District of Critical Planning Concern (DCPC) Nomination", dated March 15th, 2001, and the
Regulations for Evaluating Hardship Applications dated April 26, 2001, the applicants have
requested that the Town Manager grant a hardship exemptidn to allow for the issuance of a Building
Permit.
Materials Submitted:
Completed Application for Building Permit Exemption Based Upon Substantial Hardship, dated
Apri126, 2001,with various attachments.
Summary of Evidence Submitted:
1. The applicant is operating under a variance which has already received an extension and will soon
lapse.
2. The applicant has been engaged in permitting with various boards and commission for several
years and well in advance of February 22, 2001.
3. The applicant will suffer severe financial hardship if she loses here rights under the variance.
After reviewing the documents submitted and taking testimony, a motion was made and duly
seconded as follows:
I find substantial and sufficient hardship under the criteria established by the Town Manager.

Background:
The property consists of 3 parcels with a total area of approximately 1.47 acres. Parcel 016 Is improved
with a one-story,3 bedroom ranch style dwelling with a living area of approximately 1,668 sq.ft. Parcel
016 is improved with 2 buildings;a one-story, 3 bedroom ranch style dwelling with a living area of
approximately 1,156 sq,ft.and a one-story,3 bedroom cottage with a living area of approximately 576 sq.
ft. Parcel 110 Is currently vacant. The property is located In an RD-1 Residential Zoning District which
requires a minimum 30'front yard, 10'side yard and 10'rear yard setback,and a minimum lot size of one
acre.
All 3 parcels are owned by the applicants. Parcels 016 and 110 have technically merged under zoning,
being less than an acre individually. The applicants wish to sell the existing house on Parcel 016 to their
daughter and build a 2 bedroom single-family r"Oence on the adjoining vacant land to the south. The
applicants are proposing to reconfigure the existing lot lines so that the encroachment over the lot line
between subdivision lot numbers 10 and 11 Is rectified and the sideline setbacks of present zoning are
met.
The applicants have applied for the following zoning relief:
Appeal Number 1999-164-Variance from lot size requirements,Section 3-1.1(5)of the Zoning
Ordinance, In order to allow the creation of a buildable lot that has less than the minimum required area.
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the'Office of the Zoning Board of Appeals on
October 7, 1 M. A public hearing before the Zoning Board of Appeals was duly advertised and notices
sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened December_15, 1999,
and continued to January 19,2000, at which time the Board granted the relief with conditions.
Hearing Summary:
Board Members hearing these appeals on December 15, 1999 were Gail Nightingale, Ron Jansson,
Richard Boy, Ralph Copeland, and Chairman Emmett Glynn. Attorney Jeffrey Johnson represented the
applicants, David and Janet Cook Dunbar,who were present. Attorney Johnson requested and the Board
agreed to have these appeals heard together.

• Variance to Section 34.1(5)Bulk Regulations-Lot Size
As background,Attorney Johnson explained the three houses on the property in issue were built In the
1930s- 1940s and were not built within the lot lines. The applicants bought the property In March 1993.
Recently, they put In new septic systems for all three houses. Pursuant to a variance granted by the
Board of Health,the septic systems are located across the street on property owned by the applicants.
That lot still has-room for a single family home and Its own septic system. It was during the Board of
Health process that the encroachment was discovered by the applicants. The Board asked to see the
variance from the Board of Health to make sure there are no restrictions placed on the lot. [Attorney
Johnson to supply.)
The applicants wish to sell the"middle house"to their daughter and built a 3 bedroom single-family
residence on the adjoining vacant land to the south. That vacant land Is almost one acre. There is a
man-made herring run behind the property limiting the upland calculations. Most of the homes In the area
are located on 1/2 acre lots. The applicants are aware of the need for Conservation Commission approval
before they build anything. The new home will be on town water.
Attorney Johnson reviewed the different lot lines and the structures on each lot. Some of the structures
currently encroach on the lot lines. The applicants have a signed ANR Plan(signed August 08, 1999)for
the new configuration of the tots for the creation of Parcel 1 and Parcel 1A. There will be one parcel with
two houses and the applicants will keep it In their name and they are seeking to create a buildable lot with
the remaining land. For zoning purposes,all the lots have merged because of common ownership.
For the record,the applicants bought all the property-'three houses and all the lots(on both sides of the
street)for$195,000 in 1993.
The Board asked about ground water flows with reference to Long Pond, Attorney Johnson reported that
Peter Sullivan(Sullivan Engineering, Inc.)did,e groundwater evaluation and he could report back to the
Board 9 they so desired,
The Board asked Attorney Johnson to explain the.Varianoe conditions as they,felt-If there were any
hardship conditions-they might be self-imposed.
Attorney Johnson explained that because the applicants also own the land across the street,they could
build the house on that lot and would not need zoning relief.' However,they would prefer to build on the
this side of the road as that is a bigger lot.,They would consider"swapping"their buildability rights from
the tots on one side of the private way to the lots on the other side by putting on deed restrictions.
Specifically,the applicants would restrict tots 5,6,and 7 to never being built on[in perpetuity)In.
exchange for the buildability of Lots 13-17-a quid-quo-pro-if the Board would be amicable. Without
zoning relief, there could be a total of four houses on all these lots but not at the preferred location of the
applicants. If granted the relief,they would.limit the number of houses on all these lots to four structures-
In perpetuity.
Board Member Ralph Copeland asked about the possibility of a demolition of the small cottage to make
the lots less crowded. Attorney Johnson explained that is the home of the applicants'other daughter and
it would also cause a more nonconforming situation for Lot 8.
Public Comment: Janice Dunbar addressed the Board. She explained that when they bought the
property there were many problems and they have spent a lot of money to clean up the property and they
have taken care with regard to the,herring run and the ground water. There is a letter of support from Earl

Board Members hearing this appeal on January 19,2000 were Ralph Copeland, Ron Jansson,Tom
DeRiemer,and Chairman Emmett Glynn. Attorney Jeffrey Johnson represented the applicants, David
and Janet Cook Dunbar,who were present:
Board Member Gene Burman stated he must step down due to a possible conflict of Interest. He has
leased a portion of the property for the applicants: Attorney Johnson responded that the tenant has
moved out so there Is no longer any financial gain and,therefore,no conflict of interest.'Mr. Burman
stated he would still like to step down to avoid any appearance of a conflict of interest. The Board asked if
the applicants wanted to go forward with a four member Board. After discussion with the applicants,
Attorney Johnson Informed the Board they would like to go forward and take their chances with only four
Board Members.
At the start of the hearing(January 19,20001,Attorney Johnson provided the Board with several maps
showing the existing layout,the proposed layout and the building envelope. He also provided the Board
with an amended request which includes Lots 5 thru 7. The applicants are willing to forego building a
house on Lots 5 thru 7 If they are allowed to build a 3 bedroom house on Lots 13 thru 17.
Attorney.Johnson described the proposal. The applicants wish to sell Lots 11 and 12 to their daughter.
They are seeking permission to change the lot line between Lots 10 and 11 to correct an encroachment
over the lot line. They would like to build a 3 bedroom house on Lots 13 thru 17.
The Board asked which lots are owned by the applicants. Attorney Johnson responded that they own
Lots 8 thru 17 on the westerly side of Holly Lane and Lots 5 thru 7 on the easterly side. The Board asked
which lots are part of the relief being requested. He stated that the Special Permit request is for Lots 8
thru 10 to allow a change of the lot line.-The Variance request Is to allow Lots 13 thru 17 to be considered
buildable.
The Board discussed the Lot 5hapeyFaotorwhich will become more nonconforming for Lots 8 thru 10. .
Attorney Johnson infonned:the Board that they went before.the Conservation Commission on January 18,
2000 and that another meeting Is scheduled for a site visit before they decide on the matter.
Ron Jansson asked if the existing septic systems comply with current Title V regulations. Attorney
Johnson stated that he has been informed by Peter Sullivan that they do. The septic systems for the
middle and last house(moving away from Long Pond)are located across the street on Lot 5. There Is.an
easement for the septic systems but Lots 5 thru 7.are still buildable. Attorney Johnson stated that as-of-
right a septic system for a new house on Lots 5-7 could be put across the street.
The Board asked who Is currently residing in the 3 existing dwellings. Attorney Johnson stated that the
Dunbars live In the first house(closest to Long Pond),their daughter Is renting the middle dwelling and
their other daughter Is renting the third house. .
Public Comment: Fred Hulme addressed the Board. He is in favor of allowing a house to be built on
Lots 13-17 but not on Lots 5-7. He stated the herring run-flows toward Pine Street,away from Long Pond.
Findings of Fact:
At the hearing of January 19,2000,the Board unanimously found the following findings of fact as related
to Appeal No. 1999-1544:
1. Appeal Number 1999-154 is a request for a Variance from Section 3-1 i1(5)Bulk Regulations-Lot
Size:
2. The property in issue Is owned by David B. and Janet Cooke Dunbar. The property Is shown on
Assessor's Map,229, and is known as Subdivision Lots 14-17 as shown on a plan of land recorded
with the Barnstable County Registry of.Deeds,Plan Book 58,Page 23.
3. The property consists of approximately.75 of an acro of land and is zoned RD-1 Residential D1
Zoning District which requires a minimum of one acre'of contiguous upland to be considered

these four lots.
4. No specific findings are made with reference to Chapter 40A,Section 10.
5. Granting the applicants the relief being sought would not be In derogation of-the spirit nor the intent of
the Zoning Ordinance nor would it be detrimental to the neighborhood affected in that the lot being
created is an equivalent size to other lots in the area,

Decision:
Based on the findings of fact, a motion,was duly made and,seconded to grant the relief being sought in
Appeal No. 1999-154, subject to the following terms and conditions:
1. The new buildable lot shall Include Lots 14.17 only,as shown on a plan of land recorded,with the
Barnstable County Registry of Deeds, Plan Book 58 Page 23.
2. The applicants shall submit to both the Zoning Board of Appeals and the Planning Board a revised
plan showing the reconfiguration of these lots.
3. The new plan and this decision shall be recorded at the some time at the Barnstable County Registry
of Deeds.
4. The lot shall be allowed to be built,upon for single-family residential purposes only and not to exceed
a three bedroom house.
5. The applicants must comply with all requirements of the Conservation Commission,the Board of
Health and the new Title V provisions without a variance. .
6. Lots 5-7, as shown on a plan of land recorded with the Barnstable County Registry of Deeds, Plan
Book 58, Page 23,shall remain unbuildable lots in perpetuity as a trade-off in the intensification of use
that is being allowed in this area.
7. The applicants shall file a deed restriction Indicating the above restriction:

Procedural Summary:
This appeal was filed at the Town Clerk's Offioe and at the Office of the Zoning Board of Appeals on
October 7, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices
sent to all abutters In accordance with MGL Chapter 40A.' The hearing was opened December 15, 1999,
and continued to January 19,2000,at which time the Board granted the relief with conditions.

applicants, David and Janet Cook Dunbar,who were present. Attorney Johnson requested and the Board
agreed to have these appeals heard together. .
As background,Attorney Johnson explained the three houses on the property In issue were built In the
1930s-1940s and were not built within the lot lines. The applicants bought the'property in March 1993,
Recently,they put in new septic systems for all three houses. Pursuant to a variance granted by the
Board of Health,the septic systems are located.acros's the street on property owned by the applicants.
That lot still has room for a single family home and its own.septic system. It was during the Board of
Health process that the encroachment was discovered by the applicants. The Board asked to see the
variance from the Board of Health to make sure there are no restrictions placed on the lot. [Attorney

The applicants wish to sell the'middle house"to their daughter and build a 3 bedroom single-family
residence on the adjoining vacant land to the south. That,vacent land Is almost one acre. There is a
man-made herring run behind the property limiting the upland calculations. Most of the homes In the area
are located on 1/2 acre lots. The applicants are aware of the need for Conservation Commission approval .
before they build anything. The new home will be on town water.
Attorney Johnson reviewed the different lot lines and the structures on each lot. Some of the structures
currently encroach on the lot lines. The applicants have a signed ANR Plan(signed August 08, 1999)for
the new configuration of the lots for the creation of Parcel 1 and Parcel 1A. There will be one parcel with
two houses and the applicants will keep It in their name and they are seeking to create a buildable lot with
the remaining land. For zoning purposes, all the lots have merged because of common ownership.
For the record,the applicants bought all the property-three houses and all the lots(on both sides of the
street)for$195,000 in 1993.
The Board asked about ground water flows with reference to Long Pond. Attorney Johnson reported that
Peter Sullivan[Sullivan Engineering,Inc.]did a groundwater evaluation and he could report back to the
Board If they so desired. .
The Board asked Attorney Johnson to explain the Variance conditions as they felt-if there were any
hardship conditions-they might be self-imposed
Attorney Johnson explained that because the applicants also own the land across the street,they could
build the house on that lot and would not need zoning relief. However,they would prefer to build on the
this side of the road as that is a bigger lot. They would consider"swapping"their buikiability rights from
the lots on one side of the private way to the lots on the other side by putting on deed restrictions.
Specifically,the applicants would restrict Lots 5,6,and 7 to never being built on[in perpetuity)in .
exchange for the buildability of Lots 13-17-a quid-quo=pro-If the Board would be amicable. Without
zoning relief,there could be a total of four houses on all these lots but not at the preferred location of the
applicants. If granted the relief,they would limit the number of houses on all these lots to four structures-
In perpetuity.
Board Member Ralph Copeland asked about the possibility of a demolition of the small cottage to make
the lots less crowded. Attorney Johnson explained that is the home of the applicants'other daughter and
it would also cause a more nonconforming situation for Lot B.
Public Comment: Janice Dunbar addressed the Board. She explained that when they bought the
property there were many problems and they have spent a lot of money to clean up the property and they
have taken care with regard to the herring run and the ground water..There Is a,letter of support from Earl
E. Brown,Jr. in the file. No one else spoke in favor or In opposition to these appeals.

and Janet Cook Dunbar,who were present.
Board Member Gene Burman stated he must step down due to a possible conflict of interest. He.has
leased a portion of the property for the applicants. Attorney Johnson responded that the tenant has
moved out so there Is no longer any financial gain and,therefore,no conflict of interest. Mr. Burman
stated he would still like to step down to avoid any appearance of a conflict of Interest. The Board asked If
the applicants wanted to go forward with a four member Board. After discussion with the applicants,
Attorney Johnson informed the Board they would like to go forward and take their chances with only four
Board Members.
At the start of the hearing,Attorney Johnson provided the.Board with several maps showing the existing
layout,the proposed layout and the building envelope. He also provided the Board with an amended
request which includes Lots 5 thru 7. The applicants are willing to forego building a house on Lots 5 thru
7 if they are allowed to build a 3 bedroom house on Lots 13 thru 17.
Attorney Johnson described the proposal. The applicants wish to sell Lots 11 and 12 to their daughter.
They are seeking permission to change the lot line between Lots 10 and 11 to correct an encroachment
over the lot line. They would like to build a 3 bedroom house on Lots 13 thru 17.
The Board asked which lots are owned by the applicants. Attorney Johnson responded that they own
Lots 8 thru 17 on the westerly side of Holly Lane and Lots 5 thru 7 on the easterly side. The Board asked
which lots are part of the relief being requested. He stated that the Special Permit request is for Lots 8
thru 10 to allow a change of the lot line. The Variance request is to allow Lots 13 thru 17 to be considered
buildable.
The Board discussed the Lot Shape Factorwhlch will become more nonconforming for Lots 8 thru 10.
Attorney Johnson informed the Board that.they went before the Conservation Commission on January 18,
2000 and that another meeting is scheduled for a site visit before they decide on the matter,
Ron Jansson asked If the existing septic systems comply.with current Title V regulations. Attorney
Johnson stated that he has been Informed by Peter Sullivan that they do. The septic systems for the
middle and last house(moving away from Long Pond)are located across the street on Lot 5. There Is an
easement for the septic systems but Lots 5 thru 7 are still buildable. Attorney Johnson stated that as-of-
right a septic system for a new house on Lots 5-7 could be put across the street.
The Board asked who is currently residing In the 3:exlsting dwellings. Attorney Johnson stated that the
Dunbars live in the first house(closest to Long Pond),their daughter Is renting the middle dwelling and
their other daughter is renting the third house.
Public Comment: Fred Hulme addressed,the Board,, He is in favor of allowing a house to be built on
Lots 13-17 but not on Lots 5-7. He stated the herring run flows toward Pine Street,away from Long Pond.
No one else spoke in favor or In opposition to this appeal.
Findings of Fact:
At the hearing of January 19,2000,the Board unanimously found the following findings of fact as related
to Appeal No. 1099-155:
1. Appeal Number 1999-154 is a request for a Variance from Section 3.1,1(5)Bulk Regulations-Lot
Size. Appeal Number 1999-155 is a request for a Special Permit pursuant to Section 4-4.2(5)Merged
Lots. Both forms of relief are necessary for the purposes of obtaining the relief being sought.
2. The property in issue is owned by David B.and.Janet Cooke Dunbar. The property is addressed as
55.73 and 93 Holly Lane,Centerville, MA as shown on Assessor's Map 229,Paroels 015,016 and

3. The applicants first seek to divide Lots B-10 from Lots 11 and 12 and to change the lot line between
Lots 10 and 11 as shown on a plan of land titled'Sketch Plan Showing Shape Factor Comparisons",
scale 1'=40'and dated January 19,2000.
4. The applicants need a'Speciai Permit In order,to do this in view of the fact that all of the lots have
merged in common ownership.
5. Located on these 4 lots are 3 residential dwellings. No findings are made with reference to whether or
not they are legal pre-existing nonconforming since that is not before the Board,
6. The building located on Lots 11 and 12 Is serviced by a septic system located on Lot 5 across the
street. .
7. In granting the applicants a Special Permit(callow Lots 11 and 12 to be conveyed out separately as
has been produced will not be substantially more detrimental to the neighborhood affected nor would
it be In derogation of the spirit and Intent of the Zoning Ordinance, Section 4-4.2(5)allows for Special
Permit throughout the entire town for the purposes of making a lot more nonconforming as long as no
additional building lots are created.
8. The petitioners are not seeking to Increase the nonconformity on the lots by Increasing the size of any
of the buildings.
Decision:
Based on the findings of fact,a motion was duly'made and seconded to grant the relief being sought in
Appeal No. 1999-155,subject to the following terms and conditions:
1. The property shall be divided as shown the submitted,plan titled'Sketch Plan Showing Shape Factor
Comparisons',scale 1'=40'and dated January 19,2000 with the exception that Lot 13 shall be .
included with Lots 11 and 12 so the lots are of,a more uniform size In this neighborhood, No further
alterations to the lot lines shall be permitted.
2. All approvals from the Board of Health which may be.necessitated by this relief or which may be
necessitated by the new p►ovislons of Title V shall be complied with without any additional variance by
the petitioners.
3. No portion of any structure on either of the two lots(Lots 8-12)shall be added onto or expanded in
any way nor shall there be any further construction of any structures on these lots.
4. Lots 5-7(across the street)shall remain unbulldable and shall remain the servient lot with.reference to
Lots 8-12 fot the purposes of the septic systems.
5. The ANR Plan,to be endorsed by the Planning Board,shall reference this decision of the Board and
both the plan and decision shall be recorded at the same time at the Barnstable County Registry of
Deeds.

meet the same R value requirement as above-grade walls. Windows and sliding glass doors of conditioned

The current exemption for"homeowners"was extended to include owner-occupied dwellings of six units or
less and to allow homeowners to engage an individual for hire who does not possess a license,provided that
the owner acts as supervisor.
DEFINITION OF HOMEOWNER
Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is
intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or
farm structures. A person who constructs more than one home in a two-year period shall not be considered
a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the
Building Official,that he/she shall be responsible for all such work performed under the building permit.

HOMEOWNER'S EXEMPTION
The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the
provisions of this section(Section 109.1.1-Licensing of construction Supervisors):provided that if the homeowner engages a
person(s)for hire to do such work,that such Homeowner shall act as supervisor."
Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see
Appendix Q,Rules&Regulations for Licensing Construction Supervisors.Section 2.15) This lack of awareness often results in
