The Town gparnstakFp �n presently designates the "use" of this property as "motel.". However, based on the inforination that follows, I submit that the use designation of the property as "motel" is too narrow and-Alfa]2 "multi-family"more accurately describes how the property has been used since it was first developed. In 1948 Joseph Silvia("Silvia") and A. Roland Robert("Robert")purchased the property which was vacant woodland and depicted as Lot'12 in Plan Book 48, Page 49. See Exhibits 1 and 2. Between 1948 and 1949 and prior to the enactment of zoning, Silvia and Robert developed the property. See Exhibits 3 and 4 (notin$t the deeds in Exhibits 3 and 4 state "with the buildings thereon" while Exhibit 1 states "woodland"). Under the deeds, Silvia owned the westerly portion(presently known as 1927 Falmouth Road)_and Robert owned the easterly portion(presently known as 1903 and 1941 Falmouth Road). See Exhibit 5.• The development of the property by 1949 is also supported by the Town of Barnstable Assessing Division Field Cards which dates the structures at the property to that-time. See Exhibits 6A-6C.1 By 1949 the property was improved with the four(4) structures that exist today. See Exhibits 1-6. In 1952 Robert conveyed the easterly portion of the property to Silvia. See Exhibit 7. Additional support for the development and use of the property comes from 2002 Affidavit of Floyd J. Silvia which states that his parents purchased the property in 1948 and that during the 1950's it not only served as their residence but it was utilized as a motel and apartments (Ranch Rail 1 It appears that the Town of Barnstable Assessing Division Field Card for 1903 Falmouth Road dates the structure to 1985 but this is an error because the deed into Robert and Silvia in January 1948 states"woodland"while the April 1948 deed into Robert(for 1903 Falmouth Road)states"with the buildings thereon". h 4 Motor Court) were rented on a year round basis. See Exhibit 8. I submit that the foregoing facts establish that the four(4) structures which are present today and the multifamily use of the property existed prior to the enactment of zoning. Between 1960 and 1987 the property was utilized in substantially the same multifamily fashion as Silvia and Robert established in 1949. See Exhibits 9-12. In 1966, Robert E. Immonen and Kaino M. Immonen("Immonen") petitioned the Town of Barnstable Zoning Board of Appeals ("ZBA") for a special permit to expand the non-conforming use of the property. See Exhibit 9. The uses as stated in the 1966 zoning petition indicate multifamily use rather than purely motel. See Exhibit 9. Although the ZBA issued the special permit in 1966, the proposed new building was never constructed. Compare Exhibit 5 and Exhibit 9. Between 1976 and 1980, Edward F. Simpson as Trustee of the Ranch Rail Realty Trust("Simpson") operated the property. See Exhibit 10 (noting that as of 1976 the name Ranch Rail still associated with the property). In J Simpson June 1980 Sim conveyed the remainder of Lot 12 (1927 Falmouth Road) to Charles P. Colbath and Barbara M. Colbath("Colbath") but retained Lots 1 and 2, along with access thereto for his own use as a single family residence. See Exhibit 11. However, the single family use of 1903 Falmouth Road terminated in September 1980 when Simpson conveyed Lots 1 and 2 to Charles P. Colbath, Barbara M. Colbath and Dennis J. Colbath. See Exhibit 12. In 1987 Colbath conveyed the property to David A. Sauro and Janice L. Sauro as Trustees ("Sauro"). See Exhibits 13 and 14. In 1988 Sauro petitioned the ZBA for a special permit to expand the pre-existing non-conforming use (motel/apartments)by razing the existing structure on Lot 1 (one apartment unit) and constructing a larger building to house four two-bedroom apartments. See Exhibit 15 (noting Lot 1 contained only 1 apartment unit because Immonen never constructed the authorized two unit building authorized under the 1966 special permit shown in Exhibit 9). The ZBA denied Sauro's petition for a special permit but the Decision issued by the ZBA contains numerous factual inconsistencies from what is contained in Michael Ford's memorandum and this letter. See Exhibit 15. Notwithstanding the factual inconsistencies, the ZBA denial of the special permit did not change the existing multifamily use at the property as of 1988 (eight efficiency and four single rooms) and the Building Commissioner of Town of Barnstable recognized the apartments at the property. See Exhibit 16. In July 1993 Richard P. Callahan as Trustee of Centerville Village Apartments Realty Trust ("CVA")purchased the property. See Exhibit 17. A short time after acquiring the property CVA was issued a building permit from the Town of Barnstable for the remodeling of the property, which included the installation of new kitchen efficiency units. See Exhibit 18 (noting that efficiency units already existed in 1988). The building permit application originally described the proposed use as "existing apartments" but it appears this was crossed out by the builder, Michael J. Gardner, and"motel units"was inserted. See Exhibit 18. The reason "existing apartments"was crossed out and"motel units" inserted in the building permit was at the direction of the Building Commissioner so that ZBA would not be required. See Exhibit 19. From 1993 to present the property has been utilized the same. I submit that the narrowing of use terminology at the property occurred in 1993 and it should not have due to the historical multifamily use of the property dating to 1949. Based on the foregoing facts, I suggest that the proper use designation for the property is multifamily, not limited to motel. Due to the documented, historic multifamily use of the property, I suggest that the use clarification can be made administratively. In the end,4Ry future -development at this property will require a-variety of Town approvals including Site-Plan ---- -- Review and ZBA due to its proximity to Route 28. Box ' 960 Hyannis, fMA . 0.2601 771-5070 ` i , I FACTS The locus which is the subject of this petition. consists of three adjacent lots located off_ of Route 28, ( 1927 Falmouth Road) , in the Village of Centerville in a residential zoning district. The parcel has 300 feet of frontage on Route 28 . The total area of ' the three lots combined is 1 . 34 acres. The total area of the two lots which are the subject of the proposed project is 27 , 248 sq. ft . At present the Petitioners operate the property as a pre-exist ing. nonconf orming use consisting of twelve ( 12 ) rental units, eight ( 8 ) of which are efficiency units and four (4 ) of which are single rooms. Three of the units are presently rented to the Housing Assistance Corporation and the Barnstable Housing Authority under their respective rental assistance programs . The property has the benefit of a special permit under Appeal No, 1966-3 (a copy of which is attached hereto as Exhibit A) which allowed the construction of the building, presently proposed for demolition, and its use as two ( 2 ) apartment units. The use of the property for rental units commenced around 1.950 and was operated as the Ranch Rail motor Court . It is a pre-existing nonconforming use in that this area has been zoned. Residential and the previous Board in the 1_966 Special Permit Petition found that said use was indeed a pre-existing nonconforming use. Subsequent to the issuance of the 1966 permit, the one-story wooden frame dwelling that is sought to be demolished. and replaced with. the proposed structure was constructed. There is presently one ( 1) apartment unit located in said structure. -1- The Petitioners ,propose upon demolition of the - -- -- --_--a f or e-m ent-io n-e d--st r-u c t ur e---to c-o n s-tr-u c t-a---t w o-=s t o r b u i l d i n y-- g---w i t h-- -- --- four (4) apartment units located in same with a total of eight (8 ) bedrooms . The Petitioners further propose, and would welcome a restriction, that at least two (2) . of the proposed four ( 4 ) units be offered on a' long .term basis to the Barnstable Housing Authority for ,use in their rental assistance program. ( See letter from :Michael Toner, Director of the Barnstable Housing Authority attached hereto as Exhibit B. ) There are six ( 6 ) parking spaces proposed to service the four units. The new building, although slightly larger , will be built in approximately the same location as the existing building, setback from Route 28 by over 100 feet . 1 � The new building as proposed would meet all of the requirements for four ( 4 ) new apartments ,�or multi-family dwelling , as provided for in Section 3-2 .1 Subsection J except the required perimeter green space of 20 feet along one side of the lot serviced by the 'proposed driveway and parking . ARGUMENT The Petitioners are seeking a special permit under the provisions of old Section G, ParagraphB and old Section P, Paragraphs 4 and 6 to extend, change or alter a pre-existing nonconforming use The applicable sections under the recodif.ied By-law are Sections 4-4 .2 , Subparagraphs 2 and 3 . The test before the Board of Appeals is the same as it was under the previous By-law. i .e. , whether or not the proposed -2- extension or . alteration of the pre-existing nonconforming structure and use is more objectionable and substantially detrimental to the neighborhood then the existing nonconforming structure and use. The nonconforming use of the site, i .e. as multiple rental efficiency units, pre-dates the adoption of zoning in 1954 , the initial units having been constructed in 1950 . The use has been recognized as a nonconforming use by the Board of Appeals in Special Permit No. 1966-3 which authorized the construction of the two (2) additional efficiency apartment units. Therefore, the Petitioners ' standing to apply for special permit relief as a nonconforming use falls under the provisions of Section 4-4 .2 . The Board must now determine whether or not the issuance of the permit as requested would result in a use which is substantially more detrimental or more objectionable to the neighborhood then the existing nonconforming use. The neighborhood is primarily residential in nature consisting of vacant residential land and numerous single-family dwellings . The proposed use would be in conformity with the underlying zoning being residential in nature. Indeed, the uses as proposed would only be an increase of three (3) units over what is presently on the site and two ( 2 ) units over what was authorized as an addition by the 1966 Special Permit. As such, the additional three ( 3 ) units would not result in any substantial increase in traffic or congestion. The benefit to the neighborhood and .the Town as a whole is that such needed housing will be made available to those in great need of one. -3- Y Since purchasing. the .property in March of 1987 the Petitioners have made numerous changes to the existing property including a 'complete face-Lift and renovation of all existing buildings other than the one proposed for demolition, the . elimination of the swimming pool that-existed in the front yard on Route 28 and interior remodeling and cleaning of all units presently under rental contract .' The Petitioners' have submitted elevations to show the style and construction of the building and all traffic would ingress and egress out onto Route 28 at the existing curb cut. The site plan, together with ' the proposed elevations clearly show that the project aesthetically will be an improvement over the existing wooden frame. structure which it will replace on the back portion of the lot . CONCLUSION The Petitioners feel that the permit as prayed for will result in an extension of the existing use, residential in character , in keeping with the, under_lying residential zoning- and one which would greatly benefit the neighborhood in terms of providing much needed housing. Therefore, the Petitioners would suggest that to grant the permit as prayed for , with restrictions, would not be more objectionable or substantially detrimental to the neighborhood then the existing nonconforming rental operation. 3792d , At the conclusion of the hearing, the Board took said petition under advisement. Based on the evidence submitted, the .Zoning Board of Appeals made the. following findings: Lot 1 is- occupied by a single-family residential structure and, there- fore, is: in compliance with the existing zoning bylaw classification of this area as single-family residential uses only. The. petitioner, therefore, has no standing to request a special permit to extend a non-conforming use. -2- To replace a conforming, single-family structure with a use that is not permitted in the zoning district requires a variance which was not requested nor .advertised', and which is not permitted within 300 feet of Route 28. A special permit issued under Appeal No. 1966-03 allowed for the construction of two units on Parcel 1. Only one unit was constructed and the special permit granted 22 years ago has long. since expired. Based on the consideration of the land area involved as either .one entire parcel consisting of ,three adjoining lots, or as one separate lot #1, the addition of four dwelling units and eight bedrooms on this small property is an over-intensification of use and would be substantially more detrimental to the neighbor affected. At a public hearing held on March .31, 1988 , the Zoning Board of Appeals. vot.ed by a unanimous vote to deny the Special Permit sought .
