Dear Mr . Daluz:
As you know the above lot does not meet the current dimensional
standards under the Barnstable Zoning Bylaw.
However , the lot went into ownership separate from that of }
adjoining land Qn and has been in
ownership separate from that of adjoining land to the present
day. At the time the lot went into separate 'ownership it had
the benefit of the previous grandfather clause which was in our
zoning bylaw which gave building protection to the lots shown
on certain board of survey plans. This lot is shown on one of
the protected board of survey plans .
It is my opinion that , since the lot went into ownership
separate from adjoining land while it was "otherwise buildable"
under the previous grandfather clause, it therefore meets the
criteria of the current grandfather clause in our zoning bylaw
making it a buildable lot for single family residential use.
