Relief Requested &Background
The petition of Jay Jackson is a request for a variance to the provision (M) of accessory Home w
Ui
Occupation to permit a sign. Section 4-1.4(1) permits a customary home occupation as-of-right in all
zoning districts subject to conditions. One of those conditions-provision (M) states "No sign shall be
displayed indicating the Customary Home Occupation."
On October 15,.1999, Mr.Jackson was issued a Business Certificate from the Town of Barnstable to
conduct his customary home occupation. He is now seeking a variance to place a 7-1/4 by 14 inch sign
on his mailbox. The sign is to read"Jay Jackson-Carpenter- 508-771-4985".
According to the Assessor's Record, the property is a .27-acrea lot located at the intersection of Huckins
Neck and Conners Roads. It is developed with a one-story 1,503 sq.ft., three-bedroom single-family
dwelling built in 1964. A garage of 308 sq.ft. is attached to the dwelling.
Procedural&Hearing Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
February 20, 2002. An extension of time for holding the hearing and for filing of the decision was executed
between the applicant and the Board. A public hearing before the Zoning Board of Appeals was duly
advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened
April 17,2002, at which time the Board found to deny the requested variance..
Board members deciding this appeal were Richard L.Boy,Ralph Copeland,Randolph Childs and Vice
Chairman Gail Nightingale. The applicant,Mr.Jay Jackson represented himself..
The applicant,Mr. Jay.Jackson represented himself at the hearings. The Vice Chairman noted to Mr.
Jackson that there were only four board members present to hear this appeal and that it would require a
unanimous vote to grant the Variance. Mr.Jackson agreed to go forward with the appeal and the four-
member board.
Mr.Jackson explained the size of the sign and noted it was a gift and that he was encouraged by his
neighbor to hang the sign outside to advertise his trade as a carpenter. The Board noted that it was very
specific in the ordinance that no signage is to be permitted along with a home occupation. Mrs.
Nightingale asked for those unique conditions that would justify the Board granting a variance. Mr.
Jackson said that he would like to hang this sign on his mailbox.
The Board reiterated that they take a very dim view of granting signage relief especially within the single-
family neighborhoods. They again stated that unique conditions must exist to satisfy the requirements of

MGL Chapter 40A Section 10 to permit the Board to grant a variance and that none has been established.
They asked Mr.Jackson if he would like to continue this appeal or withdraw it without prejudice so as to
return at a later time when he could establish conditions for the granting of a variance. Mr.Jackson
remarked that he would prefer a decision today and that he had no other reason or justification for the
grant of a variance for the sign.
Findings of Fact:
At the hearing of April 17, 2002,the Board unanimously made the following findings of fact:
1. Appeal 2002-39 is that of Mr.Jay Jackson requesting a Variance to Section 4-1.4(1)M to allow the
placement of a sign in his front yard advertising carpenter. The property is shown on Assessor's Map
251, Parcel 068, and is commonly addressed 4 Huckins Neck Road,Centerville, MA, in a Residential
D-1 Zoning District. .
2. In consideration for the Variance,the applicant has not substantiated those conditions unique to this
lot that justify the granting of the relief being.sought as required by MGL Chapter 40A, Section 10.
3. -No unique conditions have been shown to exist that affect
the locus.
4. A.literal enforcement of the provisions of the Zoning Ordinance would not involve substantial
hardship, financial or otherwise to the petitioner.
5. This relief if granted would be a substantial detriment to the public good and would nullify and
substantially derogate from the intent or purpose of the Zoning Ordinance. It would set a precedence
for allowing commercial signage.throughout single-family neighborhoods within the town.
Decision:
Based on the findings of fact, a motion was duly made and seconded to deny the appeal.
The vote was as follows:

Appeal 2002-39 is denied. Appeals of this decision, if any, shall be made pursuant to MGL Chapter 40A,

INTENT: It is the intent of this section to, the residents of the Town of Barnstable to operate a home occupation
within single family dwellings,subject to the provisions of Section 4.1.4 of the Zoning ordnance,provided that the
activity shall not be discernible from outside the dwelling: there shall be no increase in noise or odor,no visual
alteration to the premises which would suggest anything other than a residential use;no increase in traffic above normal
residential volumes;and no increase in air or groundwater pollution.
After registration with the Budding Inspector,a customary home occupation shall be permitted as of right subject to the
following conditions:
• The activity is carried on by the permanent resident of a single family residential dwelling unit,located
within that dwelling unit.
• Such use occupies no more than 400 square feet of space.
• There are no external alterations to the dwellingwhich are not customary in residential buildings,and
there is no outside evidence of such use.
• No traffic will be generated in excess of normal residential volumes.- j
• The use does not involve the production of offensive noise,vibration,smoke,dust or other particular
matter,odors,electrical disuirbance,heat,glare,humidity or other objectionable effects.
• There is no storage or use of toxic or hazardous materials,or flaum cable or explosive materials,in excess
of normal household quantities.
Any need for parking generated by such use shall be met on the same lot containing the Customary Home
Occupation,and not within the required front yard.
• There is no exterior storage or display of materials or equipment.
• There is no commercial vehicles related to the Customary Home Occupation,other than one van or one
pickup truck not to exceed one ton capacity,and one sailer not to exceed 20 feet in length and not to
exceed 4 tires,parked on the same lot containing the Customary Home Occupation.
• No sign shall be displayed indicating the Customary Home Occupation..
• If the Customary Home Occupation is listed or advertised as a bii iness,the street address shall not be
included.
e No person shall be employed in the Customary Home Occupation who is not a permanent resident of the
dwelling unit.
