lnformation and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the"law", an employee is defined as every person in the service of another under any
contract of hire, express or implied,oral or written.
An employer is defined as an individual, partnership, association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual , partnership, association or other legal entity, employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the
dwelling house of another who employs persons to do maintenance , construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required.
Additionally, neither the commonwealth nor any of its political subdivisions shall enter into any contract-for the
performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter hav
been presented to the contracting authority.
Applicants
Please fill in the workers' compensation affidavit completely, by checking the box that applies to your situation and
supplying company names, address.and phone numbers as all affidavits may be submitted to the Department of
Industrial Accidents for confirmation of insurance coverage. Also be sure to sign and date the affidavit. The
affidavit should be returned to the city or town that the application for the permit or license is being requested,
not the Department of Industrial Accidents. Should you have any questions regarding the"law"or if you are required
to obtain workers' compensation policy, please call the Department at the number listed below.

Please be sure that the affidavit is complete and printed legibly. The Department has provided a space at the bottom of
the affidavit for you to fill out in the event the Office of Investigations has to contact you regarding the applicant. Pleas
be sure to fill in the permit/license number which will be used as a reference number. The affidavits may be returned to
the Department by mail or FAX unless other arrangements have been made.

As you are aware from our phone conversations, there is a
dispute between Ron Burrows and my mother regarding the fence
located northwest of the intersection of Central and Greely
Avenues. Mr. Burrows contends that the fence prevents adequate
vision clearance per Section 14 of the Town Barnstable Zoning
Byryl�aws.„ He provided the enclosed sketch plan as part of his

For argument's sake, we assume that the plan is materially
correct in its presentation of the intersection.
First, we need your opinion on whether Central Avenue is the
existing dirt road, which I understand has been in its current
configuration for at least the past 50+ years, or whether the
road is the 40 foot wide right-of-way as .defined on paper in
1989. I believe I sent you that plot plan last November. In
researching this issue, I would call to your attention a
multiparty agreement recorded January 30, 1941, a copy of which
is attached. In essence, this document defines beach lots and
right-of-ways, and assures that landowners between Craigville
Beach Road and the beach have access to their beach property.
Paragraph 6 specifically deals with Central Avenue.
Second, we would like to understand what the actual property
boundary is for my mother's property along Greely and Central
Avenues, which are both private roads. My understanding is that
the property boundary is the center of each of those roads, as
defined by the subdivision plan of 1989. Mr. Burrows position
is that the property boundaries are the western edge of the
Greely Avenue and the northern edge of Central Avenue, both as
defined in 1889. I would appreciate if you would review the
relevant deeds and render an opinion on this question.

Third, would you please visually inspect the intersection to
determine if the fence encroaches on the existing dirt road. It
'is my understanding that the fence is lawful if Central Avenue
is bounded by the edge of the existing dirt road and if the
fence does not encroach on that existing dirt road. Under those
circumstances, I am further lead to believe that the
requirements for corner vision clearance per Section 14 of the
Town of Barnstable Zoning Bylaws are satisfied.
Would you please produce a letter addressing these three
points and send it to me at the address listed on this
letterhead. In order to bring this dispute to a speedy
resolution, .I would appreciate a response at your earliest

This letter is in response to your letter of April 26th to
my mother and follows up on our telephone conversation of May
3rd. I have been advised on this issues by Henry Healy, Esq. ,
Partner at Bingham, Dana and Gould and Mark Titlebaum, Esq.
conveyance law specialist with Hay and Dailey, Boston.
In response to Mr. Burrow's complaint last summer, I
researched the facts and legal documents pertaining to traffic
flows and right-of-ways in our woods in West Hyannisport. Of
particular interest is a multiparty agreement recorded January
30, 1941 (copy attached) which defines the rights of travel on
all the private roads currently part of the West Hyannisport
Beach Association. In essence, it assures that landowners
between Craigville Beach Road and the beach have access to their
beach property. Paragraph 6 specifically excludes Central
Avenue from any right-of-way.
Central Avenue has never been more than a cart path, nine to
twelve feet wide, and I am told that it was only left in place
after the 1941 agreement to shorten routes as a matter of
convenience for milk trucks, garbage trucks and emergency
vehicles. The fact that Central Avenue has been closed off at
both ends so that houses could be placed on it (including
property sold by Mr. Burrows for that express purpose) adds
further, practical weight to my argument.

Further, I am advised that my mother's deeds -of ownership
clearly identify that the property boundary is the center of
Greeley and Central Avenues. The Engineering Office of the Town
of Barnstable also affirmed that position. This is a point with
which Mr. Burrows does not concur. I am advised that the _deed
interpretation on this point is very clear and not subject to
dispute.
In summary, Central Avenue is nothing more than an ancient
way whose boundary is simply the edge of the dirt cart path as
it has existed for the last 80+ years. Any right of travel on
that cart path derives only from the casual usage that it has
enjoyed for the past many years.
Two points derive from that conclusion. First, the fence
which my parents constructed has adequate vision clearance per
Section 14 of the Town of Barnstable Zoning Bylaws, a fact which
you confirmed last August when you inspected the property.
Second, the portion of the fence north of Central Avenue
violates no right-of-way.
I reviewed these findings, then still tentative, by phone
with Mr. Burrows on November 29th, 1988. We agreed to await
further input from the surveyor regarding the boundary
definition. I solicited two bids and awarded the work by phone
in December to Baxter and Nye in Osterville. There was a
misunderstanding regarding what constituted an official
authorization to proceed, given that the firm, had quite a
backlog of work to execute before being able to start work on my
mother's property. Not having heard from them over the course
of the winter, I called Bill Nye on April 12th and confirmed the
engagement by letter on April 13 (copy attached) . I expect the
surveying work to be completed by early June.
Upon review of the surveyor's findings, I will have another
conversation with Mr. Burrows at which time I trust we will
resolve this issue amicably and appropriately. .

which arise out -of this correspondence.

Dear Mr. Burrows:
I have completed the review of the legal issues regarding my
mother's fence on the corner of Greely and Central Avenues. `
Shortly after sending William Nye my letter of May loth, we
talked by phone. At that time, he was reluctant to produce the
letter that I requested simply because we were dealing with
legal issues rather than surveying issues. As a result, I asked
Mark Titlebaum, the lawyer who provides real estate counsel to
Bingham Dana and Gould, to review the relevant deeds, documents
and plot plans and produce a legal opinion. '
His letter is attached. In essence, his legal opinion is
consistent with the tentative conclusions I shared with you by
telephone in December. The fence is legally placed.
When the fence was installed to provide privacy from the
traffic and noise created by your development of the eastern
side of Greely Avenue, it did go to the corner and did obstruct
corner vision. In response to your complaint in 1987, my father
did in good faith move the fence to bring it into compliance '
with the zoning laws. Given the conclusions of the attached .;
legal opinion, however, it could be argued that the fence never
did need to be moved in the first place. After your further
complaint last August, the fence was inspected by Mr. DaLuz, the
Building Commissioner, in the presence of my mother and George
Bergtholdt, and Mr. DaLuz expressed the opinion that there was
adequate vision clearance. As documented in the attached legal
opinion the fence violates no right-of-way along the dirt road
known as Central Avenue.

As an aside, I would bring your attention to one additional
piece of evidence showing that mother does, in fact, own
property to the center of Greely and Central Avenues. Attached
to this letter are copies of a plot plan drawn by the Town of
Barnstable in 1980 and the Town's request for an easement to put
drainage on the western half of Greely Avenue. The documents
clearly identify my parents as the owners of the western half of
Greely Avenue.
As far as I am concerned, we have satisfied the requirements
of the law and acted responsibly as a good neighbor. I would
ask you to review the enclosed documentation, accept its
conclusions and put this issue behind us.

by the entirety, both of 70 Plymouth, Street, Montclair, New Jersey, herein-
after called the Grantors, for consideration paid in the sum of One Dollar
($1.00), grant to THE INHABITANTS OF THE TOWN OF BARNSTABLE, a municipal
corporation, within the County of Barnstable, Commonwealth of Massachusetts,
hereinafter referred to as the Grantees, with QUITCLAIM COVENANTS, the
perpetual right and easement to enter upon, dig up, lay, maintain, construct,
reconstruct, repair, replace, operate, inspect and remove pipes, apparatus,
equipment and other usual fixtures deemed necessary for drainage purposes, in,
under, across and along the land of the Grantors situated in Barnstable
(Hyannis), County of Barnstable, Massachusetts, more particularly described
as follows:

and the westerly sideline of Greely Avenue:

Said easement is shown and delineated on a plan entitled: TOWN OF
BARNSTABLE, PLAN OF PROPOSED DRAINAGE EASEMENT, CRAIGVILLE BEACH ROAD,
HYANNIS (BARN.) MASS. dated August.21, 1980, Scale 1"=20 ft. which plan is
to be recorded herewith.
ALSO the perpetual right and easement at any time and from time to time
and without further payment therefor, to clear and keep cleared the area or
areas, in which this easement is herein granted, or any part thereof, of trees
underbrush or other obstructions, and to add to and otherwise change the
location of the pipes, apparatus, fixtures and other equipment and each and;
every part thereof and the location thereof within the area herein granted,%,
and the right to pass along said strip of land for all of the above purposes,
and the removal of said pipes, apparatus, fixtures and equipment as reasonably
required.
In all cases, the making of repairs or improvements shall be completed
as soon as possible.

Dear Bruce:
You have told me that Mr. Ronald P. Burrows and your mother, Mrs. Jean
Berry Walton, have a dispute regarding a fence, owned by Mrs. Walton, and
located near and to the north of an existing dirt road and within a "paper
street" known as Central Avenue, at the northwesterly intersection of Greely
Avenue, in West Hyannisport. Enclosed is sketch plan by Everett H. Hinkley
dated May 31, 1988, showing the fence and ways. I understand that the plan was
prepared for Mr. Burrows and that you assume it is substantially correct.
You have told me that Mr. Burrows complains that the offending fence in
Central Avenue obstructs his view of the intersection with Greely Avenue. You
have explained that Mr. DaLuz, the Building Commissioner, has inspected the
premises and is of the opinion that the fence does not materially obstruct the
view_ of a driver approaching the intersection, so does not violate Section
4-5.1 of the Zoning By—Law dealing with vision clearance on corner lots, and
need not be removed.
You have explained that Mr. Burrows takes the position that, whether or not
others believe that-the fence obstructs the view of the intersection, the fence
should be removed because it is located in a way or street (that is, in Central
Avenue) and not in your mothers's front or side yard.
Your mother has assumed that she has title to the center line of the
40--foot wide paper street known as Central Avenue and that rights of others, if
any, to use the way are limited to the "Existing Dirt Road" shown on the }
Hinkley sketch plan. If that is the case, her front or side yard for zoning
purposes would extend southerly to the northerly line of the "Existing Dirt
Road. "
You have asked me to obtain from the Barnstable County Registry of .Deeds
certain instruments and plans and to review those instruments and plans with a
view toward determining your mother's title in Central Avenue at the

Northwesterly corner of Greely Avenue and, specifically, with a view toward
determining whether she may lawfully maintain the "Existing Stockade Fence, "
hereinafter called the "Fence. " Following are my comments:
1. Central Avenue is a 40—foot wide way shown on plan dated Jan. 22, 1889,
entitled "Section No. 1 Plan Of Sea Shore Lots Belonging To The Hyannis
Beach Association On Vineyard Sound Barnstable Mass. ," recorded in Plan
Book 34, page 91. Enclosed is attested copy of that plan, hereinafter
called the "1889 Plan. " The Fence is located in the northerly half of
Central Avenue, where it abuts Lot 116 on the 1889 Plan.
2. Your mother acquired title to Lot 116 and other lots under deed from Ronald
P. Burrows dated December 28, 1973, recorded in Book 1984, page 128,
attested copy enclosed. The deed, in its description of the premises,
begins "Southerly by Central Avenue, eighty and 81/100 (80.81) feet;". The
effect of that language is to convey to your mother the title to the center
line of Central Avenue where it abuts Lot 116, if Mr. Burrows had title.
It may be of interest to you to know. that the deed also conveyed to your
mother title to the center line of Greely Avenue, where it adjoins Lots 107
through 116 (from Central Avenue to Wianno Avenue, now known as Craigville
Beach Road), if Mr. Burrows had title. I mention this because by deed
dated September 11, 1981, recorded in Book 3358, page 130, attested copy
enclosed, Mr. Burrows conveyed to himself, as trustee of Greely Avenue
Trust, the entire width of Greely Avenue from Wianno Avenue southerly to
Lots 376 and 367 on the 1889 Plan. Mr. Burrows apparently did not realize
that he had earlier parted with his title to the westerly half of Greely
Avenue, where it adjoins Lots 107 through 116.
3. The title to the ways shown on the 1889 Plan and rights in those ways were
established under an instrument dated October 1, 1940, recorded in Book
575, page 198, attested copy enclosed, and signed, presumably, by all the
lot owners. Under Paragraph Fifth of that instrument, each lot owner was
granted the fee (or title) to the center line of Central Avenue, Greely
Avenue and other ways where they adjoined their lots. Under Paragraph
Sixth, rights of way were granted to the lot owners in all ways shown on f
the 1889 Plan except for Vineyard Sound Avenue and Central Avenue. Under +
Paragraph Seventh, certain specified parties were granted rights of way in
Central Avenue between Magnolia Avenue and Lincoln Street and between
Kearsage Avenue and Jackson Street. Those parts of Central Avenue are to
the west of your property. Under Paragraph Eighth, rights of way are
granted in all ways except in Vineyard Sound Avenue and Central Avenue.
4. It is evident that the instrument of October 1, 1940 grants no rights in
Central Avenue, except for the limited rights (not affecting your mother's
property) granted under Paragraph Seventh. Furthermore, Paragraph Ninth
provides that "No party shall have any rights of way or other rights over
any of the streets shown on said Plan-of Seashore Lots unless expressly .
granted hereby, all rights not expressly granted hereby being released by
each party." It appears, then, that there are no rights of way of record

in Central Avenue, except for those limited rights given under Paragraph
Seventh. In fact, I understand that Central Avenue between Greely Avenue
and Fairview Street was closed by Mr. Burrows and is now part of a
residential lot. The plan showing the discontinued part of Central Avenue
within the residential lot (recorded in Plan Book 315, page 8, attested
copy enclosed) references the 1940 instrument by its Book and page as
apparent justification .for discontinuing the road.
5. In view of the foregoing, it appears that your mother has title to the
center line of Central Avenue where it abuts her property and that there
are no rights of record of others in that part of Central Avenue abutting
her property. The "Existing Dirt Road" apparently is a travelled way over
which some persons may have rights on account of twenty years' use of the
Road. Accordingly, her front or side yard runs to the northerly line of
the "Existing Dirt Road" and the Fence is lawfully located.
6. I have not made a title examination of .the property because it would likely
be very expensive. Instead, I have examined those instruments you told me
are significant and assumed there are no others. Mr. Burrows is, of
course, free to have the title examined if he believes my report may be
incomplete or erroneous.
