The Board of Appeals found Mr. Parow presented his petition for variance relief from Section J, setback require- ments at Lot 9 Farm Hill Rd`., West Hyannisport in an RB zoning district. Plans have been submitted with the filing. The petitioner desires to construct a one-car garage as indicated on the Plan which shows the side and rear yard setback encroach- ment of the proposed 20' x 24' garage. The driveway location does not allow for the garage to be placed within the required setback area - the lot consists of only 7,705 square feet. The petitioner has no intent of creating an apartment in the proposed garage. This is to be a one-car garage with storage loft above and shop area. Chairman, Luke P. Lally made a motion to allow the variance requested, based on the facts presented at the hearing. The Board voted unanimously to allow the variance with the encroachment as per the Plan presented at the filing. Murphy, Jr., appeared on behalf of the petitioner, at which time he requested a continuance of the public hearing scheduled this evening - we are also in receipt of his letter relating to this issue - the continuance is necessary in order for the petitioner to have a compre- hensive traffic study compiled - this will not be completed for a period of three weeks - necessitating a continuance to the meeting of June 26. Attorney Murphy said that he would be happy to waive the time constraints the Board must hold a hearing within 65 days of the filing of the petition under Chapter 40A, as well as the time frame relating to the Board's making a decision, etc, Attorney Murphy to provide a letter to the Board in which he waives the time constraints. Chairman, Luke Lally, commented if there is no objection from Board members we will continue this hearing to the meeting of June 26 - ,we will not advertise the petition again. 1986-51 BARBARA & GEORGE PAROW Mr. Parow presented his petition for relief from Section J, setback require- ments at Lot 9 Farm Hill Road, West Hyannisport in an RB zoning district - Plans have been presented at the filing. The petitioner intends to construct a one-car garage for,:which he has already pourned a concrete slab, as shown on the Plan which also indicates the side and rear yard setback encroachment and the proposed garage of 20' x 20' . The petitioner stated that because of the placement of the driveway, the garage may not be elsewhere on the lot - the lot contains only 7705 square feet - most of the lots in the area are the same size. Chairman, Luke Lally, questions the petitioner as to whether he has any intent to make an apartment in the proposed garage - he does not - to be only a one-car garage with storage loft above and shop area, per the plans in the file.
