The applicants bought the property in March 1993. Recently, they put in new septic systems for all three houses. Pursuant to a variance granted by the Board of Health, the septic systems are located across the street on property owned by the applicants. That lot still has room for a single family home and its own septic system. It was during the Board of Health process that the encroachment was discovered,by the applicants. The Board asked to see the variance from the Board of Health to make sure there are no restrictions placed on the lot. [Attorney Johnson to supply.] The applicants wish to sell the"middle house"to their daughter and build a 3 bedroom single-family residence on the adjoining vacant land to the south. That vacant land is almost one acre. There is a man-made herring run behind the property limiting the upland calculations. Most of the homes in the area are located on '/Z acre lots. The applicants are aware of the need for Conservation Commission approval before they build anything. The new home will be on town water. Attorney Johnson reviewed the different lot lines and the structures on each lot. Some of the structures currently encroach on the lot lines. The applicants have a signed ANR Plan (signed August 08, 1999)for the new configuration of the lots for the creation of Parcel 1 and Parcel 1A. There will be one parcel with two houses and the applicants will keep it in their name and they are seeking to create a buildable lot with the remaining land. For zoning purposes, all the lots have merged because of common ownership. For the record, the applicants bought all the property-three houses and all the lots (on both sides of the street)for$195,000 in 1993. The Board asked about ground water flows with reference to Long Pond. Attorney Johnson reported that Peter Sullivan [Sullivan Engineering, Inc.] did a groundwater evaluation and he could report back to the Board if they so desired. The Board asked Attorney Johnson to explain the Variance conditions as they felt- if there were any hardship conditions-they might be self-imposed. Attorney Johnson explained that because the applicants also own the land across the street, they could build the house on that lot and would not need zoning relief. However, they'would prefer to build on the this side of the road as that is a bigger lot. They would consider"swapping"their buildability rights from the lots on one side of the private way to the lots on the other side by putting on deed restrictions. specifically, the applicants would restrict Lots 5, 6, and 7 to never being built on [in perpetuity] in exchange for the buildability,of Lots 13-17-a quid-quo-pro- if the Board.would be amicable. Without zoning relief, there could be a total of four houses on all these lots but not at the preferred location of the applicants. If granted the relief, they would limit the number of houses on all these lots to four structures- in perpetuity. Board Member Ralph Copeland asked about the possibility of a demolition of the small cottage to make the lots less crowded. Attorney Johnson explained that is the home of the applicants' other daughter and it would also cause a more nonconforming situation for Lot 8. Public Comment: .Janice Dunbar addressed the Board. She explained that when they bought the property there were many problems and they have spent a lot of money to clean up the property and they have taken care with regard to the herring run and the ground water. There is a letter of support from Earl E. Brown, Jr. in the file. No one else spoke in favor or in opposition to these appeals. Attorney Johnson requested a continuance to allow him time to get the Board information about the lots across the street and Board of Health information/input. They will also consider whether or not to withdraw the application(s). Pursuant to a variance granted by the Board of Health, the septic systems are located across the street on property owned by the.applicants. That lot still has room for a single family home and its own septic system. It was during the Board of Health process that the encroachment was discovered.by the applicants. The Board asked to seethe variance from the Board of Health to make sure there are no restrictions placed on the lot. [Attorney Johnson to supply.) The applicants wish to sell the"middle house"to their daughter and build a 3 bedroom single-family residence on the adjoining vacant land to the south. That vacant land is almost one acre. There is a man-made herring run behind the property Limiting the upland calculations. Most of the homes in the area .are located on acre lots. The applicants are aware of the need for Conservation Commission approval before they build anything. The new home will be on town water. Attorney Johnson reviewed the different lot lines and the structures on each lot. Some of the structures currently encroach on the lot lines. The applicants have a signed ANR Plan (signed August 08, 1999)for the new configuration of the lots for the creation of Parcel 1 and Parcel 1A. There will be one.parcel with two houses and the applicants will keep it in their name and they are seeking to create a buildable lot with the remaining land. For zoning purposes, all the lots have merged because of common ownership. For the record, the applicants bought all the property-three houses and all the lots (on both sides of the street)for$195,000 in 1993: The Board asked about ground water flows with reference to Long Pond. Attorney Johnson reported.that Peter Sullivan [Sullivan Engineering,'Inc.] did a groundwater evaluation and he could report back to the Board if they so desired. The Board asked Attorney Johnson to explain the Variance conditions as they felt-if there were any hardship conditions -they might be self-imposed. Attorney Johnson explained that because the applicants also own the land across the street, they could build the house on that lot and would not need zoning relief. However, they would prefer to build on the this side of the road as that is a bigger lot. They would consider"swapping" their buildability rights from the lots on one side of the private way to the lots on the other side by putting on deed restrictions. Specifically, the applicants would restrict Lots 5, 6, and 7 to never being built on [in perpetuityl.in exchange for the buildability of Lots 13-17-a quid-quo-pro-if the Board would be amicable. Without zoning relief, there could be a total of four houses on all these lots abut not at the preferred location of the applicants. If granted the relief, they would limit the number of houses on all these lots to four structures- in perpetuity. Board Member Ralph Copeland asked about the possibility of a demolition of the small cottage to make the lots less crowded. Attorney Johnson explained that is the home of the applicants' other daughter and it would also cause a more nonconforming situation for Lot 8. Public Comment: Janice Dunbar addressed the Board. She explained that when they bought the property there were many problems and they have spent a lot of money to cleanup the property and they have taken care with regard to the herring run and the ground water. There is a letter of support from Earl E. Brown, Jr. in the file. No one else spoke in favor or in opposition to these appeals. Attorney Johnson requested a continuance to allow him time to get the Board information about the lots across the street and Board of Health information/input. He has leased a.portion of the property for the applicants. Attorney Johnson responded that the tenant has moved out so there is'no longer any financial gain and, therefore, no conflict of interest. Mr. Burman stated he would still like to step down to avoid any appearance of a conflict of interest. The Board asked if the applicants wanted to go forward with a four member Board. After discussion with the applicants, Attorney Johnson informed the Board they would like to go forward and take their chances with only four Board Members. At the start of the hearing, Attorney Johnson provided the Board with several maps showing the existing layout, the proposed layout and the building envelope. He also provided the Board with an amended request which includes Lots 5 thru 7. The applicants are willing to forego building a house on.Lots 5 thru . 7 if they are allowed to build a 3 bedroom house on Lots 13,thru 17. Attorney Johnson described the proposal. The applicants wish to sell Lots 11 and 12 to their daughter. They are seeking permission to change the lot line between Lots 10 and 11 to correct an encroachment over the lot line. They would like to build a 3 bedroom house on Lots 13 thru 17. The Board asked which lots are owned by the applicants. Attorney Johnson_responded that they own Lots 8 thru 17 on the westerly side of Holly Lane and Lots 5 thru 7 on the easterly side. The Board asked which lots are part of the-relief being requested. He stated that the Special Permit request is for Lots 8 thru 10 to allow a change of the lot line. The Variance request is to allow Lots.13 thru 17 to be considered buildable. The Board discussed the Lot Shape Factor which will become more nonconforming for Lots 8 thru 10. Attorney Johnson informed the Board that they went before the Conservation Commission on January 18, 2000 and that another meeting is scheduled for a site visit before they decide on the matter. Ron Jansson asked if the existing septic systems comply with current Title V regulations. Attorney Johnson stated that he has been informed by Peter Sullivan that they do. The septic systems for the middle and last house (moving away from Long Pond)are located across the street on Lot 5. There is an easement for the septic systems but Lots 5 thru 7 are still buildable. Attorney Johnson stated that as-of- right a septic system for a new house on Lots 5-7 could be put across the street. The Board asked who is currently residing in the 3 existing dwellings. Attorney Johnson stated that the Dunbars live in the first house(closest to Long Pond); their daughter is renting the middle dwelling and their other daughter is renting the third house. Mr. Schultz stated that he would proceed with a four- member Board citing that he realized that all would have to vote in the affirmative to grant any modification. Mr. Schultz stated that the on-site septic system had been installed in conformance with Title 5 regulations; however, a variance was necessary from the local Board of Health regulations to provide sufficient separation between the leach field'and high groundwater. It is zoned Residential D-I Zoning District and is within the Resource Protection Overlay District that now requires two-acre minimum lot area: 2.
