimum required number of accessible parking spaces, and of 521 CMR 23.2.2, for .a failure to ensure the required number of accessible parking spaces for vans. Following its receipt of the complaint, the Board issued notice to Centerville Plaza Trust,' dated November 22,2016, to respond within 14 days of its.receipt thereof with the steps planned or taken to comply with the regulations. The.Board did not thereafter receive a full compliance plan from the owner and, therefore, issued a Second Notice, dated March 22; 2017. It received no response following the Second Notice and,therefore, issued a Notice of Hearing on August 3, 2017: The hearing was scheduled for October 16, 2017 and was'held in accordance with M.G.L. c. 30A, §§ 10 and 11; 801 CMR 1.02 et seq.; and 521 CMR 4.00.All interested parties were provided with an opportunity to' testify and present evidence to the Board. No one appeared on the owner's behalf. William Joyce, the Board's compliance officer, appeared and was sworn in by the Board Chair. The instant decision now.memorializes the Board's determination made at that time: Applicable Laws & Regulations 1 The Complainant identified Centerville Plaza Trust as the owner of the property. Because a review of Barnstable Assessors property records indicates the owners as "Nilesh.P. Marfatia Trust" and "Aman Realty Trust,"this decision will be forwarded to their attention as well. Pursuant to 521 CMR 3.3.1.5., "[i]f the work performed amounts to less than 30% of the full and fair cash value of the building and if the work costs less than $100,000, then only the work being performed is required to comply with 521 CMR." 521 CMR 2.3.2 mandates that, "[i]n the event that a person fails'to cure such noncompliance by the date. specified in the Board's order, the Board shall be empowered, after further hearing, to impose a fine payable to the Commonwealth not to exceed $1,000 per day per violation for each .day of noncompliance that the Board finds was without justification." Per 521 CMR 23.1; "[a]ny person who has lawful control of improved or enclosed private property used as off-street parking for businesses, auditoriums, sporting or recreational facilities, cultural centers, or general public use where the public has the right of access as invitees or licensees, shall cause such parking areas, including temporary parking areas to comply with 521 CMR." 521 CMR 23.2.1,requires that, for a parking lot with between 51 and 75.total parking spaces, a minimum of 3 of them must be accessible. Finally, 521 CMR-23.2.2 states that "[o]ne in every eight accessible spaces, but not less than one, shall be van accessible, See 521 CMR 23.4.7." Factual Findings The following findings of fact and conclusions of law are supported by substantial evidence, based on the credited testimony of the witnesses, documents admitted into evidence and AAB records. M.G.L. c. 30A, § 11(2), § 14(7) 1) The subject facility is a commercial property including several retail establishments. 2) The property includes a parking lot with 66 spaces. Exhibit#1,AAB 9. 3) The parking lot currently includes two spaces that are accessible to persons with disabilities. It includes no spaces that are accessible by vans. Ibid.,AAB 11. 4) The parking lot was last repainted in or about October 2016. Ibid.,AAB 9. Discussion The Board's jurisdiction is established pursuant to the 521 CMR 3.3.1.a., which requires that, "[i]f the work performed amounts to less than 30% of the full and fair cash value of the building and if the work costs less than $10.0,000, then only the work being performed is required to comply with 521 CMR." No evidence was adduced as to the cost of prior work performed at the -facility. Therefore, full compliance with all applicable section of 521 CMR is not demonstrated and the evidence only establishes that the owner must comply with accessible parking requirements. z This exhibit,while not marked in at the-hearing, is admitted for the record. Page 2 of 5 f " r As noted by the Complainant, the parking lot includes 66 total spaces with only two accessible spaces thereat. However, pursuant to 521 CMR 23.2.1, a parking lot that includes between 51 and 75 parking spaces must include three accessible spaces. Furthermore, one "in every eight accessible spaces, but not less than one;" must be accessible by a van. 521 CMR 23.2.2. The owner has failed to respond,to then allegations. Therefore, pursuant to 521 CMR 2.3.2 the Board hereby determines that a FINE HEARING is justified to determine whether the owner's failures constitute willful noncompliance and whether fines are appropriate in this circumstance. Conclusion and Order "In light of the foregoing,the Board voted as follows: to CALENDAR the matter for a FINEWEARING..Such hearing shall be held on February 5, 2018. The complaint cited violations of 521 CMR 23.2.1, for a failure to have the minimum required number of accessible parking spaces,.and of 521 CMR 23.2.2, for a. failure to ensure the_required number of accessible parking spaces for vans. Following its receipt of the complaint, the Board issued notice to Centerville Plaza Trust,' .dated November 22, 2016, to respond within 14 days of its receipt thereof with the steps planned•or;taken to comply with the regulations. The.Board did not thereafter receive a.response from the owner and, therefore, issued a Second Notice, dated March 22, 2017. It received no response following the Second Notice and, so, issued a Notice of Hearing on August 3, 2017. , The hearing was scheduled for October 16, 2017 and was held in accordance with M.G.L. c. 30A, §§ 10 and 11; 801 CMR 1.02 et seq.; and 521 CMR 4.00.2 All interested parties were provided with an opportunity to testify and present evidence to the Board. No one appeared on the owner's behalf. William Joyce, the Board's compliance officer, appeared and was sworn in by the.Board Chair. At the conclusion of that hearing and given the owner's failure to appear or otherwise"respond to the allegations, the Board voted to calendar the-matter for a fine hearing. r` 1 As noted in the prior decision, the Complainant identified Centerville Plaza Trust as the owner of the property.Because a review of Barnstable Assessors property records indicates the owners as."Nilesh P. Marfatia Trust" and "Amara Realty Trust,"this decision will be forwarded to their attention as well. 2 As was the subsequent hearing held on February 5, 2018. That hearing was held on February 5, 2018 to determine whether the owner's failures constituted willful noncompliance and whether fines were appropriate in the circumstances. Mr. Joyce appeared and was sworn in by the Board Chair. However, no one appeared for the'owner although notice of the hearing was issued on December 22, 2017.3 The instant decision now memorializes the Board's votes at that hearing. Applicable Laws & Regulations 521 CMR 2.3.2 mandates that, "[i]n the event that a person fails to cure such noncompliance by the date specified in the Board's order, the Board shall be empowered, after further hearing, to impose a fine payable to the Commonwealth not to exceed $1,000 per day per violation for each day of noncompliance that the Board finds was without justification." Pursuant to 521 CMR 3.3.1.a., "[i]f the work performed amounts to less than 30% of the full and fair cash value of the building and if the work costs less than $100,600, then only the work being performed is required to comply with 521 CMR." Per 521 CMR 23.1, "[a]ny person who has lawful control of improved or enclosed private property used as off-street parking for.businesses, auditoriums, sporting or recreational facilities,cultural centers, or general public use where the public has the right of access as invitees or licensees, shall cause such parking areas, including temporary parking areas to comply with 521 CMR." 521 .CMR 23.2.1 requires that, for a parking lot with between 51 and 75 total parking spaces, a minimum of 3 of them must be accessible. Finally, 521 CMR 23.2.2 states that "[o]ne in every eight accessible spaces, but not less than one, shall be van accessible, See 521 CMR 23.4.7." Page 2 of 4 I The following findings of fact and conclusions of law are supported by substantial evidence, based on the credited testimony of the witnesses, documents admitted into evidence and AAB records. M.G.L. c. 30A, § 11(2), § 14(7) 1) The subject facility is a commercial property including several retail establishments. 2) The property includes a parking lot with 66 spaces. Exhibit#1, AAB 9. 3) The parking lot currently includes two spaces that are accessible to persons with disabilities. It includes no spaces that are accessible by vans. Ibid., AAB 11. I 4) The parking lot was last repainted in or about October 2016. Ibid.,AAB 9. Discussion 'The Board's jurisdiction is established pursuant to the 521 CMR 3.3.1.a., which requires that, "[i]f the work performed amounts to less than 30% of the full and fair cash value of the building and if the work costs less than $100,000, then only the work being performed is required to comply with 521 CMR." No evidence, was adduced as to the cost of prior work performed at the facility. Therefore, full compliance with all applicable section of 521 CMR is not demonstrated and the evidence only establishes that,the owner must comply with accessible parking requirements given the recent repainting of the parking lot. As the Complainant noted, the parking lot includes 66 total spaces with only two accessible spaces thereat. However, pursuant to 521 CMR 23.2.1, a parking lot that includes between 51 and 75 parking spaces must include three accessible spaces. Furthermore, one "in every eight accessible spaces, but not less than one," must be accessible by a van. 521 CMR 23.2.2. Therefore, a space accessible by a van is required in this parking 4 lot. As the owner failed to respond to the allegations, the Board deemed it appropriate to.calendar a fine, hearing in this matter. The owner again failed to either appear at that hearing or otherwise respond to the allegations, despite proof that it had received notice of the hearing. Given this, the Board now find'' that the owner's failures constitute willful noncompliance and that fines are appropriate in this circumstance. Conclusion and Order In light of the foregoing,the Board voted as follows: to FIND IN FAVOR OF THE COMPLAINANT in that the owner wilfully failed,.without any justification, to comply with the cited requirements of 521 CMR. The Board further finds that the owner willfully failed to comply with its December 21, 2017 order. Therefore, a FINE of$1,000/DAY IS IMPOSED, starting on February 5; 2018 and continuing until such time that the Board receives verification of t compliance. Such verification shall be made via'affidavit stamped by a licensed Massachusetts design professional, certifying the,parking lot complies with 521 CMR. Payment of the daily fine shall be paid immediately following`demonstration of.compliance and must be submitted to AAB via check or money order, payable to the "Commonwealth of Massachusetts:"s to EXPEDITE the decision of the Board, therefore.bypassing the Board's approval`of the decision prior to it being sent out to all parties concerned. s. I The Board reserves its right to reconsider when payment is due and whether, in the face of continuing disregard of this order, portions of the fine should be immediately paid on set dates,whether a subpoena should issue against the owner or whether to seek enforcement of this order by the Office of the Attorney General of.Massachusetts.
