The zoning history of this area is as follows : 1950 Zoned A District Article 68 1956 RB-1 Requiring 10, 000 square foot lots with a width of 100 feet Article 42 1958 RD-1 Area was increased to 20, 000 square feet with a width of 125 feet Article 49 1985 RD-1 Area was increased to 1 acre with a 20 foot frontage requirement and a 125 foot width Article 1 1996 RD-1 Area still required 1 acre of area with 20 feet of frontage and a width of 125 feet with established setbacks of 30 feet for the front of the lot and 10 foot setbacks for the side and rear of the lot 8 . Both Lot 65 and Lot 57 complied with every zoning change which affected this area until the adoption of Article 1 on February 28, 1985 at Town Meeting which increased the area for lots in this district to one acre. At the time of this change the lots were in separate ownership. Based on the foregoing it is my opinion that under Section 4- 4 . 2 (1) of the Town of Barnstable Zoning Ordinance these lots are not held in common ownership with any adjoining land; have a minimum of 5, 000 square feet of area and 50 feet of frontage (which exceeds the minimum frontage requirement for this zoning district) ; conformed to the existing zoning when legally created and Lot 65 conformed to the existing zoning when it was revised in 1967; and the lots were separately owned at the time of every zoning change which made them non-conforming. Therefore, it is my opinion that both Lot 65 and Lot 57 are "grandfathered" lots and each may be built upon for residential purposes because the lots each conform with Section 4-4 . 2 (1) of the Zoning Ordinance . From all data it appears that both Parcels are buildable under zoning as legal created pre-existing non- conforming lots. Although each is held by what appears to be a husband and a wife and the lot north in both their names, I would strongly suggest that the issue of common "control" not be pursued. The separation and its timing shows that they may have been separated to avoid the merger issue. It should be noted that Parcel 5, although has frontage on Hill Creek Road, that road way does not appear to be developed (as shown on the GIS map). When that lot comes forward for a building permit, some level of development or the way will probably have to be made. Both parcels are in close proximity to wetlands and an order of conservation may be needed.
